Justitie:AlgemeenSamenvatting: Dit Verdrag behelst een brede waaier aan civiele beschermingsmaatregelen van kinderen, gaande van bevelen inzake ouderlijke verantwoordelijkheid en contact tot openbare maatregelen voor bescherming en zorg, zaken rond vertegenwoordiging en de eigendommen van kinderen. Het Verdrag legt uniforme regels vast om te bepalen welke autoriteiten van welk land bevoegd zijn om de nodige beschermingsmaatregelen te nemen, en welke wetten van welk land hierop van toepassing moeten zijn. Het voorziet ook in erkenning en handhaving in alle lidstaten van maatregelen die in een andere lidstaat genomen werden. Samenwerking tussen de autoriteiten is erg belangrijk. Het Verdrag is bijzonder relevant inzake omgang en toegang, kinderontvoering, niet-begeleide minderjarige vreemdelingen en grensoverschrijdende plaatsing van kinderen. Summary: This Convention covers a very wide range of civil measures of protection concerning children, from orders concerning parental responsibility and contact to public measures of protection or care, and from matters of representation to the protection of children’s property. The Convention has uniform rules determining which country’s authorities are competent to take the necessary measures of protection and which country’s laws are to be applied. It also provides for the recognition and enforcement of measures taken in one Contracting State in all other Contracting States. Cooperation between Central Authorities is key. The Convention is of particular relevance in the areas of parental disputes over custody and contract, child abduction, unaccompanied minors and cross-frontier placement of children. Inwerkingtreding in België: 1 november 2005.Taal : Engels (eng) Trefwoorden: Gezin:Adoptie Samenvatting: Dit Verdrag, in lijn met artikel 21 VRK, was ontwikkeld om safeguards vast te stellen die ervoor zorgen dat interlandelijke adoptie altijd in het belang van het kind is en de fundamentele rechten van het kind respecteert. Het Verdrag erkent dat het opgroeien in een familiale omgeving van groot belang is voor het geluk en de gezonde ontwikkeling van het kind. Het erkent eveneens dat interlandelijke adoptie het voordeel biedt van een permanente familie voor een kind voor wie in zijn of haar geboorteland geen passende familie kan gevonden worden. Door duidelijke procedures uiteen te zetten en onverantwoorde financiële winst te verbieden, voorziet het Verdrag in meer veiligheid, voorspelbaarheid en transparantie voor alle partijen die bij de adoptie betrokken zijn. Het Verdrag stelt ook een samenwerkingssysteem tussen autoriteiten in het land van oorsprong en het land van bestemming op, wat speciaal ontworpen is om ervoor te zorgen dat interlandelijke adoptie plaatsvindt onder voorwaarden die ertoe bijdragen de beste adoptiepraktijken te garanderen en misbruik uit te roeien. Summary: In line with Article 21 CRC, this Convention was developed to establish safeguards ensuring that intercountry adoptions take place in the best interest of the child and with respect for the child’s fundamental rights. The Convention recognises that growing up in a family is of primary importance and is essential for the happiness and healthy development of the child. It also recognises that intercountry adoption may offer the advantage of permanent family to a child for whom a suitable family cannot be found is his or her country of origin. By setting out clear procedures and prohibiting improper financial gain, the Convention provides greater security, predictability and transparency for all parties to the adoption. The Convention also establishes a system of co-operation between authorities in countries of origin and receiving countries, designed to ensure that intercountry adoption takes place under conditions which help to guarantee the best adoption practices and elimination of abuses. Het doet dit door een systeem van samenwerking tussen Centrale Autoriteiten vast te leggen, alsook door een snelle terugkeer van het kind naar zijn of haar land van gewoon verblijf te vergemakkelijken. Het Verdrag start van de vooronderstelling dat het onwettig verwijderen of vasthouden van een kind over internationale grenzen heen niet in het belang van dit kind is. Zo is het hoofddoel van het Verdrag – naast het vrijwaren van de toegangsrechten – kinderen tegen de schadelijke effecten van ontvoering of vasthouding te beschermen. Hoewel het Verdrag reeds voor het VRK werd goedgekeurd, helpt het om een aantal fundamentele rechten van het kind ten uitvoering te brengen, zoals deze uitgedrukt in artikels 11, 35, 9§3 en 10§2 van het VRK. Summary: This Convention seeks to combat parental child abduction by providing a system of cooperation between Central Authorities and a rapid procedure for the return of the child to the country of the child’s habitual residence. It starts from the presumption that the wrongful removal or retention of a child across international boundaries is not in the interests of the child. As such, the principal object of the Convention, aside from protecting rights of access, is to protect children from the harmful effects of cross-border abductions and wrongful retentions. Even though the Convention predates the CRC, it helps to give effect to the fundamental rights of the child such as those expressed in Articles 11, 35, 9§3 and 10§2 CRC. Het Verdrag is van toepassing op gevallen van kinderbijstand. Globaal spitst het Verdrag zich toe op het procederen van aanmeldingen, effectieve toegang tot procedures, erkenning en handhaving van bestaande beslissingen, onderhoudsovereenkomsten, en handhaving in het intern rechtssysteem. Het Verdrag wordt aangevuld door een Protocol inzake de wet die van toepassing is op onderhoudsgeschillen. Summary: The object of the Convention is to ensure the effective international recovery of child support and other forms of family maintenance. The Convention applies on a mandatory basis to child support cases. On the whole, the Convention focuses on the processing of applications, effective access to procedures, recognition and enforcement of existing decisions, maintenance arrangements, and enforcement under internal law. The Convention is supplemented by a Protocol dealing with the applicable law to maintenance disputes. Als een instrument binnen internationaal privaatrecht, doelt het Verdrag er hoofdzakelijk op om conflicten tussen wetten aan te pakken en op te lossen. Nadat Hoofdstuk I de reikwijdte van het Verdrag heeft bepaald, gaat Hoofdstuk II verder met hoe men bepaalt welke wet van toepassing is. Hoofdstuk III gaat dan verder met diverse bepalingen, terwijl Hoofdstuk IV concludeert met de finale bepalingen. Summary: This Convention aims to establish common provisions concerning the law applicable to maintenance obligations arising from a family relationship, parentage, marriage or affinity, including a maintenance obligation in respect of a child who is not legitimate. As a Private International Law document, it aims to govern and resolve conflicts of laws in this regard. After Chapter I has established the scope of the Convention, Chapter II sets forth how to determine the applicable law. Chapter III then continues with miscellaneous provisions, whereas the final provisions are addressed in Chapter IV.
