De probleemstelling van dit onderzoek betreft de vraag of jonge ‘nieuwe’ migranten (case van jongeren van Noord-Kaukasische origine) die verdacht worden van het plegen van een als misdrijf omschreven feit, anders worden bejegend doorheen hun justitiële trajecten in vergelijking met autochtone jongeren of ‘oude migranten’ (i.e. etnische minderheden) in vergelijkbare omstandigheden. We beogen deconstructie van processen van selectie en circulariteit van informatie die de afzonderlijke beslissingsprocessen in de praktijk beïnvloeden (met focus op selectie- en beslissingsprocessen en in mindere mate uitkomsten of louter juridische vergelijkingen van beslissingen, en vragen naar hun legitimiteit strictu senso). We trachten na te gaan of de positie van ‘nieuwe migranten’ direct of indirect de beeldvorming en definities m.b.t. de persoon van de jongere, de feiten en uiteindelijk selecties en beslissingen beïnvloedt. Vertrekkende vanuit interpretatieve traditie staan we stil bij de wijze waarop dossiers vorm en richting krijgen, hoe definities en hierop gebaseerde beslissingen geconstrueerd en gelegitimeerd worden. De onderliggende assumptie is dat justitiële (i.e. maatschappelijke) reactie samenhangt met de sociale positie van de betrokkenen. We trachten te reconstrueren of en hoe het ‘nieuw’ zijn aan belang wint (of verliest) doorheen de trajecten en selecties en definities beïnvloedt. Om ‘nieuw’ te conceptualiseren vertrekken wij vanuit de noties ‘gevestigden’ en ‘buitenstaanders’ van Elias. Om de legale en sociale profielen van jongeren te reconstrueren en hierin de rol van hun positie te onderzoeken maken we gebruik van kritisch discursieve benadering. |
| Summary: |
The aim of this study is to investigate whether or not young ‘new’ immigrants (case study: immigrants originating from the Northern Caucasus), who are formally suspected of having committed an offense, are treated differently compared to native youths and ‘old’ immigrant (i.e. ethnic minorities) youth in comparable circumstances (i.e. suspected of having committed similar offenses) in the practice of Juvenile Justice decision making. The goal is to uncover processes of selection and circulation of information that shape the practice of decision making throughout the trajectories (i.e. process focused approach that goes beyond the legal logic comparing outcomes or the legitimacy of in-between selections and decisions) and to investigate if the position of ‘new’ immigrants directly or indirectly influences the images of youths, their offenses and eventually, selections and outcomes. Departing from an interpretative tradition we take a look at the way that the case files (and with them the juveniles and their situations) are given shape and direction and the way that decisions are constructed and legitimised (how, by whom, based on what). We assume that societal reaction cannot be separated from one’s social position. Specifically, we attempt to reconstruct to what extent, at what stages and how the position of being a ‘new’ immigrant becomes prominent and influences definition, selection and decision making processes. To conceptualize and operationalize ‘new’ we depart from Elias’ theoretical framework of ‘established’ and ‘outsiders’. Critical discursive approach is applied to reconstruct legal and social profiles of youth and their offenses and to trace the role of their position therein. |
