Convention on the Civil Aspects of International Child Abduction / Hague Conference on Private International Law

Taal : Engels (eng) Trefwoorden: Gezin:Internationale kinderontvoering Samenvatting: Dit Verdrag wil ontvoeringen van kinderen door hun ouders tegengaan. Het doet dit door een systeem van samenwerking tussen Centrale Autoriteiten vast te leggen, alsook door een snelle terugkeer van het kind naar zijn of haar land van gewoon verblijf te vergemakkelijken. Het Verdrag start van de vooronderstelling dat het onwettig verwijderen of vasthouden van een kind over internationale grenzen heen niet in het belang van dit kind is. Zo is het hoofddoel van het Verdrag – naast het vrijwaren van de toegangsrechten – kinderen tegen de schadelijke effecten van ontvoering of vasthouding te beschermen. Hoewel het Verdrag reeds voor het VRK werd goedgekeurd, helpt het om een aantal fundamentele rechten van het kind ten uitvoering te brengen, zoals deze uitgedrukt in artikels 11, 35, 9§3 en 10§2 van het VRK. Summary: This Convention seeks to combat parental child abduction by providing a system of cooperation between Central Authorities and a rapid procedure for the return of the child to the country of the child’s habitual residence. It starts from the presumption that the wrongful removal or retention of a child across international boundaries is not in the interests of the child. As such, the principal object of the Convention, aside from protecting rights of access, is to protect children from the harmful effects of cross-border abductions and wrongful retentions. Even though the Convention predates the CRC, it helps to give effect to the fundamental rights of the child such as those expressed in Articles 11, 35, 9§3 and 10§2 CRC.
