Onderwijs:AlgemeenSamenvatting: De focus van dit artikel is om vanuit een kinderrechtenperspectief een analyse aan te bieden van de 'equity' van onderwijservaringen aangeboden aan jongeren die zich buiten de algemene schoolomgeving bevinden, en een alternatief onderwijsaanbod krijgen. Het dilemma voor het beleid en de bestaande gebruiken is dat het alternatieve onderwijs ondersteuning geeft aan het recht van kinderen op onderwijs zoals bepaald in artikel 28 van het Verdrag inzake de Rechten van het Kind van de Verenigde Naties “wanneer scholen hierin niet slagen”. Echter, worden de rechten van deze kinderen om toegang te verkrijgen tot onderwijs op basis van gelijkheid van kansen, niet gecompromitteerd in het aanvaarden van zulke alternatieven? Dit is een recht verankerd in hetzelfde artikel. Om dit dilemma verder te onderzoeken zal deze paper eerst het beleid en de gebruiken nagaan die verband houden met alternatief onderwijs, door gebruik te maken van periodieke bevindingen van het Committee inzake de Rechten van het Kind voor het Verenigd Koninkrijk, en hoe deze bevindingen specifiek relateren tot de situatie in Noord-Ierland. De paper zal vervolgens kijken naar de artikels die relevant zijn voor het probleem van uitsluiting van onderwijs binnen het VN Verdrag inzake de Rechten van het Kind. Vanuit deze overwegingen van wettelijke standaarden die van toepassing zijn op het probleem van uitsluiting, zal de paper de nadruk leggen op de complexiteiten van het probleem binnen de context van de huidige debatten over gemarginaliseerde jongeren en onderwijs. Summary: The focus of this article is to provide a child rights analysis of the equity of educational experience afforded to young people outside mainstream schools by alternative providers. The dilemma for policy and existing practice is that alternative education supports children's right to an education as stated in Article 28 of the United Nations Convention on the Rights of the Child “when schools find they cannot”. However, in accepting alternatives are we compromising those same children's rights to achieve access to education on the basis of equality of opportunity? This is a right enshrined in the same article. In order to explore this dilemma, the present paper will firstly consider policy and practice concerns with regard to alternative education, drawing on periodic reports from the Committee on the Rights of the Child for the United Kingdom and how these findings relate specifically to the situation in Northern Ireland. The paper will then look at the articles relevant to the issue of exclusion from education within the United Nations Convention on the Rights of the Child. From this consideration of legal standards applicable to the issue of exclusion, the paper will focus on the complexities of the issue within the context of current debates on marginalized young people and education. Onderwijs:MensenrechteneducatieSamenvatting: Mensenrechteneducatie wordt stilaan een essentieel ingrediënt van alle samenlevingen in de wereld dat respect en tolerantie aanmoedigt voor hen die zich rondom ons bevinden, en om goede burgers te creëren voor de toekomst. In zowel het noorden als het zuiden van Ierland worden mensenrechten aanzien als een instrument waarmee positieve veranderingen kunnen optreden. Onder de voorwaarden van de Belfast/Goede Vrijdag overeenkomst 1998 werd er prioriteit gegeven aan de creatie van een ‘mensenrechtencultuur’. Als gevolg van de Overeenkomst werden er Mensenrechtencommissies opgericht in Noord Ierland en de Republiek van Ierland. In termen van beide Mensenrechtencommissies kreeg mensenrechteneducatie een centrale rol. De Goede Vrijdag Overeenkomst trof ook voorzieningen om een aantal grensoverschrijdende organisaties op te richten, waarvan één zich richt op onderricht. Beide staten hebben bindende internationale verbintenissen gesloten om programma’s te ontwikkelen die verband houden met Mensenrechteneducatie. Artikel 29 van het Verdrag inzake de Rechten van het Kind in het bijzonder vereist dat kinderen de kans krijgen om respect te ontwikkelen over hun eigen culturele identiteit, taal en waarden en voor de cultuur, taal en waarden van anderen. Summary: Human Rights Education is becoming an essential ingredient to all societies in the world in order to encourage respect and tolerance to those around us and build good citizens for the future. In both the North and South of Ireland human