| | Samenvatting: | Verscheidene bepalingen van het Verdrag inzake de Rechten van het Kind bevatten referenties naar internationale samenwerking, soms in combinatie met referenties naar de noden van ontwikkelingslanden. Dit artikel onderzoekt of deze referenties, in het licht van de interpretatie die wordt gegeven door het Comité voor de Rechten van het Kind en andere mensenrechtenverdragen die vergelijkbare verwoordingen gebruiken (in het bijzonder het Internationaal Verdrag inzake Economische, Sociale en Culturele Rechten en het Verdrag inzake Personen met een Handicap), aanleiding kunnen geven tot een wettelijke verplichting om op internationaal vlak samen te werken voor de verdere ontwikkeling in het licht van economische, sociale en culturele rechten. Hoewel het niet mogelijk is om het bestaan vast te stellen van wettelijke verplichtingen met betrekking tot het aanbieden van ontwikkelingshulp in het algemeen - die aanleiding zou geven tot een extraterritoriale verplichting - bestaan er toch wettelijke verplichtingen met betrekking tot het respecteren en beschermen van economische, sociale en culturele rechten van kinderen in derdewereldlanden. Daarbij heeft het Comité voor de Rechten van het Kind duidelijkheid geschept bij sommige specifieke verplichtingen die door de donorlanden vervuld moeten worden, zoals onder meer de allocatie van 0.7 percent van het BNP voor ontwikkelingshulp en het aannemen van een op rechten gebaseerde samenwerking in de ontwikkelingshulp, waarbij de kinderrechten worden geïntegreerd. | | Summary: | Several provisions of the Convention on the Rights of the Child contain references to international cooperation, sometimes in combination with a reference to the needs of developing countries. This article explores whether these references, in light of the interpretation given by the Committee on the Rights of the Child and of other human rights treaties which contain similar wording (in particular the International Covenant on Economic, Social and Cultural Rights and the Disability Convention), amount to a legal obligation to cooperate internationally for development in the field of economic, social and cultural rights. While it is not possible to establish the existence of a legal obligation to provide development assistance in general - which would amount to an extraterritorial obligation to fulfil - legal obligations to respect and protect economic, social and cultural rights of children in third countries do apply.
