In de bijdrage wordt gepleit voor het versterken van de positie van het kind binnen de complexe scheiding van zijn1 ouders door vanuit meerdere perspectieven diens belangen te beoordelen. Binnen de juridische context zal verbinding met de gedragsdeskundige expertise wenselijk en wellicht zelfs noodzakelijk zijn. Aandacht zal immers moeten worden gegeven aan de bijzondere situatie van het kind dat nog in ontwikkeling is en zeker binnen de scheidingsproblematiek van zijn ouders kwetsbaar zal zijn. Het is van belang om een juiste balans te vinden tussen enerzijds het recht van het kind op participatie, dat vastligt in de (inter)nationale regelingen en anderzijds de noodzaak tot bescherming van het kind. Hierbij raken de juridische en de gedragsdeskundige expertise elkaar. Samenwerking tussen de gedragsdeskundigen, zoals de psychologen, pedagogen en maatschappelijk werkenden en de juristen, zoals de advocaten en de rechters, zal er toe kunnen bijdragen om de belangen en daarmee het welzijn van het kind te verbeteren. Een dergelijke verbinding wordt ook bepleit in de diverse internationale regelingen. Het is aan te bevelen om deze verbinding gedurende het gehele proces van scheiden, inclusief de juridische procedure te zoeken en ook door te voeren in de rechtspraak door het creëren van een vorm van multidisciplinaire rechtspraak waarbij de rechter en de gedragsdeskundige samen tot de beslissing zullen komen. |

In the contribution calls for strengthening the position of the child within the complex separation of his2 parents to assess his interests from multiple perspectives. Within the legal context connection to the behavior specialist expertise will be desirable and perhaps even necessary. Attention will have to be given to the special situation of the child under development that certainly within the separation problems with his parents will be vulnerable. It is important to have a right balance between on the one hand, the right of the child to participation, that is established in the (inter) national arrangements and on another hand the need for the protection of the child. It hit the legal and behavioural expert experience each other. Cooperation between the behavioral experts, such as psychologists, educators and social workers and lawyers, as lawyers and judges, will contribute to the interests and the welfare of the child. Such a connection is also advocated in the various international regimes. It is recommended to search this connection throughout the process of divorce, including the legal procedure and also to the case-law by creating a form of multidisciplinary case-law in which the judge and the behavioural expert will come to the decision together. |
