Mensenrechten:Economische, sociale en culturele rechtenSamenvatting: Dit Verdrag heeft betrekking op de economische, sociale en culturele rechten in het Inter-Amerikaanse gebied. De rechten van kinderen vallen onder artikel 16, waarin staat dat elk kind, ongeacht zijn afkomst, het recht heeft op de bescherming die zijn status als een minderjarige vraagt van zijn familie, de maatschappij en de Staat. Elk kind heeft het recht om te groeien onder de bescherming en de verantwoordelijkheid van zijn ouders, behalve in uitzonderlijke, juridisch-erkende omstandigheden. Een kind van jonge leeftijd behoort niet te worden gescheiden van zijn moeder. Ieder kind heeft ook het recht op gratis en verplicht onderwijs, althans in de elementaire fase, en het recht om zijn opleiding voort te zetten op hogere niveaus van het onderwijssysteem. Deze bepalingen worden herhaald in de artikelen 13 (onderwijs) en 15 (bescherming van het gezin). Summary: This Convention covers economic, social and cultural rights in the Inter-American area. Children’s rights are covered by Article 16, stating that every child, whatever his parentage, has the right to the protection that his status as a minor requires from his family, society and the State. Every child has the right to grow under the protection and responsibility of his parents; save in exceptional, judicially-recognized circumstances, a child of young age ought not to be separated from his mother. Every child also has the right to free and compulsory education, at least in the elementary phase, and to continue his training at higher levels of the educational system. Such provisions are repeated in Articles 13 (education) and 15 (protection of the family). Mensenrechten:AlgemeenSamenvatting: Deel I van het Pact van San José gaat het over verplichtingen van de Staat en te beschermen rechten (algemene verplichtingen; burgerlijke en politieke rechten; economische, sociale en culturele rechten; de schorsing van garanties, interpretatie en toepassing; en persoonlijke verantwoordelijkheden). Deel II gaat dan verder met middelen van bescherming (bevoegde organen; de Inter-Amerikaanse Commissie en het Hof voor de mensenrechten; en gemeenschappelijke bepalingen). Alle 26 van het Verdrag’s inhoudelijke artikelen zijn van belang voor kinderen en de bescherming van hun rechten. Een uitdrukkelijke verwijzing naar kinderen vindt men terug in artikel 5 (kinderen in conflict met de wet), artikel 17 (bescherming van het gezin) en artikel 19 (rechten van het kind). Summary: In its Part I, the Pact of San José deals with State obligations and rights protected (general obligations; civil and political rights; economic, social and cultural rights; suspension of guarantees, interpretation and application; and personal responsibilities). Part II then continues with means of protection (competent organs; the inter-American Commission and Court on Human Rights; and common provisions). All of the Convention's 26 substantive articles are of relevance to children and the protection of their rights. Explicit reference to children is made in Article 5 (children in conflict with the law), Article 17 (protection of the family) and Article 19 (rights of the child). Mensenrechten:AlgemeenSamenvatting: De Amerikaanse Verklaring van de Rechten en Plichten van de Mens was 's werelds eerste algemene mensenrechtendocument. Het omvat het recht op bescherming voor moeders en kinderen (artikel VII: alle vrouwen, vooral tijdens en na de zwangerschap, en alle kinderen hebben recht op bijzondere bescherming, zorg en steun), alsmede een bepaling over plichten ten opzichte van kinderen en ouders (artikel XXX: het is de plicht van iedere persoon om zijn of haar minderjarige kinderen te helpen, te ondersteunen, voor te lichten en te beschermen. Tevens is het de plicht van de kinderen om altijd hun ouders te eren en hen te helpen, ondersteunen en beschermen wanneer het nodig is). Hoewel deze verwijzingen naar het recht op ondersteuning en onderwijs positief zijn en tevens worden uitgedrukt als een plicht van de ouders ten opzichte van hun kinderen, slagen de bepalingen er niet in verder te gaan dan deze beperkte interpretatie van de rechten van kinderen. Dit werd pas met de invoering van het Amerikaans Verdrag inzake de rechten van de Mens in 1969 een realiteit. Summary: The American Declaration of the Rights and Duties of Man was the world’s first general human rights document. It includes the right to protection for mothers and children (Article VII: “All women, during pregnancy and the nursing period, and all children have the right to special protection, care and aid”); as well as a section on duties towards children and parents (Article XXX: “It is the duty of every person to aid, support, educate and protect his minor children, and it is the duty of children to honor their parents always and to aid, support and protect them when they need it”). The aforesaid provisions view children as human beings that deserve assistance and care due to their status as minors. Although these references to the right to support and education are positive, and expressed as a duty of the parents vis-à-vis their children, neither of the provisions manages to go beyond a restricted view of children’s rights. It was not until the adoption of the American Convention on Human Rights in 1969 that this limited concept of children’s rights was surpassed. Summary: This Convention governs the matter of adoption in the Inter-American area, when the domicile of the adopter and the habitual residence of the adoptee are in different States parties. The Convention provides that its terms and the laws applicable under it shall be interpreted consistently and in favor of the validity of the adoption and the best interests of the adoptee (Article 19).
