Experten inzake kinderbescherming en –rechten vanuit 42 landen (6 geïndustrialiseerde landen en 36 ontwikkelingslanden) vulden een enquête in over artikel 19 van het VRK en de vereiste implementatie van kinderbeschermingsmaatregelen. Vervolgens werden de landen beoordeeld op basis van de effectiviteit van de implementatie, het huidige niveau van effectiviteit van kinderbescherming en de relevantie van de verbeteringen van kinderbescherming sinds het VRK werd aangenomen in 1989. De resultaten tonen aan dat de succesvollere kinderbescherming een combinatie van twee types sociale programma’s vereist: infrastructuur die de kinderbescherming ondersteunt (wetgeving en diensten) en ten minste één ondersteuningsprogramma voor interventie gebaseerd op informatie. De studie benadrukt de nood voor overheden om een systematische benadering op te nemen voor kinderbescherming, inclusief beleid en wetgeving, programma’s en sociale diensten gebaseerd op informatie, net als professionele training en het bewustmaken van het publiek. Summary: This study was designed to obtain information from developed and developing countries on the level of implementation of the United Nations Convention on the Rights of the Child (CRC) required child protection measures, and to evaluate the impact of implementation on the establishment of a basic child protection system. Child protection and rights experts from 42 countries (6 industrialised and 36 developing) completed a questionnaire on CRC Article 19 required child protection measures implementation and rated their country's effectiveness in implementation, the current level of effectiveness of child protection, and the relevance of improvements in child protection since the CRC was adopted in 1989. The results indicate that more successful child protection requires a combination of 2 types of social programmes: a child protection infrastructure (legislation plus services) and at least one information-based intervention support programme. The study reinforces the need for governments to take a systems approach to child protection, including policy/legislation, information-based programmes and social services, as well as professional training and public awareness raising. Anayses van de relevante geschiedenis en kennis, inclusief effectieve en veelbelovende kinderbeschermingsstrategieën, worden toegpast om de formulatie van het GC en de implementatiecomponenten met hoge prioriteit te begeleiden. Consultaties over het ontwerp en de ondersteunende producten worden uitgevoerd in samenwerking met UNICEF, WHO, de NGO Groep voor het VRK en andere NGO’s. Advies moet worden gevraagd aan geïntreseerde partijen en organisaties in persoon en door communicatie op afstand over de gehele wereld. An international working group (GC19WG), Expert Advisory Panel (EAP), and GC19 Focal Group of Committee members (GC19 CRC FG) have been organized to help guide and carry out the program of development. Analyses of relevant histories and knowledge, including effective and promising child protection strategies, are being applied to guide formulation of the GC and high priority implementation components. Consultations on the draft and supportive products will be conducted in cooperation with UNICEF, WHO, the NGO Group for the CRC, and other NGOs. Advice is to be solicited from interested parties and organizations in person and through distance communication throughout the world. In addition to the GC19, numerous implementation supports will be planned and some will be produced and piloted during the program of development. Dit artikel adresseert problemen in verband met kinderrechten en bescherming die naar voor werden gebracht tijdens deze periode, net als tijdens de consultatie en de hieruit voortkomende dialogen, zoals de rechten van het kind in een vroeg/verplicht huwelijk, en de rol van de statelijke partijen als een verantwoordelijke zorgverlener wanneer ouders of familie niet in staat zijn om zorg te verschaffen. Summary: The UN Committee on the Rights of the Child established CRC General Comment 13 (April 2011) to address today's unabating high rates of violence against children globally despite CRC advances. GC13 provides clear interpretations and stronger detail to supplement the legal language of CRC Article 19, intended to establish protection of children from all forms of violence. Through GC13, the Committee seeks to strengthen policy and practice implementation for all children, including every nation's most vulnerable, by clearly establishing measurable indicators: structure, process and outcomes to children-through improved technical information, expertise and assistance. Based on knowledge and experience gained over the 22 years since the CRC was adopted, GC13 advances best practice approaches and technical resources for States Parties and professionals on preventing violence against children, and on strengthening protection programs, systems, services, research, monitoring, evaluation and reporting. This article addresses child rights and protection issues which have been raised during this period, as well as during the consultation and resulting dialogues, such as the rights of children in early/forced marriage, and the role of the State Party as responsible caregiver when parents or families are not capable of providing protection.
