Kinderrechten (algemeen):Kinderrechtenverdragen:Afrikaans Handvest inzake de Rechten en het Welzijn van het KindSamenvatting: Hoewel het ironisch lijkt dat een beleid dat slechts van toepassing is op een klein aantal kinderen zo veel politieke en sociale aandacht krijgt, weegt de symbolische significantie van internationale adoptie veel zwaarder door dan het praktische belang. Een recente herinnering hieraan op het Afrikaanse continent is de adoptie-zaak van Madonna in 2009. Deze nota beschouwt de tweede adoptie van een kind, afkomstig uit Malawi, door Madonna en bekijkt deze in het licht van internationale kinderrechten. Hoewel mensenrechtenorganisaties beweren dat Madonna zich “gedroeg als een rijke pestkop”, is Madonna’s adoptie in het algemeen bestand tegen de controle die afkomstig is van de kinderrechten. In feite heeft Madonna’s adoptie er zelfs voor gezorgd dat het discours van kinderrechten in Malawi op positieve wijze is geëvolueerd. Summary: Although it may seem ironic that a policy affecting so few children should engage so much political and social attention, the symbolic significance of intercountry adoption far outweighs its practical import. A recent reminder of this fact on the African continent is the 2009 Madonna adoption case. This note considers Madonna’s second adoption of a child from Malawi in the light of international children’s rights laws. Although human rights groups have alleged that Madonna was “acting like a rich bully” in the main, Madonna’s adoption can withstand the scrutiny of children’s rights, and in fact, has contributed towards helping the discourse of children’s rights in Malawi “stumble” forward. Het bevat een uitgebreide aanvullende tegenhanger van de VN-Kinderrechtenverdrag. Summary: The African Charter on the Rights and Welfare of the Child was adopted by the Organisation of African Unity - which was replaced by the current African Union (AU) in 1992. It contains a comprehensive complementary counterpart to the UN CRC. It outlines the basic rights of each African child below the age of 18, including non-discrimination; survival and development; name and nationality; freedom of expression, association, thought, conscience and religion; protection of privacy; education; leisure, recreation and cultural activities; rights of handicapped children; health; child labour; protection against abuse and torture; juvenile justice; protection of the family; parent care and protection; parental responsibilities; protection against harmful social and cultural practices; armed conflicts; refugee children; adoption; separation from parents; protection against Apartheid en discrimination; sexual exploitation; drug abuse; sale, trafficking and abduction; children of imprisoned mothers; and finally, responsibility of the child. The Charter also offers mechanisms of implementation, has a State reporting procedure, as well as an individual complaints procedure. Hoewel het gehoopt was dat het verdrag een significante en positieve impact op het leven van alle kinderen zou hebben, is dit in veel delen van de wereld niet gebeurd. Dit boek, gebaseerd op empirisch onderzoek en projectgegevens van niet-gouvernementele organisaties, onderzoekt de voortgang van het VRK en in mindere mate het Afrikaanse Handvest inzake de rechten en het welzijn van het kind in negen Afrikaanse landen in de 25 jaar sinds het door de Algemene Vergadering van de VN is aangenomen. Summary: The Convention on the Rights of the Child (CRC), which was adopted unanimously by the United Nations General Assembly in 1989, marked a turning point in the perception of children in international law and policy. Although it was hoped that the Convention would have a significant and positive impact on the lives of all children, this has not happened in many parts of the world. This edited volume, based on empirical research and Non-Governmental Organisation project data, explores the progress of the Convention on the Rights of the Child, and to a lesser extent, the African Charter on the Rights and Welfare of the Child, in nine African countries in the 25 years since it was adopted by the UN General Assembly. The book considers the implementation of the Convention both in terms of policy and practice, and its impact on the lived experiences of children in societies across the continent, focusing on specific themes such as HIV/AIDS, education and disability, child labour, witchcraft stigmatisation, street children, parent-child