rights is seen as a vehicle through which positive change could occur. Under the terms of the Belfast/Good Friday Agreement 1998, a priority was given to the creation of a ‘human rights culture’. As a result of the Agreement Human Rights Commissions were established in Northern Ireland and in the Republic of Ireland. In the terms of both Human Rights Commissions, Human Rights Education was given a central role. The Good Friday Agreement also made provision for a number of cross-border bodies, one of which focused on education. Both States had made binding international commitments to develop programmes in Human Rights Education. In particular, Article 29 of the Convention on the Rights of the Child requires both states to ensure that children are enabled to develop a respect for their own cultural identity, language and values and for the culture, language and values of others. Kinderrechten (inter)nationaal:Landen en regio's:Europa:Verenigd KoninkrijkSamenvatting: Een oordeel van de Lord Chief Justice (hoofd gerechterlijke macht) in Noord Ierland (februari 2005) ging over het feit dat een Trust die instaat voor Gezondheids- en Sociale Diensten, artikel 8 van het EVRM had verbroken. Dit artikel geeft ouders het recht op een familiaal leven in het proces waarbij jonge kinderen opgenomen worden in de zorg. Deze breuk heeft een groot debat gestimuleerd over de interface tussen de Mensenrechtenakt (1998) en de professionele besluitvorming met betrekking tot de kinderbescherming in Noord Ierland en over Europa. Dit artikel onderzoekt de interface tussen de Mensenrechtenakt en het primordiaal beginsel in het Kinderorde (Noord Ierland) 1995 in relatie tot de statutoire interventies om kinderen te beschermen. Er wordt onderzoek gedaan naar de toenemende complexiteit die vereist wordt van aanbevelingen van sociaal werk in gerechtshoven in complexe situaties die betrekking hebben op conflicterende rechten. De impact op het aannemen van een gestructureerd model van expliciete argumentatie wordt ook nagegaan. Summary: A recent judgement in February 2005 by the Lord Chief Justice in Northern Ireland that a Health and Social Services Trust had breached a parent's Article 8 Right to Family Life in the process used to take a young child into care has stimulated major debate about the interface between the Human Rights Act (1998) and professional decision-making in child protection work in Northern Ireland and across Europe. This article examines the interface between the Human Rights Act and the paramountcy principle in the Children (NI) Order 1995 in relation to statutory interventions to protect children. It explores the increasing sophistication required of social work recommendations to courts in complex situations involving conflicting rights and considers the impact of adopting a structured model of explicit argumentation. Deze paper bediscussieert het belang van een klachtensysteem in het handhaven van kinderrechten, in het bijzonder artikel 12 van het Verdrag inzake de Rechten van het Kind van de Verenigde Naties. Er wordt een overzicht gegeven van enkele diensten die instaan voor belangenbehartiging voor kinderen en jongeren die wensen een klacht neer te leggen over hun behandeling door de Noord-Ierse Gezondheidszorg en Persoonlijke Sociale Diensten. Vervolgens bediscussieert men enkele mogelijke toekomstige ontwikkelingen, en in het bijzonder speculeert men over de potentiële rol van de Noord-Ierse Kindercommissaris in het onderzoeken van klachten in verband met de zorg en de behandeling van kinderen in de Noord-Ierse Gezondheidszorg en Persoonlijke Sociale Diensten. Summary: Health and Personal Social Services are required to respond positively and effectively to complaints from service users. This paper discusses the importance of such complaints systems in upholding children's rights, and in particular Article 12 of the United Nations Convention on the Rights of the Child. It outlines the nature of some of the advocacy services available to children and young people who may wish to make a complaint about their treatment within Northern Ireland Health and Personal Social Services. It then moves on to discuss some possible future developments, and in particular speculates on the potential role of the Northern Ireland Children's Commissioner in investigating complaints concerning the care and treatment of children in Northern Ireland health and personal social services.
