Het rapport vult het Belgische gecombineerde vijfde en zesde periodieke rapport aan. ‘What Do You Think?’ is een participatieproject waarbij UNICEF België gedurende twee jaar getuigenissen, ervaringen en standpunten van migranten- en vluchtelingenkinderen verzamelde in opvangcentra en scholen.
In bijlage vindt men een brief van UNICEF aan het Comité voor de Rechten van Kind over de aanbevelingen van migranten- en vluchtelingenkinderen volgens het onderzoek ‘What Do You Think?’.Summary: In this report, UNICEF Belgium analyses the main challenges that children in vulnerable situations in Belgium face. the report complements the Belgian combined fifth and sixth periodic report. what do you think? is a participatory project in which UNICEF Belgium collected testimonies, experiences and views of migrant and refugee children in reception structures and schools for a period of two years.

De uiteindelijke inhoud vertegenwoordigt een verschuiving van eerder denken op het gebied van de rechten van kinderen. De inhoudelijke artikelen van de Conventie garanderen voor kinderen het volledige scala van mensenrechten en zetten ook een internationaal precedent door de mate waarin ze zich richten op de rechten van het individuele kind en een non-paternalistische houding ten opzichte van dat kind. De betekenis van het Verdrag voor sociale wetenschappers ligt vooral in de manier waarop de opstellers aandacht hebben besteed aan de psychische en fysieke ontwikkeling van het kind in de richting van de volwassenheid. Its final content represents a shift from earlier thinking in the field of children's rights. The substantive articles of the Convention guarantee to children the full range of human rights and also set an international precedent by the extent to which they focus on the rights of the individual child and provide a nonpaternalistic attitude toward that child. The significance of the Convention for social scientists lies primarily in the way in which the drafters have paid attention to the psychological and physical development of the child toward adulthood. Onderwijs:AlgemeenSamenvatting: In dit artikel wordt de toepassing van artikel 12 van het UNCRC op het onderwijs in Engeland onderzocht, met speciale nadruk op de betrokkenheid van kinderen bij de definities van "geschikt onderwijs" in het kader van Engelse scholen. Er wordt aangetoond dat er ondanks een aanspraak op kinderrechten door de Britse regering weinig vooruitgang is geboekt met betrekking tot artikel 12 en de deelname van de leerlingen aan het onderwijsbeleid en de praktijk. Er wordt geargumenteerd dat dit komt omdat de schoolomgeving kinderen vanuit een paternalistisch kader kijkt, en de beschikbare mechanismen voor kinderen om deel te nemen vanuit volwassenen gedefinieerd en gecontroleerd zijn, en dit beperkt wat kinderen kunnen zeggen. Het papier wordt afgesloten met enkele voorgestelde redenen waarom deze toestand van zaken bestaat en wat er gedaan kan worden om dit te verhelpen. Summary: This paper explores the application of Article 12 of the UNCRC to education in England, with specific emphasis on children’s involvement in definitions of “suitable education” in the context of English schools. It is demonstrated that, despite a claimed commitment to children’s rights by the UK government, little progress has been made in relation to Article 12 and pupil participation in education policy and practice. It is argued that this is because the school environment views children from within a paternalistic framework and the available mechanisms for children to participate are adult-defined and controlled and this limits what children are able to say. The paper concludes by suggesting some reasons why this state of affairs exists and what might be done to remedy it. Media:AlgemeenSamenvatting: Het IVRK, ingevoerd met de bedoeling om de rechten van het kind te beschermen, is een niet-onderhandelbare reeks standaards. Een van de basisprincipes dat het IVRK onderbouwt is het recht van het kind om volledig te participeren op sociaal vlak, alsook om toegang te verkrijgen tot bronnen van sociale steun zonder overdreven inmenging. Hier tegenover staat het recht van het kind om beschermd te worden tegen kwaad, misbruik en uitbuiting. Gedurende de afgelopen decennia heeft het Internet zich ontwikkeld als een snel en gemakkelijk toegankelijk medium waarmee mensen met elkaar in contact kunnen komen en kunnen communiceren. Terwijl het Internet voor kinderen een bron van ondersteuning is door chatrooms, online gemeenschappen en sociale netwerksites, kan het evengoed kwetsbare kinderen blootstellen aan roofzuchtende en deviante figuren die het risico op kwaad doen toenemen. Summary: Put in place to protect the rights of the child, the Convention on the Rights of the Child is a set of non-negotiable standards. A core principle underpinning the Convention is the child's right to participate fully in social arenas and to access sources of social support without excessive interference. Juxtaposing this is the right of the child to be shielded from harm, abuse and exploitation. Over the past several decades the Internet has emerged as a fast and easily accessible medium for people to connect and communicate. While the Internet provides children with a source of support through chat rooms, online communities and social networking sites, just as equally it can expose vulnerable children to predatory and deviant individuals exacerbating the potential for harm. Zo wordt geprobeerd een volledig beeld te krijgen van de manier waarop België het Verdrag in de praktijk brengt. Het rapport vult het Belgische tweede periodieke rapport aan met ervaringen en informatie vanuit het perspectief van de NGO’s. Men gebruikt dezelfde structuur als in het landenrapport om verschillende maatregelen, verplichtingen, tekorten en successen aan te halen. Summary: In an attempt to create a complete picture of how Belgium translates the Convention on the Rights of the Child into practice, the Belgian NGOs in this report analyse the conformity of Belgian legislation with the CRC, as well as the extent to which this legislation is applied. The report complements the Belgian Second Periodic Report to the Committee with experiences and information from the NGOs’ perspective. It follows the same structure as the State Report.
