Samenvatting: Dit artikel stelt de vraag of het kan worden aangenomen dat kinderen en jongeren hebben geparticipeerd in de processen die betrekking hebben op de introductie van recent overheidsbeleid ten aanzien van kinderen en jongeren en de betekenis die aan hun standpunten wordt verbonden. Aan de ene kant herkent men het onmiskenbare belang van het Verdrag inzake de Rechten van het Kind van de Verenigde Naties (VN VRK) als een instrument dat de ambitieuze standaarden uiteenzet die toegepast moeten worden wanneer men werkt met kinderen en jongeren, en zijn waarde als een audit instrument. Echter, aan de andere kant moeten de beperkingen van het Verdrag openlijk erkend worden. Er wordt een argument aangehaald, door gebruik te maken van lessen die getrokken worden uit besloten zaken, dat er meer aandacht moet worden gegeven aan de wettelijke rechten die kinderen bezitten onder het Europese Verdrag voor de Rechten van de Mens in plaats van de vluchtige rechten die door het Verdrag inzake de Rechten van het Kind verleend worden. Op die manier kan men meer betekenisvolle participatie door kinderen en jongeren verkrijgen in het vormgeven van de wetten en het beleid dat hen beïnvloedt.
Summary: This article questions whether children and young people can be said to have participated in processes relating to the introduction of recent government policy with respect to children and young people and the significance that has been attached to their views. Whilst recognising the undoubted importance of the United Nations Convention on the Rights of the Child (UNCRC) as an instrument setting out the aspirational standards to be applied when working with children and young people, and its value as an audit tool, the limitations of the Convention should be openly acknowledged. The argument is made, using lessons drawn from decided cases, that greater attention should be focused on the legal rights that children have under the European Convention on Human Rights (ECHR) rather than on the more ephemeral rights conferred by the United Nations Convention on the Rights of the Child, in order to achieve more meaningful participation by children and young people in the shaping of laws and policies affecting them.

Samenvatting:	Ons begrip van huiselijk geweld sluit traditioneel kinderen uit. Een andere, zachtere taal wordt gebruikt bij de beschrijving van ons gebruik van geweld ten aanzien van kinderen, om het zo acceptabeler te maken. De krachtige steun onder het algemene publiek en politici voor het behoud van de huidige wetgeving, die ouders toelaat om redelijke straffen te gebruiken wanneer men hun kinderen disciplineert, wordt geïnformeerd door het veel voorkomende standpunt dat fysieke bestraffing van kinderen geen geweld is, slechts matig gebruikt wordt, met liefde wordt gedeeld en een noodzakelijke vorm van discipline is die slechts als laatste optie wordt gebruikt. Het bewijs toont echter iets anders aan. Het gebruik van zware bestraffing komt veel voor bij kleine kinderen. Kinderen zelf melden dat ‘een mep geven’ eigenlijk hetzelfde is als slaan en significante pijn veroorzaakt. De wetgeving in het VK schendt het VN Verdrag inzake de Rechten van het Kind, en het Europese Hof voor de Rechten van de Mens heeft vastgesteld dat het ook een schending is van Artikel 3 van het Europese Verdrag voor de Rechten van de Mens. Een significant oeuvre van onderzoek benadrukt de schade die geassocieerd wordt met fysieke bestraffing. Het Europese Hof vereist dat de overheid de wet aanpast. Deze aanpassing moet de legaliteit van het slaan van kinderen beëindigen en kinderen dezelfde bescherming tegen mishandeling geven als volwassennen.
Summary:	Our understanding of domestic violence has traditionally excluded children. A different, and softer language is employed to describe our use of violence towards children in order to render it more acceptable. The powerful support among the general public and politicians for the retention of the current legislation which permits parents to use reasonable chastisement when disciplining their children is informed by a prevailing view that physical punishment of children is not violence, is used sparingly, with love and as a necessary form of discipline of last resort. The evidence shows otherwise. The incidence of the use of severe punishment against small children is high. Children themselves report that ‘smacking’ is really hitting and causes significant pain. UK legislation violates the UN Convention on the Rights of the Child, and the European Court of Human Rights has ruled that it also breaches Article 3 of the European Convention on Human Rights. A significant body of research highlights the harm associated with physical punishment. The Government is now required by the European Court ruling to amend the law. It should do so by ending the legitimacy of hitting children and giving them the same protection from assault as adults.

Het belang van deze zaak ligt hoofdzakelijk in de discussie over de beslissing van het Europese Hof voor de Rechten van de Mens (Grote Kamer) omtrent Neulinger & Shuruk v. Switzerland [2011] 1 FLR 122, maar ook als de eerste beslissing van het Hooggerechtshof die de interpretatie van Artikel 13(b) van het Verdrag uit 1980 in overweging neemt en als een nuttige bevestiging van de compabiliteit van het Verdrag met Artikel 3.1 van het VN VRK.
Summary:	This case note examines the Supreme Court's decision in Re E (Children) (Abduction: Custody Appeal) [2011] UKSC 27; [2011] 2 WLR 1326, in particular, its analysis of the interrelationship between the 1980 Hague Convention on the Civil Aspects of International Child Abduction, the United Nations Convention on the Rights of the Child and the European Convention on Human Rights. The importance of the case lies primarily in its discussion of the European Court of Human Rights (Grand Chamber) decision Neulinger & Shuruk v. Switzerland [2011] 1 FLR 122 but also as the first Supreme Court decision to consider the interpretation of Article 13(b) of the 1980 Convention and as a useful confirmation of the Convention's compatibility with Article 3.1 of the UNCRC.

Samenvatting:	Het belangrijkste mensenrechteninstrument van de Raad van Europa is het Europees Verdrag voor de Rechten van de Mens (EVRM). Hierin worden de burgerlijke en politieke rechten vastgelegd die door de lidstaten gewaarborgd dienen te worden. Het EVRM is complementair met het Europees Sociaal Handvest, wat op zijn beurt economische, sociale en culturele rechten beschermt. Hoewel het Verdrag geen expliciete melding van kinderrechten maakt, zijn kinderen inbegrepen in de term “eenieder die ressorteert onder de rechtsmacht” van een lidstaat (art. 1). Het EVRM wordt ten uitvoer gebracht onder het toezicht van het Europees Hof voor de Rechten van de Mens in Straatsburg. Het Hof is bevoegd uitspraak te doen in individuele en interstatelijke verzoekschriften, alsook adviezen te verschaffen. Iedere Verdragsluitende Partij moet zich houden aan de uitspraken van het Hof en alle nodige maatregelen treffen om deze na te leven. De uitvoering van de vonnissen staat onder toezicht van het Comité van Ministers. De Theseus databank bevat analyses van rechtspraak van het Europees Hof voor de Rechten van de Mens, die relevant is voor kinderrechten.
Summary:	The Council of Europe’s main human rights treaty, known as the European Convention on Human Rights (ECHR), sets out the civil and political rights and freedoms that the Member States agree to ensure. It complements the European Social Charter, which on its turn guarantees economic, social and cultural rights. Even though the Convention makes no specific mention of children’s rights, the rights contained in the ECHR apply to “everyone” within the Member State’s jurisdiction (Article 1). This includes children too. The ECHR is enforced by the European Court on Human Rights in Strasbourg. The Court has jurisdiction to deal with individual complaints and inter-State petitions. In addition, it can issue advisory opinions. The parties to a case must abide by the judgments of the Court and take all necessary measures to comply with them. The execution of judgements is supervised by the Committee of Ministers. The Theseus database provides analyses of case law from the European Court of Human Rights relevant to children’s rights.
