Het recht van kinderen om gehoord te worden in de adoptieprocedures vloeit direct voort uit de bepalingen van het Kinderrechtenverdrag van de VN, dat geratificeerd werd door bijna elk land ter wereld. In deze paper zal de interpretatie door de Europese rechtspraak betreffende dit principe geanalyseerd worden, zowel voor kinderen die oud genoeg zijn om bepalende beslissingen met betrekking tot hun toekomst te nemen alsook voor jongere kinderen aan wie het recht om gehoord te worden al is toegekend. De brede verscheidenheid van de praktijk in Europa benadrukt het gebrek aan vooruitgang in dit rechtsgebied, hetgeen niet bijgestaan wordt door de conservatieve rechtspraak van het Europees Hof van de Rechten van de Mens. |
| Summary: |
The right of the child to be heard in adoption proceedings flows directly from the provisions of the United Nations Convention on the Rights of the Child, ratified by almost every country in the world. In this paper, the interpretation of this principle across European jurisdictions will be analysed, both in terms of children who are old enough to make a determinative decision concerning their future, and those who are younger yet still possess the right to be heard. The wide variety of practices in Europe highlight the lack of progress in this field of law, which is not assisted by the conservative jurisprudence of the European Court of Human Rights. |
