Het artikel begint met uitleg over de kenmerkende karakteristieken van deze OIRK, hun aanwezigheid, locatie en organisatie in Europa, en de rol van het Europese Netwerk van Ombudsmannen voor Kinderen (ENOC). Verder wordt hun evoluerende relatie onderzocht, individueel en collectief, met Europese instellingen (vooral de instellingen van de Europese Unie, maar ook met referentie tot de Raad van Europa). Het artikel maakt gebruik van observaties van de jaarlijkse conferentie van ENOC in 2010 en van interviews met de leden van ENOC. Daarna volgt een discussie over hoe de OIRK kunnen worden begrepen als opererend op de grens van regionale, nationale, Europese en globale mechanismen. Het artikel besluit met een herziening van de huidige problemen en vragen voor verder onderzoek. Summary: This article attempts to understand the distinctive role of independent human rights institutions for children (IHRICs) in Europe, in the context of the proposed EU strategy on the rights of the child. It begins by explaining the distinctive characteristics of IHRICs, their presence, location and organisation in Europe, and the role of the European Network of Ombudspersons for Children (ENOC). It goes on to examine their developing relationships, individually and collectively, with European institutions (in particular the institutions of the European Union, but also with reference to the Council of Europe). The article draws on observations of the annual conference of ENOC in 2010, and on interviews with members of ENOC. The article follows this with a discussion of how IHRICs may be understood as operating at the interface of regional, national, European and global mechanisms, and concludes with a review of current issues and some questions for future research. Kinderrechten (algemeen):Belang van het kindSamenvatting: Het recht om voordelen van wetenschappelijk vooruitgang en haar toepassingen te genieten (RVWVT), is onvoldoende bediscussieert. De inspanningen van de VN Expert, het VN Comité van economische, sociale en culturele rechten, een AAAS coalitie en academici hebben meer licht geworpen op dit recht en het bewustzijn hiervan doen stijgen. Het RVWVT van kinderen verdient echter nog meer aandacht. Jongeren kunnen een aanzienlijk voordeel halen uit dit recht, maar toch is er weinig gekend over hoe dit recht een invloed kan hebben op het belang van het kind. Dit artikel onderzoekt het RVWVT van jonge mensen in de context van internationale akkoorden en onderzoek rond dit recht. Indicatoren onthullen verschillen in dit recht voor kinderen over en tussen landen en stellen voor dat onderzoek nodig is om kinderen hun ervaringen met RVWTV te gaan onderzoeken. Summary: The right to enjoy benefits of scientific progress and its applications (REBSPA) is under debate. The efforts of a U.N. Expert, the U.N. CESCR, an AAAS coalition, and scholars have shed light on and raised awareness of this right. Deserving more attention is children’s REBSPA. Young people stand to gain significantly from REBSPA, yet little is known about how this right may impact children’s interests. This article examines young people’s REBSPA in the context of international agreements and research on this right. Indicators reveal differences in this children’s right across and within countries, suggesting research is needed to explore young people’s experiences with REBSPA. Dit artikel introduceert de Kinderrechtenindex, een internationale meting van kinderrechten voor 190 landen. De Kinderrechtenindex bestaat uit twee burgerlijke rechten, twee politieke rechten, twee sociale rechten en twee economische rechten. Dit artikel presenteert de landenscores van de Kinderrechtenindex en gaat vervolgens na of deze kinderrechten verschillen per regio en andere verschillen, zoals de rijkdom van een land. Er wordt gehoopt dat de Kinderrechtenindex bewijs zal leveren over het belang van kinderrechten met betrekking tot zowel het werk van overheden en niet-gouvernementele organisaties als onderzoekers en anderen begaan met het welzijn van kinderen. Summary: Children’s rights continue to be subject of international debates. Moving past these debates can be facilitated with an international measure of children’s rights. This article introduces the Children’s Rights Index, an international measure of children’s rights for over 190 countries. The Children’s Rights Index consists of two civil rights, two political rights, two social rights, and two economic rights. This article presents country scores on the Children’s Rights Index, then examines whether children’s rights vary by region and other differences, such as country wealth. It is hoped that the Children’s Rights Index will provide evidence on children’s rights important to the work of governments and nongovernmental organizations, as well as scholars and others concerned about children’s welfare. In 1981 werd Noorwegen het eerste land om een post voor de eerste kinderombudspersoon in te stellen, die statutaire bevoegdheden heeft om kinderen te beschermen en hun rechten te bekrachtigen. Deze paper stelt de eerste cross-nationale analyse voor van de verschillende ombudspersonen. Summary: A potential key to the future of children's rights is the ombudsperson. In 1981, Norway became the first government to establish an office of a children's ombudsperson, which has statutory powers to protect children and enforce their rights. This paper represents the first cross-national analysis of the offices of children's ombudsperson. We employ Qualitative Comparative Analysis, which is based on Boolean algebra, to examine explanations why a national office of children's ombudsperson has or has not been established in 193 countries up to the year 2000. Our research suggests social policy innovation responds to need and is contingent on country wealth, but is mediated by either strong political rights or subscription to international treaties. This work indicates future research should consider subsequent establishment of offices of children's ombudsperson and the rights of children an ombudsperson seeks to enforce.
