Deze paper suggereert dat het verlies van de internationale achting van de VS met betrekking tot het kinderwelzijn samenhing met de uitoefening van executie van jeugdige delinquenten. De paper gaat na waarom de VS doorgaat met het uitvoeren van de doodstraf bij jongeren na het oprichten van jeugdrechtbanken en andere bescherming voor jonge delinquenten. Twee factoren staan de VS toe om deze doodstraf bij jongeren verder uit te voeren nadat de meeste staten in het internationale systeem deze praktijk hebben stopgezet: de politiek van het Amerikaanse federalisme en een systeem van raciale subordinatie die sommige jonge delinquenten weghouden van de maatregelen die horen bij de bescherming van het kind, een conclusie die suggereert dat raciale vooroordelen zich hebben gemoeid met de naleving van internationale normen van kinderwelzijn en het jeugdrecht door de VS. Summary: At the turn of the 20th century, the United States was widely considered to be a world leader in matters of child protection and welfare, a reputation lost by the century’s end. This paper suggests that the United States’ loss of international esteem concerning child welfare was directly related to its practice of executing juvenile offenders. The paper analyzes why the United States continued to carry out the juvenile death penalty after the establishment of juvenile courts and other protections for child criminals. Two factors allowed the United States to continue the juvenile death penalty after most states in the international system had ended the practice: the politics of American federalism and a system of racial subordination that excluded some juvenile offenders from the umbrella of child protection measures, a conclusion suggesting that racial prejudice has interfered with U.S. compliance with international norms of child welfare and juvenile justice. Hoewel de programma’s werden ondernomen in het teken van bescherming en/of inburgering, resulteerden deze programma’s in trauma’s voor kinderen, hun families en hun cultuur. Ook ontstond er mishandeling; een schending van de kinderrechten zoals gedefinieerd door internationale organisaties, in het bijzonder de Verenigde Naties. Onderzoek van deze diepgaande gevolgen van internaten en interraciale adopties gedurende deze historische periode kan gebruikt worden als een gids voor een menselijk, effectief en cultureel gevoelig welzijnsbeleid voor kinderen. Summary: A sociological analysis of policies related to boarding schools and transracial adoption of indigenous children in Canada, the U.S.A., Australia and New Zealand, between the 1860s and the 1980s, demonstrates the similarity of the outcome of these programmes. While undertaken in the name of protection and/or acculturation, these policies and programmes resulted in trauma to the children, their families, and their cultures, as well as in abuses that were in violation of children’s rights as defined by international organizations, in particular the United Nations. Examination of the profound consequences of boarding schools and transracial adoption during this historical period can serve as a guide to humane, effective, and culturally sensitive child welfare policies. The chapter proceeds ecologically, acknowledging that children’s lives, including their legal lives, are related to their families, communities, and the social institutions surrounding them. As such the chapter provides a readable introduction to children’s relationship with the law for both lawyers and non-lawyers. In dit artikel worden data van de volkstelling van de VS in 2000 gebruikt om de waarheid van deze veronderstelling in te schatten door de effecten te onderzoeken van positieve en negatieve familiewetten over de aanwezigheid van kinderen in de huishoudens van ongehuwde partners van hetzelfde geslacht. Hierdoor probeert men in te schatten of formele wetten een centrale rol spelen in de vorming van families door holebi’s. Gebruik makend van een multi-level analyse, komt men tot de vaststelling dat formele wetten, en in het bijzonder negatieve formele wetten, slechts een beperkte rol lijkt te spelen. Deze formele wetten kunnen echter wel een grotere rol spelen bij de afbakening van eigendomsrechten of andere rechten, zoals adoptie door de tweede ouder. Deze bevindingen zijn compatibel met de notie dat individuen minder waarschijnlijk naar de formele wet kijken in hun dagelijkse leven, in het bijzonder met betrekking tot familiezaken, maar dat zij dit wel vaker doen met betrekking tot familiezaken zoals testamenten en vermogens, de overdracht van eigendom of andere “business”-materies. Summary: Faced with legal animus or outright legal prohibitions on adoption, fostering, or surrogacy, gay men and lesbians could be deterred from family formation. In this article, we use 2000 U.S. Census data to assess the validity of this assumption by examining the effect of positive and negative family laws on the presence of children in the households of same-sex unmarried partners. In doing so, we seek to assess whether formal law plays a central role in family formation outcomes for gay men and lesbians. Employing a multilevel analysis, we find that formal law, particularly negative formal law, appears to play little role in outcomes involving family formation. Formal law might, however, play a greater role when defining property or other legal rights, such as through second parent adoption. These findings are compatible with the notion that individuals are less likely to consult formal law in their everyday lives—particularly with regard to family matters—but are more likely to do so with regard to family issues concerning wills and estates, transfers of property, or other “business” matters. Onderwijs:AlgemeenSamenvatting: Hoewel seksuele voorlichting al gedurende vele jaren in scholen voorkomt, blijven de bezorgdheden over de seksuele gezondheid en gebruiken van de jongeren een centrale plaats innemen. In recente jaren werden er een aantal initiatieven geïntroduceerd (met verschillende succesgraden) om het bewustzijn van jongeren over seksuele zaken te verhogen en om de hoge aantallen van ongeplande tienerzwangerschappen te verminderen. Een controversieel idee is dat ouders het recht ontnomen moet worden om hun kinderen uit te sluiten van seksuele voorlichting. In deze paper overweegt de auteur de implicaties van dit voorstel, en geeft extra aandacht aan de antwoorden van deze conservatieve religieuze organisaties die dit voorstel waarschijnlijk zullen tegengaan. De centrale thesis is dat, hoewel de staat voorzichtig moet zijn om niet te bruusk om te springen met de wensen van de ouders in een zeer emotioneel gebied, de interesses van het kind het belangrijkste zijn en dat jongeren in het secundaire onderwijs toegang zouden moeten hebben tot uitgebreide seksuele voorlichtingsprogramma’s. Summary: Although sex education lessons have been provided in our schools for many years, concerns about the sexual health and practices of the nation's youth remain centre stage. In recent years, a number of initiatives have been introduced, with varying degrees of success, to increase young people's awareness of sexual matters and to reduce the high number of unplanned teenage pregnancies. One particularly controversial idea is that parents should be divested of the right to withdraw their children from sex education classes. In this paper, I consider the implications of this proposal, paying special attention to the response of those conservative religious organisations most likely to oppose it. My central thesis is that, while the state should be careful not to ride rough-shod over the wishes of parents in what is an extremely emotive area, the interests of the child are paramount and all young people in maintained secondary schools should have access to comprehensive sex education programmes.
