Kinderrechten (inter)nationaal:Landen en regio's:Europa:RoemeniëSamenvatting: Roemenië is sinds 1990 een partij bij het VN-Verdrag inzake de rechten van het kind (CRC), 1989, en sindsdien is het CRC rechtstreeks van toepassing op de rechtbanken en andere overheidsinstanties. Het land heeft lang moeite gehad om de rechten van kinderen voldoende te beschermen. Bekende systematische problemen die betrekking hebben op Roemeense kinderen waren institutionalisatie, adopties tussen landen, een onvoldoende kinderregeling, armoede en discriminatie, om maar een paar te noemen. In dit artikel wordt de toepassing van het CRC door de rechtbanken onderzocht en de impact die dit heeft gehad op de bescherming van de rechten van kinderen in Roemenië. De gekozen constitutionele en gerechtelijke jurisprudentie die in het artikel wordt onderzocht, tonen aan dat de rechtbanken slechts een marginale impuls hebben voor de systematische verandering, maar hebben bijgedragen tot de bescherming van individuele rechten. Enkele mogelijke oorzaken voor deze situatie - verdeeld over factoren met betrekking tot het justitie systeem in Roemenië en CRC-gerelateerde factoren - worden besproken. Summary: Romania has been a party to the UN Convention on the Rights of the Child (CRC), 1989, since 1990, and since then the CRC is directly applicable by the courts and other state bodies. For a long time the country struggled to provide adequate protection for the rights of children. Well-known systemic problems affecting Romanian children were institutionalisation, inter-country adoptions, an inadequate child justice system, poverty, and discrimination, to name but a few. This article examines the application of the CRC by the courts, and the impact which this has had on the protection of children’s rights in Romania. The selected constitutional and judicial (i.e. ordinary courts) jurisprudence examined in the article shows that courts have only marginally provided impetus for systemic change, but have, however, contributed to the protection of individual rights. A few potential causes for this state of affairs – divided into factors relating to the justice system in Romania and CRC-related factors – are discussed. Het is een antwoord op het argument dat Roemenië’s ongedefinieerd uitstel op interlandelijke adoptie (behalve bij familiale adoptie), neergelegd in de nieuwe wetgeving, een schending is van de internationale verplichtingen. Er wordt beargumenteerd dat de druk op Roemenië om dit uitstel op te heffen gebaseerd is op een misverstand met betrekking tot de problemen waarmee Roemenië werd geconfronteerd en de substantiële inhoud van de nieuwe wetten. Institutionalisering van jonge kinderen is verboden en voor oudere kinderen bestaan er duidelijke prioriteiten voor de re-integratie in de natuurlijke familie, of, wanneer dit niet lukt, in pleegzorg of in een verblijf dat in sterke mate familiaal is, voordat een verblijf in een instelling wordt overwogen. Verder wordt er beargumenteerd dat er in het Westen een ongezonde bezorgdheid bestaat over het probleem van interlandelijke adoptie waardoor er geen rekening wordt gehouden met de andere positieve hervormingen in het Roemeense systeem van kinderbescherming en het programma van de-institutionalisering. Het standpunt wordt opgenomen dat de kritiek op de Roemeense hervormingen beroep doet op de vertekende notie van het concept ‘achterlating’ en de status van ‘wees’. De auteur concludeert dat Roemenië de politieke druk moet tegengaan om zo het uitstel op te heffen, dat vooral afkomstig is van de pro-adoptie lobby in de Verenigde Staten, en recenter ondersteund wordt door het VN Comité voor de Rechten van het Kind. Summary: This paper challenges criticism of Romania’s new child protection and adoption legislation, passed in 2004 and implemented in January 2005. It responds to the argument that Romania’s indefinite moratorium on inter-country adoption (except in cases of family adoption) embodied in the new legislation, is a breach of international obligations. It is argued that pressure on Romania to lift the moratorium is based on a misunderstanding of the problems Romania has faced and of the substantive content of the new laws. Institutionalisation of young children is prohibited and, for older children, clear priorities are created for re-integration in the natural family or, failing that, foster care or family-type accommodation before accommodation in an institution can be considered. It is further argued that there has been an unhealthy preoccupation in the West with the single issue of inter-country adoption to the neglect of these other positive reforms to the Romanian child protection system and the programme of de-institutionalisation. The view is taken that criticism of Romanian reforms relies on a distorted notion of what constitutes ‘abandonment’ and the status of ‘orphan’. The author concludes that Romania should robustly resist political pressure to lift the moratorium, largely originating from the pro-adoption lobby in the United States and, most recently, apparently endorsed by the United Nations Committee on the Rights of the Child.
