In deze Algemene Commentaar behandelt het Comité de rechten van kinderen die verdacht worden van, beschuldigd worden van of erkend worden als inbreuk te hebben gepleegd op het strafrecht. Het Comité stelt vast dat lidstaten vaak niet volledig voldoen aan hun verplichtingen inzake de rechten van kinderen in conflict met justitie (e.g. procedurele rechten, alternatieven voor wettelijke procedures, vrijheidsberoving enkel als een laatste maatregelen wanneer alle andere opties uitgesloten zijn, enz.). Daarom heeft deze tekst als doel om tips te geven inzake een aantal leidprincipes en kernelementen van een omvattend beleid voor jeugdrecht. Er worden ook aanbevelingen gegeven met betrekking tot de organisatie van het jeugdrecht; bewustmaking en training; alsook dataverzameling, evaluatie en onderzoek. |
| Summary: |
In this General Comment, the Committee discusses the rights of children alleged as, accused of, or recognised as having infringed the penal law. Because State parties often do not fully respect their obligations regarding children in conflict with the law (e.g. in the area of procedural rights, alternatives to judicial proceedings, the use of deprivation of liberty only as a measure of last resort, etc.), this GC aims to provide guidance on the leading principles and core elements of a comprehensive juvenile justice policy. It also gives recommendations with regard to the organisation of juvenile justice; awareness raising and training; and data collection, evaluation and research. |
