In deze bijdrage wordt onderzocht of en in welke mate het recht van het kind om zijn ouders te kennen (art. 7.1 IVRK) in België daadwerkelijk bestaat en kan worden afgedwongen na adoptie of toepassing van heterologe medisch begeleide voortplantingstechnieken. Na een korte bespreking van het toepassingsgebied van artikel 7.1 IVRK, wordt ingegaan op twee interpretatieproblemen m.b.t. dit artikel, namelijk de betekenis van 'parents' en 'as far as possible'. Vervolgens wordt nagegaan in welke mate de Belgische regelgeving rond heterologe medisch begeleide voortplantingstechnieken en de Belgische adoptiewetgeving in overeenstemming zijn met artikel 7.1 IVRK. Ten slotte worden de conclusies van dit onderzoek toegepast op het bijzondere geval van draagmoederschap. |

This contribution examines to what extent the rights of the child to know its origins (art. 7.1 CRC) exists in Belgium and can be enforced after adoption or use of heterologous artificial reproduction techniques. After a short discussion of the range of application of article 7.1 CRC, two problems of interpretation are pursued, that is the meaning of 'parents' and 'as far as possible'. Further it is examined to what extent the Belgian legislation concerning heterologous artificial procreation techniques and the Belgian legislation concerning adoption are consistent with article 7.1 CRC. Finally the conclusions of this examination are applied to the special case of surrogate motherhood. |
