Uit hoofde van artikel 20 Internationaal Verdrag inzake de rechten van het kind (hierna: IVRK) heeft een kind dat niet in het eigen gezin kan opgroeien “recht op bijzondere bescherming en bijstand van staatswege”, ook wel het recht op alternatieve zorg genoemd. Wereldwijd leven miljoenen kinderen echter zonder (adequate) ouderlijke zorg, terwijl een geschikt alternatief niet voorhanden is. In dit betoog wordt ingegaan op de betekenis van het recht op alternatieve zorg. Daartoe wordt bovenvermeld artikel 20 IVRK geanalyseerd, alsmede de nog relatief nieuwe VN-Richtlijnen Alternatieve Zorg voor Kinderen. |

Article 20 CRC grants a child that cannot grow up within his or her own family the entitlement for special protection and assistance provided by the State, also known as the right to alternative care. However, millions of children around the globe grow up without (adequate) parental care, without access to an appropriate alternative. This contribution discusses the significance of the right to alternative care. For this, the above mentioned article 20 CRC is analyzed, as well as the relatively new UN Guidelines on Alternative Care for Children. |
