Deze analyse toont aan dat er met het belang van het kind, en de desbetreffende standpunten hierover, rekening wordt gehouden in rechtszaken. Zo werden er bijvoorbeeld curatoren aangesteld om het belang van het kind in de juridische procedures te overzien. Kinderrechten werden als zwaard en als schild gebruikt. De toename van kinderrechten in de jurisprudentie in de afgelopen jaren is een gevolg van een volwassener wordende constitutioneel project in het algemeen, terwijl tezelfdertijd de individuele rechters meer aandacht en gewicht schenken aan het belang van kinderen, en deze meer op de voorgrond plaatsen. Pleiters voor het publieke belang, zoals het Wettelijke Centrum voor Vrouwen en het Centrum voor Wetgeving van Kinderen, brachten het belang van het kind naar voor in de gerechtelijke procedures. Als laatste heeft het Comité inzake de Rechten van het Kind, dat instaat voor de controle op de implementatie van het Verdrag, verklaard dat er inspanningen worden geleverd door de Statelijke Partijen door trainingen aan te bieden voor al diegenen die betrokken zijn bij kinderen. Dit helpt de implementatie van het Verdrag ten volle. In het juridische systeem van Zuid-Afrika is het VRK een essentieel raamwerk geworden met referenties die de basis van het systeem van mensenrechten ten volle ondersteunt. Summary: This article analyses the children's right in South African courts. This analysis indicates that children's interests and views have been taken into account with regards to litigation. For example, there were curators appointed to oversee these children's interests in legal proceedings. Children's rights have also been used as a sword as well as a shield. This increase of children's right jurisprudence for the past few years, is a consequence of a maturing constitutional project overall, while individual judges show more concern for the interests of children, putting them more in the spotlight. Public interests litigators, such as Women's Legal Center and the Center for Child Law, brought the children's interests to the fore in judicial proceedings. Last but not least, the Committee on the Rights of the Child, which is responsible for monitoring the implementation of the Convention, has stated that there exists efforts of the State Parties to train all those who are involved with children, which helps the implementation of the Convention to the fullest extent. In the legal system of South Africa, the CRC has become an essential frame of reference which underpins the foundation of the human rights system. Een categorie van onrecht is misbruik, maar het is niet de enige. Armoede, patriarchie en gendergerelateerd geweld, alsook de gesocialiseerde onderdanigheid, afhankelijkheid en stemloosheid van vrouwen en kinderen creëren omstandigheden waarin misbruik kan voorkomen, vaak met weinig gevolgen. Zuid-Afrika kent extreem veel gevallen van zowel fysiek als seksueel misbruik van kinderen. Progressieve, op rechten gebaseerde wetgeving om kinderen te beschermen bestaat, maar het wordt niet naar behoren gesteund of gefinancierd door diensten om aan hun bepalingen te voldoen. Het misbruiken en verwaarlozen van kinderen zal niet beduidend afnemen in Zuid-Afrika zonder gelijktijdige verbeteringen aan de sociale en economische omstandigheden waarin vele kinderen leven. Summary: In a country in which human rights feature prominently in our discourse about who we are, as well as in the South African constitutional and legal framework, so many wrongs continue to be done to children. One category of wrongs is abuse, but it is not the only one. Poverty, patriarchy and gender violence, as well as the socialised obedience, dependency and silence of women and children, create conditions in which abuse can occur, often with few consequences. South Africa has extremely high rates of both physical and sexual abuse of children. Progressive, rights-based legislation exists to protect children, but it is not adequately supported or resourced by services to fulfil their provisions. Child abuse and neglect will not be significantly reduced in South Africa, without simultaneous improvements in the social and economic conditions in which very large numbers of children live. Dit vereist een onderzoek naar de processen in verband met participatie en de kinderen die hierbij zijn betrokken, ten opzichte van volwassenen binnen en buiten het proces en ten opzichten van bredere socio-politieke en economische omgevingen. Summary: This paper examines the current policy and practice around children's participation in South Africa. By situating the analysis from the perspective of the socio-economic and normative context within South Africa the paper critiques current typologies of children's participation for focusing too narrowly on processes internal to participatory processes. The paper argues that theorizations of children's participation need to take account of the range of activities which are labeled as children's participation and interrogate issues around who gets to participate and why, what the purposes of the participation are and under what conditions it is possible. This requires examining participatory processes and the children involved in them in relation to adult actors within and beyond the process as well as in relation to broader socio-political and economic environments. Summary: Systematic child participation in governance decision-making has been slow to develop, and full realisation of the rights protected in Art. 12(1) of the Convention on the Rights of the Child, lags behind. This article explores alternative avenues for realising children's participation in governance, by analysing the legal protection of non-electoral forms of public participation, internationally as well as nationally in South Africa. The author provides a case study of the South African law, which arguably supports the inclusion of children's views in governance processes, through their involvement in public participation.
