Dit beoordelingsinstrument biedt specifieke en meetbare indicatoren waarmee staten vooruitgang kunnen meten bij de uitvoering van Aanbeveling CM / Rec (2012) 2 van het Comité van Ministers aan de lidstaten over de deelname van kinderen en jongeren onder de 18 jaar. Deze aanbeveling erkent artikel 12 (eerbiediging van de visie van het kind) als een grondrecht en als een algemeen beginsel van het VN-Verdrag inzake de rechten van het kind (UNCRC), een mensenrechtenverdrag dat door alle lidstaten is geratificeerd. Voorts erkent het dat artikel 12 als algemeen beginsel de uitvoering van alle andere rechten moet sturen en niet alleen verband houdt met de andere drie algemene beginselen van het IVRK, artikel 2 (het recht op non-discriminatie), artikel 3 ( primaire overweging van de belangen van het kind), en artikel 6 (het recht op leven, overleven en ontwikkeling), maar ook met artikel 5 (begeleiding door ouders en evoluerende capaciteiten van het kind), artikel 13 (het recht op vrijheid van uitdrukking), artikel 15 (het recht op vrijheid van vereniging) en artikel 17 (het recht op informatie). De Aanbeveling van de Raad van Europa (2012) 2 definieert participatie als "individuen of groepen kinderen die het recht, de middelen, de ruimte, de gelegenheid en, waar nodig, de steun hebben om vrijuit hun mening te geven, om te worden gehoord en om bij te dragen aan de besluitvorming over aangelegenheden die hen aangaan, hun standpunten naar behoren beoordeeld in overeenstemming met hun leeftijd en volwassenheid." |

This Assessment Tool provides specific and measurable indicators with which States can begin to measure progress in implementing Recommendation CM/Rec(2012)2 of the Committee of Ministers to member States on the participation of children and young people under the age of 18. This Recommendation recognises Article 12 (respect for the views of the child) both as a fundamental right and as a general principle of the UN Convention on the Rights of the Child (UNCRC), a human rights treaty that has been ratified by all member States. It further recognises that as a general principle, Article 12 needs to guide the implementation of all other rights, and is linked not only to the other three general principles of the UNCRC, Article 2 (the right to non-discrimination), Article 3 (primary consideration of the best interests of the child), and Article 6 (the right to life, survival and development), but also to Article 5 (guidance by parents and evolving capacities of the child), Article 13 (the right to freedom of expression), Article 15 (the right to freedom of association) and Article 17 (the right to information). The Council of Europe Recommendation (2012)2 defines participation as “individuals or groups of children having the right, the means, the space, the opportunity and, where neces-sary, the support to freely express their views, to be heard and to contribute to decision making on matters affecting them, their views being given due weight in accordance with their age and maturity.” |
