Kinderrechten (algemeen):Non-discriminatieSamenvatting: De probleemstelling van dit onderzoek betreft de vraag of jonge ‘nieuwe’ migranten (case van jongeren van Noord-Kaukasische origine) die verdacht worden van het plegen van een als misdrijf omschreven feit, anders worden bejegend doorheen hun justitiële trajecten in vergelijking met autochtone jongeren of ‘oude migranten’ (i.e. etnische minderheden) in vergelijkbare omstandigheden. We beogen deconstructie van processen van selectie en circulariteit van informatie die de afzonderlijke beslissingsprocessen in de praktijk beïnvloeden (met focus op selectie- en beslissingsprocessen en in mindere mate uitkomsten of louter juridische vergelijkingen van beslissingen, en vragen naar hun legitimiteit strictu senso). We trachten na te gaan of de positie van ‘nieuwe migranten’ direct of indirect de beeldvorming en definities m.b.t. de persoon van de jongere, de feiten en uiteindelijk selecties en beslissingen beïnvloedt. Vertrekkende vanuit interpretatieve traditie staan we stil bij de wijze waarop dossiers vorm en richting krijgen, hoe definities en hierop gebaseerde beslissingen geconstrueerd en gelegitimeerd worden. De onderliggende assumptie is dat justitiële (i.e. maatschappelijke) reactie samenhangt met de sociale positie van de betrokkenen. We trachten te reconstrueren of en hoe het ‘nieuw’ zijn aan belang wint (of verliest) doorheen de trajecten en selecties en definities beïnvloedt. Om ‘nieuw’ te conceptualiseren vertrekken wij vanuit de noties ‘gevestigden’ en ‘buitenstaanders’ van Elias. Om de legale en sociale profielen van jongeren te reconstrueren en hierin de rol van hun positie te onderzoeken maken we gebruik van kritisch discursieve benadering. Summary: The aim of this study is to investigate whether or not young ‘new’ immigrants (case study: immigrants originating from the Northern Caucasus), who are formally suspected of having committed an offense, are treated differently compared to native youths and ‘old’ immigrant (i.e. ethnic minorities) youth in comparable circumstances (i.e. suspected of having committed similar offenses) in the practice of Juvenile Justice decision making. The goal is to uncover processes of selection and circulation of information that shape the practice of decision making throughout the trajectories (i.e. process focused approach that goes beyond the legal logic comparing outcomes or the legitimacy of in-between selections and decisions) and to investigate if the position of ‘new’ immigrants directly or indirectly influences the images of youths, their offenses and eventually, selections and outcomes. Departing from an interpretative tradition we take a look at the way that the case files (and with them the juveniles and their situations) are given shape and direction and the way that decisions are constructed and legitimised (how, by whom, based on what). We assume that societal reaction cannot be separated from one’s social position. Specifically, we attempt to reconstruct to what extent, at what stages and how the position of being a ‘new’ immigrant becomes prominent and influences definition, selection and decision making processes. To conceptualize and operationalize ‘new’ we depart from Elias’ theoretical framework of ‘established’ and ‘outsiders’. Critical discursive approach is applied to reconstruct legal and social profiles of youth and their offenses and to trace the role of their position therein. Justitie:Kindvriendelijke justitieSamenvatting: Het project verkent de manieren waarop het begrip 'cultuur' wordt toegepast in de jeugdrechtbanken. Deze institutionele context wordt ondersteund door "het is voor je eigen bestwil" idealen, waarbij een constante balans wordt gezocht tussen het beschermen, responsabiliseren en sanctioneren van jongeren. Professionals moeten ook rekening houden met de algemene achtergrond van jongeren. Eerder onderzoek heeft aangetoond dat 'alledaagse' inzichten in 'cultuur' van invloed zijn op deze beoordelingen en soms een negatieve invloed hebben op de besluitvorming. Op basis van de inzichten van juridische antropologen (die de rol van cultuur in de rechtszaal bestuderen maar zich vaak beperken tot cultuur in juridische argumenten) legt dit onderzoek een link naar de (narratieve) criminologie om de rol van cultuur in de sociale praktijk van de rechtbanken te begrijpen. Zowel narratieven van 'cultuur en criminaliteit' als 'cultuur en besluitvorming' die in formele en informele interacties in de rechtszaal worden geproduceerd, zullen worden bestudeerd. Het project bespreekt wat cultuur betekent en hoe cultuurverhalen functioneren om (mogelijk schadelijke) interventies te legitimeren. Theoretisch wordt het begrip 'strafschade' verder ontwikkeld.
