Dit artikel focust op één cruciaal aspect van de hervormingsplannen: de idee dat magistraten contact moeten leggen met jonge delinquenten en hun families. Na een theoretische analyse van de basis van en de verantwoording voor een speciale jeugdrechtbank, stelt het artikel enkele vaststellingen voor inzake verschillen tussen de communicatieculturen van jeugdrechtbanken in Engeland/Wales en Nederland. Het artikel sluit af met het in vraag stellen van de basisveronderstelling van de White paper, namelijk dat fundamentele veranderingen kunnen worden gerealiseerd zonder structurele hervormingen. Summary: The UK Government’s White Paper ‘No More Excuses’ (Home Office, 1997) set out plans for changing the culture of the Youth Court. This article focuses on one crucial aspect of the reform plans: the idea that magistrates need to engage with young offenders and their families. After a theoretical analysis of the foundation and justification for a special youth court, the article presents some findings concerning differences between the communication cultures of English/Welsh and Dutch Youth Courts. The article concludes by questioning the basic assumption of the White Paper, that fundamental changes could be realised without structural reform. Kinderen in kwetsbare situatiesSamenvatting: Dit artikel geeft een historische schets van een eeuw jeugdrecht in Nederland. Het richt zich op de ontwikkeling van het begrip jeugd vanaf het begin van de twintigste eeuw tot nu. Uitgaande van het begrip degeneratie en het idee van het verwaarloosde kind ontstond in de jaren dertig een psychologiseringsproces. Cruciaal was de notie van het kinderlijke karakter van het gedrag van minderjarige delinquenten, die duidelijk werd geïnspireerd door nieuwe inzichten uit de pedagogie, de ontwikkelingspsychologie en de kinderpsychiatrie. De auteur stelt dat er de laatste tijd, na enkele decennia een trend naar meer hardheid op het gebied van criminaliteit, aanwijzingen zijn voor een heropleving van de notie van het kinderlijke karakter van jonge delinquenten, wederom geïnspireerd door kennis en inzichten uit de gedragswetenschappen maar ook uit de neurologie en het hersenonderzoek. Summary: This article gives a historical sketch of a century of juvenile justice in the Netherlands. It focuses on the development of the concept of childhood from the beginning of the twentieth century to the present. Starting from the notion of degeneration and the idea of the neglected child, in the thirties a psychologization process emerged. Crucial was the notion of the childlike nature of the behavior of minor offenders, which was clearly inspired by new insights coming from pedagogy, developmental psychology and child psychiatry. The author argues that recently, after some decades showing a trend towards more toughness on crime, there are indications of a reemergence of the notion of the childlike nature of young delinquents, again inspired by knowledge and insights from the behavioral sciences but also from neurology and brain research. De overdracht van jongeren van de jeugdrechtbank naar de correctionele rechtbank was gebruikelijk in grote delen van de wereld de afgelopen eeuw. Vanaf het begin maakten gerechtelijke opheffingsmechanismen om zeer ernstige gevallen te verwijderen uit de jeugdrechtbank deel uit van het jeugdrecht in vele landen. Het werd en wordt nog steeds door velen gezien als een 'veiligheidsklep' voor de jeugdrechtbanken, en voor het jeugdrechtssysteem in het geheel. Het idee was dat door het aanbieden van die veiligheidsklep voor zeer ernstige gevallen die slechts zelden voorkomen, de speciale behandeling van de massa van jonge delinquenten zou kunnen gered worden. Er was tot voor kort weinig tot geen onderzoek naar deze mechanismen gevoerd. The transfer of youths from the juvenile to the criminal court was common in large parts of the world throughout the past century. Right from the start, judicial waiver mechanisms to remove very serious cases from the juvenile court formed part of the juvenile justice system in many countries. It was and is still viewed by many as a ‘safety valve’ for the juvenile courts, and for the juvenile justice system as a whole. The idea was that by offering this safety valve for extremely serious cases that happen only rarely, the special treatment of the mass of young offenders could be saved.
