Kinderrechten (inter)nationaal:Landen en regio's:Azië & Pacific:Nieuw ZeelandSamenvatting: Deze studie wil onderzoeken wat de verschillende betekenissen zijn van discipline binnen het gezin en fysieke bestraffing vanuit het perspectief van kinderen. Dit is nodig om uit te leggen hoe discipline invloed uitoefent op kinderen, nu en in de toekomst. Er bestaat ook bezorgdheid over de uitvoering van Artikel 19 van het VN VRK. Dit artikel geeft aan dat de statelijke partijen ervoor moeten zorgen dat er gepaste wettelijke maatregelen worden genomen om het kind te beschermen tegen alle vormen van fysiek en mentaal geweld, misbruik, verwaarlozing, verwondingen en mishandeling. Nieuw–Zeeland heeft een verplichting om procedures te implementeren om kinderen te beschermen tegen geweld. Deze studie werpt licht over het feit dat kinderen een fysieke bestraffing al dan niet aanzien als een deel van de discipline van de familie, en geeft de impact weer volgens de kinderen zelf. Summary: This study wants to examine the different meanings of family discipline and physical punishment from the perspective of children. This is necessary to explain how discipline affects children, now and in the future. There also exist concerns about the implementation of Article 19 of the UN CRC. This article says that State Parties should make sure that appropriate legislative measures are taken to protect the child against all forms of physical and mental violence, abuse, neglect, injury or maltreatment. New Zealand has an obligation to implement procedures to protect children from violence. The study casts more light on whether children experience physical punishment as a part of family discipline, and determines the impact it has, according to the children themselves. Kinderrechten (inter)nationaal:Landen en regio's:Azië & Pacific:Nieuw ZeelandSamenvatting: De perspectieven van 66 kinderen en jongeren (tussen 8-9 en 14-15 jaar) over hun begrip van burgerschapszaken werden verkregen door focusgroepsdiscussies in scholen in Nieuw-Zeeland. De kinderen gaven verslag over hun rechten en verantwoordelijkheden in de dagdagelijkse context van hun thuis, school en gemeenschap. Een oefening waarbij de kinderen zich een denkbeeldig land voorstelden, werd gebruikt om hun antwoorden te vergelijken met hun huidige leven in Nieuw-Zeeland. In het algemeen zagen de kinderen dit denkbeeldig land aan als veiliger, vrolijker en gezonder, met een grotere vrijheid en meer respect dan dat ze op het moment zelf ervoeren. Summary: The perspectives of 66 children and young people (aged 8/9 and 14/15 years) on their understanding of citizenship issues were obtained through focus group discussions in New Zealand schools. The children reported on their rights and responsibilities in the everyday contexts of home, school and community. An imaginary country exercise was also utilized to compare children's responses with their current lives in New Zealand. Children generally conceived of the new land as safer, happier and healthier, with greater freedoms and respect than they currently enjoyed. Het is zeer goed mogelijk dat er moeilijkheden zullen optreden met betrekking tot de complicaties bij het faciliteren van de agency van kinderen, hun stem en hun participatie binnen de Rechtbank. Toch heeft de COC wet (Continuüm van Zorg Programma) het recht op participatie voor kinderen versterkt in de betwiste procedures van het familierecht. De Nieuw-Zeelandse Familierechtbank implementeert nieuwe stijlen van wettelijke en gerechtelijke praktijken en deze bieden betere kansen aan voor de uitdrukking van de standpunten van kinderen en hun begrip over de familiesituatie en zorgregeling te verdiepen. Het statutaire regime reflecteert beginselen van het VN VRK en de socio-culturele beginselen. Summary: In the future, it will become difficult for the Family Court to reconcile the traditional approach of law with the reformulated view of childhood. It is very likely that difficulties will be created with regards to the complexities concerning the facilitation of children's agency, voice and participation within the Court. However, the COC Act (Continuum of Care Program) has strengthened the children's right to participate in contested family law proceedings. The New Zealand Family Court implements new styles of legal and judicial practices and these provide better opportunities for the expression of children's views and to increase the understanding about family situation and care arrangements. The statutory regime reflects the UN CRC and sociological/socio-cultural principles. Elk kind en elke familiale situatie is uniek, en de perspectieven van kinderen bieden waardevolle informatie hierover. Kinderen zijn in staat hun eigen meningen, bedoelingen en moeilijkheden te communiceren, op voorwaarde dat hun sociale context en volwassen partners gevoelig zijn voor hun perspectieven. Binnen deze context kan de veronderstelling dat kinderen niet de juiste leeftijd of rijpheid hebben om deel uit te maken van het beslissingsproces betwijfelbaar. Het sleutelprobleem is niet de bekwaamheid van het kind, maar de mogelijkheid van volwassenen om een vertrouwende, ondersteunende en wederzijdse relatie te bieden waarbinnen de stem en de participatie van het kind kan worden gefaciliteerd. Summary: This article argues that the assumption that it is a burden of responsibility for children to be involved in family or legal decision-making is problematic. Each child and family situation is unique, and children's perspectives provide valuable information on this. Children can communicate their views, intentions and difficulties provided that their social contexts and adult partners are sensitive to their perspectives. Within this context, the assumption that children lack sufficient age and maturity to participate in decision-making is questionable. The key issue is not the child's competence, but the adults' ability to provide a trusting, supportive and reciprocal relationship within which the child's voice and participation can be facilitated.
