Het behelst het recht om niet van vrijheid beroofd te worden wegens het niet-naleven van een contractuele verplichting, het recht op vrijheid van beweging en de vrijheid een verblijfplaats te kiezen, het verbod voor een Verdragspartij om een staatsburger uit te wijzen, en het verbod op collectieve uitwijzing van vreemdelingen. Summary: The Fourth Protocol to the ECHR secures certain rights and fundamental freedoms not included in previous texts. These include: no deprivation of liberty for non-fulfilment of contractual obligations, right to liberty of movement and freedom to choose one's residence, prohibition of a State's expulsion of a national, and prohibition of collective expulsion of aliens. Niet geratificeerd door België.Taal : Engels (eng) Trefwoorden: Gezin:Algemeen Samenvatting: Het zevende aanvullend protocol bij het EVRM voegt een aantal rechten en fundamentele vrijheden toe aan het moederverdrag en de voorgaande protocollen. Het behelst met name:
- recht van vreemdelingen op procedurele waarborgen in geval van uitzetting uit het grondgebied van de Staat;
- recht van een persoon die voor een strafbaar feit is veroordeeld om na deze veroordeling in beroep te kunnen gaan bij een hogere rechtsinstantie;
- recht op compensatie bij gerechtelijke dwaling;
- recht om niet te worden berecht of bestraft in strafrechtelijke procedures voor een strafbaar feit waarvoor men reeds eerder werd vrijgesproken of veroordeeld (ne bis in idem);
- gelijkheid van rechten en verantwoordelijkheden tussen echtgenoten. De toelichting specifieert hierbij dat het feit dat echtgenoten gelijkheid van rechten en verantwoordelijkheden genieten in de relatie met hun kinderen, niet wegneemt dat Staten nodige maatregelen kunnen treffen in het belang van deze kinderen.Summary: The Seventh Protocol to the ECHR extends the list of rights protected under the Convention and its Protocols to include the following:
- The right of aliens to procedural guarantees in the event of expulsion from the territory of a State;
- The right of a person convicted of a criminal offence to have the conviction of sentence reviewed by a higher tribunal;
- The right to compensation in the event of a miscarriage of justice;
- The right not to be tried or punished in criminal proceedings for an offence for which one has already been acquitted or convicted (ne bis in idem);
- Equality of rights and responsibilities as between spouses.
