Kinderrechten (inter)nationaal:Landen en regio's:Europa:AlgemeenSamenvatting: Het Verdrag inzake de bevoegdheid, het toepasselijke recht, herkenning, de tenuitvoerlegging en de samenwerking op het gebied van ouderlijke verantwoordelijkheid en maatregelen ter bescherming van kinderen, werd in het kader van de Haagse Conferentie voor Internationaal Privaatrecht op 19 oktober 1996 gesloten. Echter, enkel soevereine staten mogen toetreden bij het verdrag. Bij wijze van uitzondering, machtigt de Raad daarom de EU-landen om het verdrag te ondertekenen. Niettemin behoudt de EU de exclusieve bevoegdheid voor de bepalingen van het verdrag die vallen onder de reikwijdte van de verordening betreffende de rechterlijke bevoegdheid, erkenning en tenuitvoerlegging van beslissingen in huwelijkszaken en inzake de ouderlijke verantwoordelijkheid ("Brussel II" genoemd). Bijgevolg moeten de EU-landen een verklaring afleggen bij de ondertekening van het verdrag, waarbij de EU-wetgeving nog steeds wordt toegepast op de erkenning en tenuitvoerlegging binnen de Unie van beslissingen over zaken met betrekking tot het verdrag door een EU-land. Summary: The Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children was concluded within the framework of The Hague Conference on Private International Law on 19 October 1996. However, only sovereign states may accede to the convention. By way of exception, the Council therefore authorises the European Union (EU) countries to sign the convention. Nevertheless, the EU retains exclusive competence for the provisions of the convention that fall within the scope of the regulation on jurisdiction, recognition and enforcement of judgements in matrimonial matters and matters of parental responsibility (the “Brussels II” Regulation). Consequently, EU countries must make a declaration upon signing the convention, whereby EU law continues to be applied to the recognition and enforcement within the Union of judgments given on matters relating to the convention by an EU country. Deze verordening vormt ook een belangrijke stap in de strijd tegen ontvoeringen van kinderen. In antwoord op deze nieuwe sociale realiteit heeft de Raad van Ministers Verordening nr. 2201/2003 van 27 november 2003 ("de nieuwe verordening Brussel II") opgenomen, die voor alle lidstaten – met uitzondering van Denemarken – van toepassing is. Het bepaalt de algemene regel dat de rechter in de lidstaat waar het kind zijn gewone verblijfplaats heeft, bevoegd is om uitspraak te doen over de ouderlijke verantwoordelijkheid. Daarnaast wil de verordening ervoor zorgen dat een beslissing inzake de ouderlijke verantwoordelijkheid afgegeven in een lidstaat kan worden erkend en ten uitvoer gelegd in een andere lidstaat via een uniforme, eenvoudige procedure. Het dwingt het zuiver recht van het kind om contacten met beide ouders te onderhouden door ervoor te zorgen dat beslissingen over het omgangsrecht automatisch uitvoerbaar zijn en erkend worden in een andere lidstaat, zonder enige intermediaire procedure. Bovendien wordt kinderontvoering door ouders ontmoedigd en de verplichting van de rechter versterkt om de terugkeer van het kind in gevallen van kinderontvoering binnen de Gemeenschap te bevelen. Het zorgt ervoor dat de rechterlijke instanties van de lidstaat waarin het kind voor de ontvoering zijn of haar verblijf had, het laatste woord hebben bij de keuze waar het kind zal blijven. Bovendien is de verordening een aanvulling en versterking van het Verdrag van Den Haag van 1980 inzake internationale ontvoering van kinderen, doordat het zwaardere verplichtingen oplegt om de onmiddellijke terugkeer van een kind te waarborgen in geval van kinderontvoering tussen de lidstaten. Het kind en de achtergelaten ouder achtergelaten moeten de gelegenheid hebben om tijdens de procedure gehoord te worden. De centrale autoriteiten hebben de plicht om ouders die het slachtoffer zijn van een ontvoering te helpen, alsook de bemiddeling en ondersteuning van de communicatie tussen de rechterlijke instanties te bevorderen.

This regulation represents a major step forward in the fight against abductions of children. In response to this new social reality, the Council of Ministers adopted Council Regulation No 2201/2003 of 27 November 2003 ("the new Brussels II Regulation"), which applies in all Member States except Denmark. It lays down the general rule that the courts in the Member State where the child is habitually resident are competent to rule on matters of parental responsibility. In addition, the Regulation ensures that a judgment on parental responsibility issued in a Member State can be recognised and enforced in another Member State through a uniform, simple procedure. It reinforces the right of the child to maintain contact with both parents by ensuring that decisions on access rights are automatically recognised and enforceable in another Member State without any intermediate procedure. Moreover, it dissuades parental child abduction and reinforces the obligation of the courts to order the return of the child in cases of child abduction within the Community. It ensures that the courts of the Member State of the child's residence before abduction have the final say in deciding where the child will stay. Moreover, the Regulation complements and reinforces the 1980 Hague Convention on international child abduction by imposing stricter obligations to assure the prompt return of a child in cases of child abduction between Member States. The child and the parent left behind must be given an opportunity to be heard during the procedure. Central authorities will have an obligation to assist parents who are victims of an abduction, promote mediation and support communication between courts.

Kinderen in kwetsbare situaties:ArmoedeSamenvatting: In deze bijdrage onderzoek ik de uitkomsten van het hedendaagse gezinsbeleid, en daarvoor wordt het stof van het mattheuseffect geblazen. Twee vragen staan centraal: 1) Wie plukt de vruchten van overheidsinvesteringen in het gezinsbeleid?; en 2) Wat zijn hiervan de implicaties voor de doelstellingen van de overheidsinvesteringen in het gezinsbeleid? Met andere woorden, is er ook vandaag een mattheuseffect werkzaam in het gezinsbeleid, hoe manifesteert zich dat en wat zijn daarvan de gevolgen? Daarbij ligt de focus op drie beleidsinstrumenten: kinderopvang, ouderschapsverlof en kinderbijslagen. De resultaten tonen dat er een mattheuseffect schuilt in het gebruik van kinderopvang en ouderschapsverlof, maar niet noodzakelijk in de kinderbijslag. Om kinderarmoede afdoende te bestrijden moeten overheden niet alleen inzetten op het wegwerken van het mattheuseffect maar moeten zij er tegelijkertijd voor zorgen dat gezinnen met kinderen een voldoende mate van inkomensbescherming kunnen genieten. Daarbij kunnen kinderbijslagen dan een cruciale rol spelen, maar hun impact hangt af van hoe de middelen worden ingezet. Kortom, zowel het doelmatiger inzetten van kinderbijslagen als het wegwerken van het mattheuseffect in de kinderopvang en ouderschapsverlof is noodzakelijk om van sociale investeringen in het gezinsbeleid een waarlijk succes te maken. Summary: Starting from the concept of the Matthew effect, this article explores the intended as well as unintended consequences of family policy measures in the social investment state. Two overarching research questions are addressed in an empirical and comparative way: 1) Who benefits from government investment in current family policy measures?; and 2) What are the consequences of government investment in family policy? The analyses show that inequality prevails in the use of ‘new’ family policy measures such as childcare services and parental leave schemes: the middle and higher-incomes benefit more from government investment for these measures than low-income families. This is likely to counteract the social investment objective of mitigating inequalities in early life. Notwithstanding the current policy focus on childcare and parental leave, ‘old’ family policy measures such as child benefits have a direct and important impact on inequality in early childhood. A focus on income protection should be an indispensable part of any successful investment strategy.
