Systematische participatie van kinderen in de beleidsvorming ontwikkelt zich op trage wijze en de volle realisatie van de rechten die worden beschermd in Art. 12(1) van het Verdrag inzake de Rechten van het Kind blijft achterwege. Dit artikel onderzoekt de alternatieve mogelijkheden om deze participatie van kinderen in het bestuur te verwezenlijken door de wettelijke bescherming van niet-electorale vormen van publieke participatie te analyseren, zowel op internationaal vlak als op nationaal vlak in Zuid-Afrika. De auteur bespreekt een case-study van de Zuid-Afrikaanse wetgeving, die de integratie van het standpunt van kinderen in het bestuursproces ondersteunt, door middel van hun betrokkenheid in de publieke participatie. |
| Summary: |
Systematic child participation in governance decision-making has been slow to develop, and full realisation of the rights protected in Art. 12(1) of the Convention on the Rights of the Child, lags behind. This article explores alternative avenues for realising children's participation in governance, by analysing the legal protection of non-electoral forms of public participation, internationally as well as nationally in South Africa. The author provides a case study of the South African law, which arguably supports the inclusion of children's views in governance processes, through their involvement in public participation. |
