Werk:KinderarbeidSamenvatting: Het twintigjarig bestaan van het VRK was tevens een periode van dynamische verandering in international actie tegen kinderarbeid. Tijdens de jaren ’90 heeft de groeiende internationale aandacht - vooral vanuit een kinderrechtenperspectief - nieuwe ontwikkelingen voortgebracht in technische samenwerking en internationale normering. Het VRK en zijn twee Protocollen aan de ene kant, en de ILO Verdragen inzake kinderarbeid aan de andere kant, zijn complementair. Dit artikel kijkt terug op het proces dat aan de goedkeuring van het ILO C-182 Verdrag inzake de Ergste Vormen van Kinderarbeid vooraf ging, alsook naar de tien jaar waarin het van kracht is, als een integraal deel van de vooruitgang in kinderrechten. Men hoopt hierdoor bij te dragen aan de inventarisatie van ervaring en de verduidelijking van wat nog gedaan moet worden om het specifieke doel van tegen 2016 de ergste vormen van kinderarbeid te hebben uitgeroeid, te bereiken. Summary: The 20 years of the CRC have also been a period of dynamic change in international action against child labour; increased international attention on the issue during the 1990s – especially from the children’s rights perspective – has brought new developments both in technical cooperation and in international standard-setting. The CRC and its two protocols on the one hand, and the ILO child labour Conventions on the other are complementing each other. This article looks back on the process that led to the adoption of ILO C182 on the Worst Forms of Child Labour as well as its 10 years in force, as an integral part of the progress in children’s rights. It is hoped to contribute in taking stock of experience and clarifying what remains to be done with the specific international goal of eliminating the worst forms of child labour by 2016. De auteur stelt dat de wetgeving rond kinderarbeid en het kinderrechtenperspectief doordrongen zijn door patriarchale waarden, die de exploitatie van werk in de huishoudelijke sfeer verstoppen onder pseudo-verwantschapsbanden. De auteur beweert dat ontwikkelingsprogramma’s die zich toespitsen op jonge huishoudhulpen in benadering omlijst door kinderrechten riskeren om situaties te overschaduwen waar kinderen aan het werk worden gezet en eigenlijk worden uitgebuit. Summary: This review examines refractions of children's rights in development practice from an anthropological point of view and considers the case of young domestic girls working in Abidjan. The author argues that child labour legislation and the children's rights perspective in Abidjan is permeated by patriarchal values that mask the exploitation of work performed in the domestic arena under the cover of (pseudo) kinship ties. The author contends that development programmes that target young domestic servants in a children's rights-framed approach risk obscuring situations where children are put to work and actually exploited. Ik vind het ironisch dat we de rechten van het kind gebruiken om hun het recht te ontnemen om officieel te werken en het zelfs te rechtvaardigen dat dit wordt gecriminaliseerd en dat ze uit deze openbare ruimtes worden verwijderd door in te spelen op zeer specifieke begrippen als kindertijd, opvoeding en ruimte. Ondanks de formele nadruk van de wet op bescherming, merk ik dat men meer begaan is met sociale controle en insluiting dan met het werkelijke welzijn van de kinderen. Zo dus slaagt de wet er niet in om de basisprincipes van het Kinderrechtenverdrag, aan dewelke Peru zich verbonden heeft, te reflecteren. Ondanks dat het Verdrag vatbaar is voor meerdere interpretaties, kan het ook dienen als een potentiële tegenhanger van de repressieve wetgeving, zoals de ‘Begging Bill’. Het artikel is het resultaat van 14 maanden veldwerk in Peru en meer dan 100 interviews met beleidsmakers, overheidsofficieren, onderwijzers en straatkinderen zelf, alsook nog met anderen. Summary: In this article, I critically examine Peru’s Law to Protect Minors from situations of Begging. I consider the way in which a language of children’s rights is ironically invoked to justify the physical removal and criminalization of children working in public spaces by appeals to very specific understandings of childhood, parenting, and space. Despite the law’s formal emphasis on protection, I suggest it is more concerned with social control and containment than children’s actual well-being. As such, it fails to reflect the basic principles of the Convention on the Rights of the Child to which Peru has committed. However, because the CRC is subject to multiple interpretations, it also serves as a potential resource to counter repressive legislation such as the Begging Bill. The article is based on 14 months of field work in Peru and over 100 interviews with policy makers, government officials, educators, and street children themselves, among others. Werk:KinderarbeidSamenvatting: In deze aanbeveling vraagt PACE het Comité van Ministers een beroep te doen op de lidstaten om de economische uitbuiting van kinderen in Europa en daarbuiten stevig te bestrijden. Een passend beleid, onderzoeksprojecten, herziening van de nationale wetgeving, een dichtere betrokkenheid van alle belanghebbenden, bewustmakingscampagnes en een bewezen politiek engagement worden voorgesteld als bruikbare methoden. PACE nodigt het Comité ook uit om lidstaten te vragen actief deel te nemen aan de uitwerking en implementatie van het nieuwe IAO (Internationale Arbeidsorganisatie) verdrag inzake de ergste vormen van kinderarbeid. Summary: In this Recommendation, PACE asks the Committee of Ministers to call on all member states to firmly combat the economic exploitation of children in Europe and beyond. Appropriate policies, research projects, review of national legislation, a closer involvement of all interested parties, awareness-raising campaigns and a demonstrated political commitment are suggested as useful tools in this regard. The Assembly also invites the Committee of Ministers to ask member states to participate actively in the elaboration and the implementation of the new ILO (International Labour Organisation) convention against the most intolerable forms of child labour.