Er zullen observaties in twee jeugdrechtbanken worden uitgevoerd.
Geleidelijk aan verschuift het onderzoek naar een actievere modus, waarbij een discussie over 'cultuur' wordt gestimuleerd (in interviews, in rondetafelgesprekken met cultuurdeskundigen en bemiddelaars, door jongeren te betrekken geconfronteerd mer justitiële interventies). Op deze manier draagt het onderzoek bij aan een transformatie van statische cultuurbegrippen. Bovendien analyseert het de machtsdynamiek van deze collectieve onderhandelingen over de betekenis van 'cultuur'.Summary: The project explores the ways in which the notion ‘culture’ is mobilised in youth courts. This institutional context is underpinned by "it's for your own good" ideals, entailing a constant balancing between protecting, responsibilising and sanctioning young people. Professionals also need to take into account youth's overall background. Previous research has shown that 'mundane' understandings of ‘culture' influence these assessments and at times negatively impact decision making. Based on the insights of legal anthropologists (who study the role of culture in court but often limit themselves to culture in legal arguments), this research makes a link to (narrative) criminology to understand the role of culture in the social practice of courts. ‘Culture and crime’ as well as ‘culture and decision making’ narratives produced in formal and 'backstage' interactions in courts will be studied. The project discusses what culture means and how narratives of culture function to legitimise (possibly harmful) interventions. Theoretically, it further develops the notion 'penal harm’.
Observations in two youth courts will be conducted.
Gradually, the research shifts to a more active mode, stimulating a discussion about 'culture' (in interviews, in roundtables involving cultural experts and mediators, by involving young people who became subject to judicial interventions by means of a collaboratively made video). This way the study contributes to a transformation of static culture notions. Moreover, it analyses the power dynamics of these collective negotiations of the meaning of ‘culture’.

Kinderen in kwetsbare situaties:Minderheden en inheemse volkeren:MinderhedenSamenvatting: Deze bijdrage handelt over Roma-meisjes die wegens een als misdrijf omschreven feit
(MOF) voor de jeugdrechtbank verschijnen. Onderzoek heeft aangetoond dat jeugdbeschermingsactoren deze meisjes als onbenaderbaar en als onbehandelbaar
beschouwen. Dit resulteert in een tweesporenbeleid op de jeugdrechtbank: geen
interventie of plaatsing in een gesloten instelling. In een eerder artikel lag de focus
vooral op de wijze waarop deze meisjes werden omschreven in de jeugdrechtbankdossiers door politie, maatschappelijk werkers, jeugdrechters en psychiaters. Deze bijdrage steunt op interviews met verschillende professionele actoren die in contact
komen met deze Roma-meisjes in het jeugdbeschermingssysteem. We bekijken vooreerst de visie van de actoren over deze meisjes en hun context. Verder gaan we ook in
op hoe zij omgaan met deze dossiers en welke reactiewijzen zij als (in)adequaat
beschouwen. Afsluiten doen we met een reflectie over het cultuur-centrische discours
van de professionele actoren, en over de ambivalente positie van Roma-meisjes in de
jeugdbescherming, als slachtoffer dan wel als dader.Summary: This paper focuses on Romani girls who appear before the Youth Court in delinquency cases. Research has revealed that youth justice professionals perceive these
girls as unapproachable and as incorrigible, which results in a dual reaction of the Youth Court: non-intervention or confinement in a closed institution. In an earlier
article, we mainly focused on how Romani girls are described in the Youth Court case
files by policepersons, social workers, judges and psychiatrists. The current contribution draws on interviews with professional actors who work with Romani girls in the
youth justice system. We first explore the professional actors’ views regarding these
girls and their backgrounds. Next, we discuss how they deal with cases of Romani girls
and which reactions they consider as (in)adequate. The article ends with a reflection
