Media:BeeldvormingSamenvatting: Dit artikel past het Kinderrechtenverdrag van de VN toe op de regulering van reclame van voedsel ter preventie van obesitas bij kinderen, door het evalueren van regelgeving met betrekking tot reclame in zes rechtsgebieden ten aanzien van de principes van het verdrag. Men stelt dat het verdrag de strikte regulering van voedselreclame ter preventie van obesitas bij kinderen zou ondersteunen en vooral dat deze regulering gepast zou zijn voor het samenwerkingsmodel tussen de staat en ouders dat het verdrag veronderstelt. Het artikel rijst ook de vraag dat wanneer kinderen aanzien worden als consumenten door middel van reclame, dit geen vorm kan zijn van economische uitbuiting. Summary: This article applies the United Nations Convention on the Rights of the Child to the regulation of food advertising for the prevention of childhood obesity, evaluating the advertising regulation in six jurisdictions against the principles of the Convention. It finds that the Convention would support strict regulation of food advertising for the prevention of childhood obesity; and in particular that such regulation would be appropriate to the model of co-operation between the state and parents that the Convention posits. The article also raises the question whether the grooming of children as consumers through advertising might be a form of economic exploitation. Kinderrechten (inter)nationaal:Landen en regio's:Amerika:Zuid-Amerika:PeruSamenvatting: In dit artikel bestudeer ik kritisch de wet in Peru om minderjarigen te beschermien in bedel-situaties. Ik vind het ironisch dat we de rechten van het kind gebruiken om hun het recht te ontnemen om officieel te werken en het zelfs te rechtvaardigen dat dit wordt gecriminaliseerd en dat ze uit deze openbare ruimtes worden verwijderd door in te spelen op zeer specifieke begrippen als kindertijd, opvoeding en ruimte. Ondanks de formele nadruk van de wet op bescherming, merk ik dat men meer begaan is met sociale controle en insluiting dan met het werkelijke welzijn van de kinderen. Zo dus slaagt de wet er niet in om de basisprincipes van het Kinderrechtenverdrag, aan dewelke Peru zich verbonden heeft, te reflecteren. Ondanks dat het Verdrag vatbaar is voor meerdere interpretaties, kan het ook dienen als een potentiële tegenhanger van de repressieve wetgeving, zoals de ‘Begging Bill’. Het artikel is het resultaat van 14 maanden veldwerk in Peru en meer dan 100 interviews met beleidsmakers, overheidsofficieren, onderwijzers en straatkinderen zelf, alsook nog met anderen. Summary: In this article, I critically examine Peru’s Law to Protect Minors from situations of Begging. I consider the way in which a language of children’s rights is ironically invoked to justify the physical removal and criminalization of children working in public spaces by appeals to very specific understandings of childhood, parenting, and space. Despite the law’s formal emphasis on protection, I suggest it is more concerned with social control and containment than children’s actual well-being. As such, it fails to reflect the basic principles of the Convention on the Rights of the Child to which Peru has committed. However, because the CRC is subject to multiple interpretations, it also serves as a potential resource to counter repressive legislation such as the Begging Bill. The article is based on 14 months of field work in Peru and over 100 interviews with policy makers, government officials, educators, and street children themselves, among others. Kinderrechten (inter)nationaal:Landen en regio's:Amerika:Noord-Amerika:CanadaSamenvatting: Dit artikel bekijkt de slotbeschouwingen van het VN Comité over de Rechten van het Kind van 2012, met betrekking tot de voortgang van Canada in de implementatie van het VN Kinderrechtenverdrag. Het onderzoekt de kritiek van het VN Comité op het tempo van Canada’s vooruitgang en in het bijzonder de bemerking van het VN Comité dat de belangrijkste problemen betrekkende de implementatie van het Verdrag, intergouvermenteel van aard zijn. Dit sluit zich aan bij de diagnose van het Comité dat het probleem een probleem is van coördinatie, dat zich vooral manifesteert in het gebied van recht en beleid waarin de provinciale overheden aan de gerechtelijke autoriteit blijven vasthouden maar waarbij de federale overheid een grotere fiscale hefboom handhaaft. Dit artikel analyseert de mogelijkheden om de uitdaging betreffende kinderrechten en het publieke beleid te gaan oplossen aan de hand van twee illustratieve voorbeelden: inspanningen om de onderwijsprogramma’s in de vroege kindertijd in Canada te gaan uitbreiden en inspanningen betreffende het onderwijs van de Oorspronkelijke bevolking. Summary: This article reviews the un Committee on the Rights of the Child’s 2012 concluding observations regarding Canada’s progress in implementing the un Convention on the Rights of the Child. It examines the un Committee’s criticisms about the pace of Canada’s progress, and examines in particular the Committee’s claim that the main problems in implementing the Convention are intergovernmental. It concurs with the Committee’s diagnosis of the problem as one of coordination, which manifests particularly in areas of law and policy where provincial governments maintain jurisdictional authority but the federal government maintains the greater fiscal levers. The article analyses the possibilities of resolving these children’s rights and public policy challenges, drawing on two illustrative cases: efforts to expand early childhood education programmes in Canada and efforts to improve Aboriginal education, particularly on reserves.
