De Werkgroep ‘Jeugdsanctierecht’ is opgericht met als doelstelling het overleg te organiseren tussen academici, advocatuur, magistratuur, consulenten en voorzieningen uit de sector aangaande de problematiek van het ‘jeugdsanctierecht’. In 1994 presenteerde de Werkgroep vijf principes die aan de basis moeten liggen van een (constructief) ‘jeugdsanctierecht’ (geactualiseerd in 2011): (1) de verantwoordelijkheden van de jongeren; (2) rechtswaarborgen voor jongeren; (3) constructief sanctioneren; (4) complementariteit herstel, welzijn en justitie; en (5) opsluiting als ‘ultimum remedium’. Hoewel de Werkgroep ‘Jeugdsanctierecht’ in 2011 reeds overging tot een toetsing van het huidige jeugdrecht aan de vijf principes, zijn deze principes thans te algemeen geformuleerd om als concrete aanbevelingen voor de wetgever te dienen. Het doel van dit onderzoek bestaat erin om op basis van de vijf principes een duidelijk en coherent voorstel uit te werken voor een constructief ‘jeugdsanctierecht’. Door intensief overleg met de leden van de Werkgroep en door incorporatie van inzichten uit de bestaande literatuur, worden aanbevelingen geformuleerd op verschillende fronten: het toepassingsgebied, de mogelijke interventies en diversiemaatregelen, de procedure en de gerechtelijke organisatie. Summary: This project concerns research into a constructive juvenile justice. The Flemish ‘Werkgroep Jeugdsanctierecht’ (Working Group ‘Youth Sanction Law’) is established with the objective to organize consultations on the issue of juvenile justice between academics, lawyers, judges, consultants and service providers. In 1994, and updated in 2011, the Working Group presented five principles that should be at the core of juvenile justice legislation: (1) the responsibilities of youngsters, (2) legal safeguards for youngsters, (3) constructive sanctioning, (4) complementarity of rehabilitation, care and justice and (5) detention as a last resort. Although the Working Group ‘Youth Sanction Law’ evaluated the current Belgian juvenile justice legislation in light of its principles in 2011, these five principles are at present insufficiently precise to serve as concrete recommendations for the legislator. The purpose of this research is to formulate a clear and coherent proposal for future constructive juvenile justice legislation, drawing upon the principles and insights of the Working Group. Through intensive consultations with the members of the Working Group and through the integration of insights from existing literature, recommendations are formulated on the following topics: the scope, potential interventions and diversion, the procedure and judicial organization. Inherent aan deze verhouding is de spanning tussen de verplichting van de overheid om kinderen te beschermen (zoals die o.m. voortvloeit uit artikel 19 IVRK) en de verplichting van de overheid om respect op te brengen voor het gezinsleven van kinderen en ouders (zoals die voortvloeit uit artikel 8 EVRM maar ook uit artikel 5 en 17 IVRK). Jeugdbeschermingssystemen kennen vaak ruime bevoegdheden toe aan overheidsactoren zonder deze bevoegdheden op een duidelijke manier af te bakenen. Dit roept belangrijke vragen op in verband met de legitimiteit van jeugdbeschermingsinterventies als vorm van overheidsinmenging in het gezinsleven. Summary: This project aims to elucidate the tension between the state’s obligation to protect children and the obligation to respect the right to family life of parents and children, a tension inherent to the complex triangular relationship between child, parent and the state. Child protection law confers wide powers upon government actors, allowing them to deeply penetrate family life, without clearly marking the limits of those powers. This raises important questions concerning the legitimacy of government interference under the veil of child protection. Since these questions have insufficiently been addressed in legal research, the proposed project has the objective to uncover the legal foundations of child protection law and to test them on their legitimacy (after having identified what ‘legitimacy’ entails in this particular context). Multiple countries will be included in the research, in order to establish how the described competing obligations of the state are balanced in current child protection systems. The central research question is: ‘How can current child protection law be evaluated in light of requirements of legitimacy of government interference in family life?’ This question will be answered through a combination of legal research methods, which include, besides the traditional ‘doctrinal’ approach, a comparative approach and a ‘law-in-context’-approach. In addition, the research will consist of the integration of meta-legal insights with a micro-legal analysis.
