Samenvatting: Dit Verdrag heeft betrekking op de economische, sociale en culturele rechten in het Inter-Amerikaanse gebied. De rechten van kinderen vallen onder artikel 16, waarin staat dat elk kind, ongeacht zijn afkomst, het recht heeft op de bescherming die zijn status als een minderjarige vraagt van zijn familie, de maatschappij en de Staat. Elk kind heeft het recht om te groeien onder de bescherming en de verantwoordelijkheid van zijn ouders, behalve in uitzonderlijke, juridisch-erkende omstandigheden. Een kind van jonge leeftijd behoort niet te worden gescheiden van zijn moeder. Ieder kind heeft ook het recht op gratis en verplicht onderwijs, althans in de elementaire fase, en het recht om zijn opleiding voort te zetten op hogere niveaus van het onderwijssysteem. Deze bepalingen worden herhaald in de artikelen 13 (onderwijs) en 15 (bescherming van het gezin).
Summary: This Convention covers economic, social and cultural rights in the Inter-American area. Children’s rights are covered by Article 16, stating that every child, whatever his parentage, has the right to the protection that his status as a minor requires from his family, society and the State. Every child has the right to grow under the protection and responsibility of his parents; save in exceptional, judicially-recognized circumstances, a child of young age ought not to be separated from his mother. Every child also has the right to free and compulsory education, at least in the elementary phase, and to continue his training at higher levels of the educational system. Such provisions are repeated in Articles 13 (education) and 15 (protection of the family).

Samenvatting:	De vernieuwde sociale agenda vult de Lissabon-strategie voor de periode 2008-2010 aan. Hij stelt een geïntegreerde aanpak voor met het oog op het reageren op veranderingen in de arbeidsmarkt en de Europese samenleving. Een van de prioritaire gebieden voor actie is kinderen en jongeren. Zo moet een kwalitatief hoogstaand onderwijssysteem aangepast aan de behoeften van de arbeidsmarkt bijdragen tot de integratie van jongeren in de samenleving. Nieuwe initiatieven van de Commissie moeten in het bijzonder gericht zijn op de bescherming van de rechten van het kind en de strijd tegen kinderarmoede.
Summary:	The renewed social agenda completes the Lisbon Strategy for the period 2008-2010. It proposes an integrated approach with a view to responding to transformations in the employment market and European society. One of its priority areas for action is children and youth. Quality education systems adapted to the needs of the employment market should contribute to the inclusion of young people in society. New initiatives from the Commission should, in particular, target the protection of the rights of the child and the fight against child poverty. Samenvatting:	De laatste jaren is er een explosie waar te nemen in de methodologieën betreffende het naleven van de economische en sociale rechten (ESR) van kinderen. Belangrijke voorbeelden betreffen het ontwikkelen van indicatoren, criteria, een budget analyse op basis van kinderrechten en een analyse van de invloed van kinderrechten. Het Comité voor de Rechten van het Kind heeft zulke instrumenten geprezen in zijn werk en heeft actief het gebruik ervan gepromoot. Problematisch is nochtans dat er serieuze tekortkomingen zijn in de benadering van het Comité ten aanzien van de ESR standaarden die verankerd zijn in het VN Kinderrechtenverdrag, die dreigen een invloed te hebben op de effectiviteit van zo’n methodologieën. Dit artikel stelt dat het Comité nagelaten heeft om de inhoudelijke verplichtingen, opgelegd door artikel 4, en veel van de ESR verzekerd in het Kinderrechtenverdrag voldoende in de diepte te gaan opnemen. Bijgevolg, is het orgaan er niet in geslaagd om een coherent en samenvattend kader, specifiek gericht op de ESR voor kinderen, te gaan uiteen zetten. Door gebruik te maken van het voorbeeld van de budget analyse op basis van de kinderrechten, stelt de auteur dat deze omissie een belangrijke hindernis vormt voor degene die op zoek is naar het beoordelen van de mate waarin staten tegemoet gekomen zijn aan hun verplichtingen in het Kinderrechtenverdrag, die betrekking hebben op de ESR. Dit artikel brengt dus de belangrijkste problemen, die tot nu toe weinig kritische, academische aandacht gekregen hebben, samen en wijst ze ook aan, namelijk de ESR van kinderen in het Kinderrechtenverdrag, de relatie tussen budgettaire besluitvorming en het Kinderrechtenverdrag, en de budget analyse op basis van kinderrechten.
Summary:	Recent years have seen an explosion in methodologies for monitoring children’s economic and social rights (ESR). Key examples include the development of indicators, benchmarks, child rights-based budget analysis and child rights impact assessments. The Committee on the Right of the Child has praised such tools in its work and has actively promoted their usage. Troublingly, however, there are serious shortcomings in the Committee’s approach to the ESR standards enshrined in the UN Convention on the Rights of the Child (CRC), which threaten to impact upon the efficacy of such methodologies. This article argues that the Committee has failed to engage with the substantive obligations imposed by Article 4 and many of the specific ESR guaranteed in the CRC in sufficient depth. As a result, that body has not succeeded in outlining a coherent, comprehensive child rights-specific ESR framework. Using the example of child rights-based budget analysis, the author claims that this omission constitutes a significant obstacle to those seeking to evaluate the extent to which states have met their ESR-related obligations under the CRC. The article thus brings together and addresses key issues that have so far received only very limited critical academic attention, namely, children’s ESR under the CRC, the relationship between budgetary decision-making and the CRC, and child rights-based budget analysis.
