In dit essay beargumenteert Paul Smeyers dat risico-denken en de technologisatie dat gepaard gaat met het opvoeden van kinderen in deze context, op natuurlijke wijze leidt tot het juiste discours. Echter, als men denkt over de relatie tussen ouders en kinderen in termen van rechten, kan men geconfronteerd worden met een aantal onoverkomelijke problemen. Het concept van ‘het beste belang voor het kind’, dat vaak wordt ingeroepen als concept helemaal niet duidelijk. Smeyers beweert dat het discours over rechten, hoewel zeker belangrijk en relevant in zover dat het de relatie tussen ouders en de staat bespreekt, zorgt voor een verarming in het begrijpen van de relatie tussen familieleden wanneer dit wordt gebruikt in een alles bevattend raamwerk in deze context. Hij besluit dat we de totaliserende tendens van de transformatie van de sociale werkelijkheid in een systeem moeten overstijgen, net zoals het definiëren van de relatie tussen ouders en kinderen in technische termen, als het verantwoordelijk houden van ouders voor de opvoeding van hun kinderen. Summary: Due to a number of radical changes in society, the role of parents in the upbringing of their children has been redefined. In this essay, Paul Smeyers argues that "risk" thinking, and the technologization that goes with it in the context of child rearing, naturally leads to the rights discourse, but that thinking about the relation between parents and children in terms of rights confronts one with a number of insurmountable problems. The concept of the "best interests of a child" that is often invoked is, to say the least, not at all clear. Smeyers contends that while the discourse of rights is clearly important and relevant insofar as the relation between parents and the state are discussed, it impoverishes our understanding of relations of family members when used as an all-inclusive framework in that context. Therefore, he concludes that we must surpass the totalizing tendency of the transformation of the social realm into a system, of defining the relation between parents and children in technical terms, and of holding parents liable for their children's upbringing. De focus ligt daarbij in eerste instantie niet op de concrete invulling van dit recht of de onderwijspraktijk, maar wel op de vraag wat de betekenis en rol van onderwijs kan zijn voor ruimere samenlevingsvraagstukken. Daarbij wordt door middel van interviews en veldwerkstudie onderzocht welke betekenisattributies er zijn bij verschillende betrokken actoren (Roma, vrijwilligers en professionals binnen de onderwijssector en de welzijnssector, beleidsmakers). Summary: This research project seeks for an answer to the question which can be the meaning of the universal right to education for irregular migration children and Roma children more in particular from an educational viewpoint. In first instance, the focus is not on the how this right should be translated into concrete practices, but rather on the meaning and role of education for broader societal questions. Interviews and fieldwork are applied in order to gain an insight in various attributions of meaning amongst the different stakeholders who are involved (Roma people, voluntary and professional fieldworkers in both education and social work, policy makers).
