Gezin:Alternatieve zorg:Residentiële zorgSamenvatting: Uit hoofde van artikel 20 Internationaal Verdrag inzake de rechten van het kind (hierna: IVRK) heeft een kind dat niet in het eigen gezin kan opgroeien “recht op bijzondere bescherming en bijstand van staatswege”, ook wel het recht op alternatieve zorg genoemd. Wereldwijd leven miljoenen kinderen echter zonder (adequate) ouderlijke zorg, terwijl een geschikt alternatief niet voorhanden is. In dit betoog wordt ingegaan op de betekenis van het recht op alternatieve zorg. Daartoe wordt bovenvermeld artikel 20 IVRK geanalyseerd, alsmede de nog relatief nieuwe VN-Richtlijnen Alternatieve Zorg voor Kinderen. Summary: Article 20 CRC grants a child that cannot grow up within his or her own family the entitlement for special protection and assistance provided by the State, also known as the right to alternative care. However, millions of children around the globe grow up without (adequate) parental care, without access to an appropriate alternative. This contribution discusses the significance of the right to alternative care. For this, the above mentioned article 20 CRC is analyzed, as well as the relatively new UN Guidelines on Alternative Care for Children. Kinderrechten (inter)nationaal:Landen en regio's:Afrika:AlgemeenSamenvatting: Afrika is de thuis van miljoenen kinderen zonder geschikte ouderlijke zorg of toegang tot gepaste alternatieve zorg. De primaire factoren die leiden tot deze situatie zijn HIV/aids, armoede, conflict en de afbrokkeling van het traditionele uitgebreide familiale netwerk. De afgelopen jaren is de internationale gemeenschap deze huishoudens met een kind aan het hoofd, waarin een kind de meerderheid van de verantwoordelijkheden heeft overgenomen van de voornaamste verzorger, beginnen zien als een vorm van alternatieve zorg. Daarom stelt de auteur de volgende princiepsvragen: Wat houdt het internationaal erkende recht op alternatieve zorg voor kinderen in? Is de erkenning van huishoudens met een kind aan het hoofd als een vorm van alternatieve zorg in lijn met het IVRK en andere internationale standaards die aangenomen zijn met de bedoeling om de inherente rechten van kinderen op bescherming, ontwikkeling, overleving en participatie te beschermen? Summary: Africa is the home to millions of children without adequate parental care or access to suitable alternative care. The primary factors leading to this situation are HIV/AIDS, poverty, conflict, and the disintegration of the traditional extended family network. In recent years the international community has started to view child-headed households –in which a child has taken over the majority of responsibilities of the main caregiver- as a form of alternative care. Therefore the author poses the following principle questions: What does the internationally recognized right to alternative care for children entail? Is the recognition of the child-headed household as a form of alternative care in line with the Convention on the Rights of the Child and other international standards which have been adopted as a measure to protect the inherent rights of children to protection, development, survival and participation?
