Deze aanbeveling behandelt de toepassing van de Verdragen van Luxemburg en Den Haag, respectievelijk inzake gezag en ontvoering van kinderen. Overheden wordt voorgesteld om beide verdragen zo snel mogelijk te ondertekenen en te ratificeren als ze dat nog niet gedaan hebben. Daarnaast moeten ze beslissingen nemen over de erkenning en tenuitvoerlegging binnen een termijn van 6 weken vanaf de datum van de aanvang van de procedure voor de rechter, en moeten ze alle kosten dragen die in verband staan met de procedure (behalve de kosten die rechtstreeks aan de repatriëring van het kind verbonden zijn). |
| Summary: |
This Recommendation deals with the application of the Luxembourg and Hague Conventions on custody and child abduction respectively. Governments are suggested to sign and ratify both treaties as soon as possible if they have not already done so. In addition, they should take decisions concerning recognition and enforcement within a period of 6 weeks from the date of commencement of the proceedings before the judicial authority, and bear all costs linked to the procedure (with the exception of those costs directly linked to the repatriation of the child). |
