Met het pilootproject 'het aanbod van een intensieve klinische behandeling voor delinquente jongeren met een psychiatrische problematiek' stelt de overheid middelen ter beschikking voor de oprichting en de werking van enkele psychiatrische eenheden die zich specifiek tot delinquente jongeren met psychiatrische stoornissen richten, om zo het gebrek aan aangepaste hulpverlening op te vangen. Voor het onderzoek naar de haalbaarheid en de opvolging van dit project op organisatorisch en therapeutisch vlak wordt een wetenschappelijke onderzoeksequipe aangesteld, die bestaat uit experten en medewerkers verbonden aan het U.Z. KU Leuven en de KU Leuven. De juridische inbreng in het project bestaat in een eerste fase uit een grondige beschrijving van het jeugdbeschermingsrecht, bekeken vanuit de invalshoek van jongeren met een psychiatrische problematiek, en van de wet van 26 juni 1990 betreffende de bescherming van de persoon van de geesteszieke. Daarnaast worden de problemen in verband met het juridisch kader van het project in kaart gebracht en worden voorstellen tot wetswijziging geformuleerd. Ten slotte wordt gewerkt rond dwangopname en dwangbehandeling. |
| Summary: |
Almost no adequate treatment exists for youth offenders with a psychiatric disposition. These juveniles are not welcome in regular psychiatric services due to their delinquent behavior, nor are they accepted by the institutions for delinquent youths, due to their severe psychiatric disorders. During the development of the pilot project, government resources are made available for the establishment and functioning of several psychiatric units for juvenile delinquents with psychiatric dispositions, as a means of compensating for the lack of existing units. Five institutions, spread over Belgium in both the Flemish and Wallonia regions, are nominated to participate in this project. Currently, three of them are actually functioning. Furthermore, a scientific working group is appointed and has the duty of checking and following up the feasibility of the project. The members of the working group are experts and collaborators of the U.Z. (University Hospital), K.U.Leuven and the Faculty of Psychology. Additionally, the Institute of Social Law (Faculty of Law) was asked to deal with the judicial aspects of the project. The scientific team collects and processes data dealing with effective outcomes, for example regarding recidivism, in addition to examining the subjective well-being of youths. In the meantime, the scientific team collects necessary data at the level of the youth courts in order to attain a risk assessment profile of the youths at the time of their intake. Legal input of the project is found in the first phase via a thorough description of the existing youth protection law. This input is examined from the point of view of youths who suffer from psychiatric problems, in addition to taking into account the 1990 law that concerns the protection of the mentally ill. Furthermore, the problems regarding the legal framework of the project are recorded and proposals are formulated regarding certain amendments of the law. The possibilities and conditions of coercion, involuntary placement and involuntary treatment are examined from an international and Belgian perspective. |
