Dit Verdrag voorziet in de oprichting van gemeenschappelijke bepalingen inzake de wet die van toepassing is op onderhoudsplichten voortkomend uit een familierelatie, ouderschap, huwelijk of affiniteit, inclusief onderhoudsplichten aan onwettige kinderen. Als een instrument binnen internationaal privaatrecht, doelt het Verdrag er hoofdzakelijk op om conflicten tussen wetten aan te pakken en op te lossen. Nadat Hoofdstuk I de reikwijdte van het Verdrag heeft bepaald, gaat Hoofdstuk II verder met hoe men bepaalt welke wet van toepassing is. Hoofdstuk III gaat dan verder met diverse bepalingen, terwijl Hoofdstuk IV concludeert met de finale bepalingen. |
| Summary: |
This Convention aims to establish common provisions concerning the law applicable to maintenance obligations arising from a family relationship, parentage, marriage or affinity, including a maintenance obligation in respect of a child who is not legitimate. As a Private International Law document, it aims to govern and resolve conflicts of laws in this regard. After Chapter I has established the scope of the Convention, Chapter II sets forth how to determine the applicable law. Chapter III then continues with miscellaneous provisions, whereas the final provisions are addressed in Chapter IV. |
