Media:AlgemeenSamenvatting: Dit protocol houdt een uitbreiding in van de reikwijdte van het verdrag inzake cybercriminaliteit, met inbegrip van de inhoudelijke, procedurele en internationale samenwerking, om zo ook de strafbare feiten van racistische of xenofobe propaganda te coveren. Dus, afgezien van de harmonisatie van de elementen van de substantieve wet van dergelijk gedrag, richt het protocol zich op verbetering van het vermogen van de partijen om het gebruik van de middelen en mogelijkheden van de internationale samenwerking in het Verdrag (ETS No. 185) in te stellen op dit gebied. Summary: This Protocol entails an extension of the Cybercrime Convention’s scope, including its substantive, procedural and international cooperation provisions, so as to cover also offences of racist or xenophobic propaganda. Thus, apart from harmonising the substantive law elements of such behaviour, the Protocol aims at improving the ability of the Parties to make use of the means and avenues of international cooperation set out in the Convention (ETS No. 185) in this area. Dit artikel geeft de brede constitutionele veranderingen aan die werden gemaakt met betrekking tot kinderen en de implicaties van deze veranderingen voor de legislatieve procedure, inclusief een discussie over het feit of het nieuwe burgerinitiatief al dan niet gebruikt kan worden als een manier om te lobbyen voor specifieke kwesties in verband met kinderrechten en de relatie tot het recht voor kinderen om te participeren. De impact van de verbeterde EU-agenda van fundamentele rechten op kinderrechten wordt beoordeeld, net zoals het Handvest van de grondrechten, de grondbeginselen van het EU-recht en het EVRM. Bijkomend presenteert het Verdrag van Lissabon nieuwe kansen om kinderrechten te integreren in alle fases van de besluitvorming en het implementatieproces. Het brengt ook sterkere instrumenten mee om een geschikt niet-legislatief antwoord te ontwikkelen voor de verschillende niveaus van noden die kinderen hebben, zoals beleids-, budget- en onderzoeksmethoden. Summary: The EU’s Lisbon Treaty presents the most important opportunity for the development of children’s rights since the EU’s existence. This article sets out the broader constitutional changes made that are of relevance to children and the implications of changes to the legislative procedure, including a discussion on whether the new Citizens’ Initiative might be exploited as a lobbying tool for specific children’s rights issues and its relation to the right of children to participate. The impact of the EU’s enhanced fundamental rights agenda on children’s rights is assessed, including the Charter of Fundamental Rights, the General Principles of EU Law and the ECHR. In addition, the Lisbon Treaty presents new opportunities for integrating children’s rights into all stages of the decision making and implementation process. It also provides sharper tools to develop adequate non-legislative responses to the diverse range of needs that children have, such as policy, budgetary and research initiatives. Kinderrechten (inter)nationaal:Landen en regio's:Europa:AlgemeenSamenvatting: De EU heeft een verhoogde interesse in kinderrechten, zoals gezien in de Communicatie COM(637) 2006 final, het Verdrag van Lissabon in 2009 en ‘Een EU agenda voor de Rechten van het Kind (COM(2011) 60 final)’. Artikel 24(1) van het Handvest van de Grondrechten van de Europese Unie bepaalt dat kinderen ‘hun mening vrij mogen uiten’. Deze meningen zullen in overweging worden genomen met betrekking tot zaken die het belang van kinderen aangaan in overeenstemming met hun leeftijd en maturiteit. De tijd is aangebroken om de mening van kinderen naar de EU toe te adresseren, in de verwachting dat de EU klaar is om hen mee in overweging te nemen. In onderzoek van twee EU lidstaten hebben 55 kinderen tussen de leeftijd van 5 en 13 jaar – in vluchtelingengroepen, etnische minderheden, al dan niet verzorgd, zigeuners, kinderen met beperkingen en jonge zorgzame kinderen – aanspraak gevorderd voor burgerschap. Dit artikel kijkt naar voorbeelden van de aanspraak van de groep in de context van het EU beleid om zo verder te onderzoeken wat de EU kan doen om te voldoen aan de verwachtingen van deze jonge burgers. Summary: There has been increasing interest in children’s rights from the EU, seen in the Commission’s 2006 Communication (COM(367) Final 2006), the Treaty of Lisbon 2009 and the Commission’s 2011 Communication ‘An EU Agenda for the Rights of the Child (COM(2011) 60 final)’. The Charter of Fundamental Rights of the European Union Article 24(1), states that children ‘may express their views freely’. Such views shall be taken into consideration on matters which concern them in accordance with their age and maturity. The time is therefore ripe to address the views of children towards the EU, in the expectation that the EU may be ready to take them into consideration. In research in two EU Member States, fifty-five children aged 5 to 13 – in groups of refugee, minority ethnic, looked after, gypsy traveller, disabled and young caring children – developed claims for citizenship. This article looks at examples of the groups’ claims in the context of EU policy, to explore what the EU could do to live up to the expectations of these young citizens.
