Kinderrechten (inter)nationaal:Landen en regio's:Afrika:Zuid-AfrikaSamenvatting: Systematische participatie van kinderen in de beleidsvorming ontwikkelt zich op trage wijze en de volle realisatie van de rechten die worden beschermd in Art. 12(1) van het Verdrag inzake de Rechten van het Kind blijft achterwege. Dit artikel onderzoekt de alternatieve mogelijkheden om deze participatie van kinderen in het bestuur te verwezenlijken door de wettelijke bescherming van niet-electorale vormen van publieke participatie te analyseren, zowel op internationaal vlak als op nationaal vlak in Zuid-Afrika. De auteur bespreekt een case-study van de Zuid-Afrikaanse wetgeving, die de integratie van het standpunt van kinderen in het bestuursproces ondersteunt, door middel van hun betrokkenheid in de publieke participatie. Summary: Systematic child participation in governance decision-making has been slow to develop, and full realisation of the rights protected in Art. 12(1) of the Convention on the Rights of the Child, lags behind. This article explores alternative avenues for realising children's participation in governance, by analysing the legal protection of non-electoral forms of public participation, internationally as well as nationally in South Africa. The author provides a case study of the South African law, which arguably supports the inclusion of children's views in governance processes, through their involvement in public participation. Kinderrechten (inter)nationaal:Landen en regio's:Afrika:Zuid-AfrikaSamenvatting: Dit artikel evalueert de wetgeving die werd ontwikkeld in Zuid-Afrika met betrekking tot de wettelijke erkenning en ondersteuning van huishoudens waar kinderen aan het hoofd staan. Er wordt een uitleg en kritische analyse van de nieuwe statutaire voorzieningen verschaft. Er wordt aangetoond dat in ontwikkelingslanden die getroffen zijn door de AIDS pandemie en slechts beperkte middelen hebben, zoals Zuid-Afrika, het aannemen van een positieve houding ten opzichte van de formele wettelijke erkenning zwaarder doorweegt dan een negatieve houding. Er wordt echter aangetoond dat, om aan het belang van het kind te voldoen, het essentieel is om de erkenning te baseren op de levensvatbaarheid van de huishoudens. Het onderzoek toont ook aan dat, hoewel Zuid-Afrikaanse voorzieningen grensverleggend zijn en een aanzienlijke waarde bezitten als voorbeeld voor de andere landen, er toch bepaalde tekortkomingen bestaan die hun effectiviteit kunnen schaden. Wijzigingen en aanvullende formuleringen worden voorgesteld. Summary: This article evaluates legislation developed in South Africa for the legal recognition and support of child-headed households. It provides an explanation and critical analysis of new statutory provisions. We show that in a developing country with AIDS pandemic challenges and limited resources such as South Africa reasons in favour of formal legal recognition outweigh those against. We demonstrate, however, that in order to meet the best interests standard it is essential to base recognition on household viability. Our analysis indicates that, although the South African provisions are groundbreaking and of considerable value as an example for other countries, there are some deficiencies which may compromise their effectiveness. Amendments and supplementary wording are proposed. Kinderrechten (inter)nationaal:Landen en regio's:Europa:RoemeniëSamenvatting: Roemenië is sinds 1990 een partij bij het VN-Verdrag inzake de rechten van het kind (CRC), 1989, en sindsdien is het CRC rechtstreeks van toepassing op de rechtbanken en andere overheidsinstanties. Het land heeft lang moeite gehad om de rechten van kinderen voldoende te beschermen. Bekende systematische problemen die betrekking hebben op Roemeense kinderen waren institutionalisatie, adopties tussen landen, een onvoldoende kinderregeling, armoede en discriminatie, om maar een paar te noemen. In dit artikel wordt de toepassing van het CRC door de rechtbanken onderzocht en de impact die dit heeft gehad op de bescherming van de rechten van kinderen in Roemenië. De gekozen constitutionele en gerechtelijke jurisprudentie die in het artikel wordt onderzocht, tonen aan dat de rechtbanken slechts een marginale impuls hebben voor de systematische verandering, maar hebben bijgedragen tot de bescherming van individuele rechten. Enkele mogelijke oorzaken voor deze situatie - verdeeld over factoren met betrekking tot het justitie systeem in Roemenië en CRC-gerelateerde factoren - worden besproken. Summary: Romania has been a party to the UN Convention on the Rights of the Child (CRC), 1989, since 1990, and since then the CRC is directly applicable by the courts and other state bodies. For a long time the country struggled to provide adequate protection for the rights of children. Well-known systemic problems affecting Romanian children were institutionalisation, inter-country adoptions, an inadequate child justice system, poverty, and discrimination, to name but a few. This article examines the application of the CRC by the courts, and the impact which this has had on the protection of children’s rights in Romania. The selected constitutional and judicial (i.e. ordinary courts) jurisprudence examined in the article shows that courts have only marginally provided impetus for systemic change, but have, however, contributed to the protection of individual rights. A few potential causes for this state of affairs – divided into factors relating to the justice system in Romania and CRC-related factors – are discussed.
