De tekst van de AVG biedt echter weinig duidelijkheid in verband met de implementatie van een aantal bepalingen die een impact kunnen hebben op kinderen. Dit artikel identificeert een aantal pluspunten, knelpunten en relevante vragen, met aandacht voor een brede waaier aan rechten die aan kinderen zijn toegekend door het Verdrag inzake de rechten van het kind. Summary: The General Data Protection Regulation pays specific attention to the protection of personal data of children. The text of the AVG, however, offers little clarity in relation to the implementation of a number of provisions that can have an impact on children. This article identifies a number of advantages, bottlenecks and relevant questions, with attention for a wide range of rights granted to children by the Convention on the Rights of the Child. Media:MediawijsheidSamenvatting: Dagelijks worden kinderen blootgesteld aan een grote verscheidenheid van nieuwe reclametechnieken. Deze nieuwe vormen van commerciële communicatie hebben speciale kenmerken (nl. geïntegreerd, interactief en gepersonaliseerd) waardoor ze met name aantrekkelijk zijn voor kinderen. Echter, kinderen hebben vaak moeite om deze nieuwe vormen van reclame te herkennen of de achterliggende persuasieve intentie te begrijpen. Bijgevolg rijzen er belangrijke juridische en ethische vragen vanuit een kinderrechtenperspectief (bijvoorbeeld hun recht op ontwikkeling, privacy en de bescherming van persoonsgegevens, recht op participatie). Momenteel regelt een breed scala aan bepalingen commerciële communicatie gericht aan kinderen, over verschillende kanalen. Het onderzoek start vanuit de observatie dat het regulerend kader gefragmenteerd is in wetgeving en alternatieve regulerende instrumenten (zoals zelf- en co-regulering) en neemt als werkhypothese dat deze fragmentatie mogelijk kan leiden tot lacunes of overlappingen, zoals onder andere een gebrek aan duidelijke en uniforme definities of zelfs tegenstrijdige regels, die op hun beurt een negatieve invloed kunnen hebben op de ontwikkelen en reclamewijsheid van kinderen. Om die reden stelt het doctoraat in vraag welke substantieve en procedurele elementen een regulerend kader voor commerciële communicatie nodig heeft opdat kinderen worden opgeleid en “empowered” om met commerciële communicatie om te gaan (i.e. reclamewijs), zodat ze kunnen opgroeien tot kritische, geïnformeerde consumenten die hun eigen bewuste keuzes kunnen maken in de huidige nieuwe media omgeving. Summary: On a daily basis, children are exposed to a broad variety of new digital advertising techniques. These new forms of commercial communication have specific features (i.e. immersive, interactive, personalised) that make them particularly appealing to children, but also raise concerns as children often do not recognise or understand the persuasive intent of these new forms. Accordingly, these new forms raise significant legal and ethical questions from a children’s rights perspective (e.g. their right to development, privacy and data protection, participation). However, currently a wide array of provisions regulates commercial communication aimed at children, across various channels. The research starts from the observation that the regulatory framework is fragmented into both legislative and alternative regulatory instruments (i.e. self- and co-regulation) and takes as its working hypothesis that this potentially may lead to gaps or overlaps such as inter alia a lack of clear and uniform definitions and even contradicting rules, which in turn may have a negative impact on
children’s development and advertising literacy. Media:TechnologieSamenvatting: Kinderen over de hele wereld brengen steeds meer tijd door met spelen en creatieve activiteiten in de digitale omgeving. Uit deze spelactiviteiten wordt steeds vaker inkomsten gegenereerd, waardoor kinderen worden blootgesteld aan belangrijke commerciële en privacy risico's. Dit project zal drie niveaus van inkomstengeneratie via spelactiviteiten bestuderen: (1) kinderen aanmoedigen om geld uit te geven (bijv. in-app aankopen); (2) profiteren van persoonsgegevens (bv. gerichte advertenties) en (3) uitbuiting door influencer-werk (bv. exploitatieve contracten). Het VN Kinderrechtenverdrag (‘IVRK’) kent kinderen in verband hiermee het recht op spel (art. 31 IVRK) en op bescherming tegen economische uitbuiting (art. 32 IVRK) toe. Aangezien het IVRK werd opgesteld in een pre-internettijdperk, is de oorspronkelijke interpretatie van deze rechten achterhaald. Bovendien zijn er geen richtlijnen op internationaal niveau voor Staten over hoe deze rechten in nationale wetgeving kunnen worden omgezet. Het beoogde onderzoek omvat vier taken: eerst de hiaten in het bestaande wettelijke kader blootleggen; ten tweede de eigen opvattingen van kinderen over hun rechten in hun eigen context verzamelen; ten derde het recht op spel en op bescherming tegen uitbuiting reconceptualiseren binnen de onderzoekscontext; en ten vierde, het operationaliseren van deze rechten in regelgevende oplossingen en design vereisten voor spelaanbieders. Summary: Children all over the world are spending increasing periods of time engaged in play and creative activities in the digital environment. These playful experiences are increasingly monetised, exposing children to significant commercial and privacy risks. This project will focus on three levels of monetisation of play: (1) encouraging children to spend money (e.g. in-app purchases); (2) capitalising on personal data (e.g. targeted advertising) and (3) exploitation through influencer work (e.g. exploitative contracts). In relation to this, the UN Convention on the Rights of the Child (‘CRC’) grants children a right to play (art. 31 CRC) and to protection from economic exploitation (art. 32 CRC). However, as the CRC was drafted in a pre-internet era, the original interpretation of these rights has become outdated. Moreover, there is no guidance at the international level for States on how to operationalise these rights in their national laws. Therefore, the envisaged research encompasses the following tasks: first uncovering any gaps in the existing legal framework applicable to the three levels of monetisation of play; second, gathering children views about their rights in their own contexts; third reconceptualising children’s rights to play and protection from exploitation in light of the monetisation of play in the digital environment; and fourth, operationalising these rights into regulatory solutions and design requirements for play providers (e.g. game designers).