relationships and child participation. The book breaks new ground in blending legal and social perspectives of the experiences of children, and identifies concrete ways forward for the better implementation of the CRC treaty in the various political contexts that exist in Africa. In artikel 31 voorziet het Afrikaanse Handvest inzake de Rechten en het Welzijn van het Kind een reeks plichten voor kinderen. Het is begrijpelijk dat het uitdrukkelijk opleggen van plichten op kinderen een strijdpunt kan worden wanneer dit gebeurt in een instrument inzake hun rechten en welzijn. Dit artikel begint met het opstellen van een discussieplatform door internationale ervaringen te benadrukken en het Afrikaanse perspectief op mensenrechten toe te lichten. Daarop verder bouwend onderwerpt het artikel de precieze betekenis, inhoud, voorwaarden van navolging en toepassing van de plichten van kinderen aan een kritisch onderzoek en poogt het om deze te verduidelijken. Als conclusie stelt men voor dat artikel 31 een waardevolle toevoeging vormt voor de internationale mensenrechtenagenda. Een doelgerichte interpretatie van de bestanddelen van deze bepaling onthult dat kinderen een rol zouden moeten spelen op familiaal, maatschappelijk, nationaal en continentaal niveau, in overeenstemming met hun leeftijd en maturiteit, langs de weg naar het opgroeien als een deel van hun erfgoed, hun zelfverwezenlijking en hun ontwikkelend burgerschap. Summary: Each right has a corresponding duty. The African Children’s Charter, under Article 31, imposes a range of duties on children. Understandably, it could become contentious when an instrument on the rights and welfare of children expressly imposes duties on them. After setting the platform for discussion by highlighting international experiences and indicating the African human rights conception, this article critically examines and attempts to clarify the precise meaning, content, conditions of compliance and application of those duties for children. By way of conclusion, it is suggested that Article 31 represents a valuable addition to the international human rights agenda, and that a purposive interpretation of it’s constituent parts reveals that children should be required to play a role at family, community, national, and continental levels, in accordance with their age and maturity, along the way to growing up as part and parcel of their heritage, their empowerment and their developing citizenship. Het Kinderrechtenverdrag en het Afrikaans Handvest betreffende de Rechten en het Welzijn van Kinderen worden hier gebruikt als beginpunt. De studie suggereert dat het in de publieke sfeer is dat kinderrechten hun meeste invloed hebben gehad in de verslagperiode. Het artikel benadrukt acht onderscheidingsgebieden in deze vijfjaarlijkse periode: deze bevatten het rechterlijk akkoord van het vrijmaken van middelen om aan kinderen hun rechten te voldoen, nadruk op de kwaliteit en standaarden in het onderwijs, de ontwikkeling van vernieuwende methodes om om te gaan met onredelijke overheidsmaatregelen ten aanzien van kinderen en een stijgende focus op het recht op waardigheid van het kind. De auteurs besluiten dat de reikwijdte van de voornoemde gevallen wijst op de groeiende inbreng van het overwegen van kinderrechten in, in aantal stijgende, gebiedende van juridische interactie. Summary: This article represents the next in a series of five-year overviews of children’s rights in the courts in South Africa. Using the Convention on the Rights of the Child and the African Charter on the Welfare of Children as a point of departure, the study suggests that it is in the public sphere that children’s rights have had their most impact in the period under review. The article highlights eight areas of distinction in this five-year period: these include judicial approval of resource mobilisation for the fulfilment of children’s rights, emphasis on the quality of and standards in education; the development of innovative remedies to deal with unreasonable state measures affecting children, and an increasing focus on the right to dignity of the child. The authors conclude that the scope of the cases cited points to the growing insertion of children’s rights considerations in increasingly diverse areas of legal interaction. Furthermore, the authors posit that the CRC and ACRWC – together with non-binding sources of international law – have substantively informed and enriched the jurisprudence of South African courts.
