Deze studie richtte zich op één aspect van de implementatie, namelijk de hervorming van de wet. Dit werd hoofdzakelijk gebaseerd op verslagen gericht aan de commissie met betrekking tot kinderrechten van 179 landen. De resultaten tonen voor de meeste landen aan dat de implementatie beperkt is en veel meer gericht op kinderwelzijn dan wetgeving op basis van kinderrechten. De relatie tussen maatregelen van de hervorming van de wet / de wettelijke regeling, met name het bestaan van gewoonterecht en wetten die lijfstraffen verbieden, op de ervaring van kinderen, kindermishandeling en sterfte worden geanalyseerd en theoretisch gegrond. Summary: Scholars and practitioners stress the need for systematic research on the implementation of the UN Convention on the Rights of the Child (CRC) and its potential impact on children’s rights. Our study focused on one aspect of implementation – law reform. Drawing primarily on reports to the CRC Committee for 179 countries, results show for most countries, implementation is limited and focused far more on child-welfare than child-rights based legislation. The relationship of measures of law reform/legal regime (most notably, the existence of customary law and laws banning corporal punishment) to children’s experience of rights, child physical abuse and mortality, is analysed and theoretically grounded. Dit artikel bespreekt de rol van internationale indicatoren in relatie met het meldingsprocess dat een integraal onderdeel vormt van het Verdrag. Vervolgens wordt de mogelijkheid besproken van het ontwikkelen van een indicator die op globale wijze de mishandeling van kinderen kan meten. Praktische en definiërende obstakels worden in beschouwing genomen en maatregelen gesuggereerd door andere auteurs, zoals het percentage kindermoorden, worden op kritische wijze overwogen. Het artikel besluit dat er op het huidige moment geen geldige maatregelen bestaan die toestaan dat kindermishandeling op globale wijze gemeten kan worden, maar dat er een aantal positieve stappen kunnen worden ondernomen om het bewustzijn en het meten van kindermishandeling op internationaal vlak te promoten, en deze worden bediscussieerd. Summary: UNICEF is developing indicators to measure the compliance of signatory states with the United Nations Convention on the Rights of the Child, 1989. This article explains the role of international indicators in relation to the reporting process integral to the Convention. It then discusses the possibility of developing an indicator to measure child maltreatment globally. Practical and definitional obstacles are considered and measures suggested by other authors, including the rate of child homicide, are critically considered. The article concludes that at present there is no valid measure that allows child maltreatment to be measured globally but that a number of positive steps can be taken to promote awareness and measurement of child maltreatment internationally and these are discussed. Voornamelijk op het niveau van de Raad van Europa en de Verenigde Naties is het hoog op de politieke agenda komen te staan en getuigt het van een succesvolle doelgerichte campagne. Een constante internationale druk blijft echter de boodschap en kan leiden tot nauwer op elkaar afgestelde normgeving, zeker binnen het Europese kader. De auteurs overlopen in deze bijdrage de verschillende wetgevende initiatieven die op internationaal en op nationaal niveau tot op heden werden ontwikkeld. Daarnaast wordt ook de nodige aandacht besteed aan de relevante internationale (quasi-)rechtspraak die zoals vaak als katalysator voor politieke mobilisering dient. Ten slotte wordt een balans opgemaakt van de internationale druk op België met het antwoord hierop van de beleidsmakers. Summary: The concern for the issue of corporal punishment of children has definitely undergone a strong impulse over the past few years. It is high on the political agenda of the Council of Europe and the UN and it illustrates that the targeted campaign is a success. The international pressure should however be maintained, potentially leading to closer cooperation in regulations, especially within the European frame. In this contribution, the authors scroll through the various current legislative initiatives at international and national level. Also, the necessary attention is given to the relevant international (quasi-)jurisdiction, which often serves as political catalyst for political mobilization. Finally, a balance is struck between the international pressure on Belgium and the policy makers’ response to this. Internationale bezorgdheden over geweld tegen kinderen nam op significante wijze toe gedurende het voorbije decennium. Een Studie over Geweld Tegen Kinderen, aangemoedigd door het VN Comité voor de Rechten van het Kind, uitgevoerd onder de auspiciën van de Verenigde Naties Secretaris Generaal, en gerapporteerd in 2006, werd een oproep om de bescherming van kinderen te verbeteren. Gebruiken en systemen om kinderen te beschermen werden in het algemeen als inadequaat veroordeeld en, in sommige gevallen, zelfs als destructief. Er wordt erkend dat ‘business as usual’ – meer van hetzelfde – niet voldoende is. Een Algemene Commentaar (een gids om aan verplichtingen te voldoen) voor artikel 19, de centrale conceptualisatie van kinderbescherming van het VN Verdrag inzake de Rechten van het Kind, heeft het potentieel om een wereldwijde herformulering van de prioriteiten van kinderbescherming, het beleid en de gebruiken te promoten ingevolge van de implementatie van een kinderrechtenbenadering. Het kan een mechanisme zijn om de noodzakelijke transformationele verandering – voor een authentieke verschuiving van het paradigma – te omkaderen en te promoten. Hier wordt een verklaring gegevn voor de historische context, de motivering, het centraal staan van kinderrechten, het ontwikkelingsproces, holistische natuur en de primaire elementen van de Algemene Commentaar 13 (GC13): het recht van het kind op vrijheid van alle vormen van geweld. GC13 belichaamt en strijdt voor een kinderrechtenbenadering ten aanzien van kinderbescherming, en omvat sterke ondersteuning voor proactieve primaire preventie, promotie van goede kinderzorg, een een verbintenis om de rechten en het welzijn van alle kinderen te verzekeren. Een op kinderrechten gebaseerd, comprehensief gecoördineerd raamwerk wordt aanbevolen voor de implementatie van GC13. Summary: Children continue to be subjected to high levels of violence (i.e., physical, psychological and sexual maltreatment) throughout the world. International concern about violence against children has increased significantly during the last decade. A Study on Violence Against Children, encouraged by the UN Committee on the Rights of the Child, conducted under the auspices of the United Nations Secretary General and reported in 2006, has become a rallying call to improve child protection. Child protection practices and systems have been judged to be generally inadequate and, in some cases, destructive. It is widely recognized that business as usual—more of the same—will not do. A General Comment (guide to fulfilling obligations) for Article 19, the central conceptualization of child protection of the UN Convention on the Rights of the Child, has the potential to promote a worldwide reformulation of child protection priorities, policies, and practices by virtue of the infusion of a child rights approach. It can be a mechanism for framing and promoting the transformational change needed – for a genuine paradigm shift. Here, explication is given for the historical context, rationale, centrality of child rights, process of development, holistic nature, and primary elements of General Comment 13 (GC13): The child's right to freedom from all forms of violence.GC13 embodies and champions a child rights approach to child protection entailing strong support for proactive primary prevention, promotion of good child care, and a commitment to secure the rights and well-being of all children. A child rights-based, comprehensive coordinating framework is recommended for the implementation of GC13.
