Het Verdrag is het resultaat van vele jaren moeizaam werken om de situatie van kinderen in de maatschappij te verbeteren. Het is ook het startpunt om een nieuwe houding ten aanzien van kinderen aan te nemen. Kinderrechten opnemen in het positieve recht is uiteraard geen eindpunt. Er is namelijk een duidelijk verband wettelijke en sociale normen (i.e. tussen rechtswetenschap en opvoedingswetenschap). De pedagogie, die ons leert om met kinderen om te gaan, draait helemaal om om mensenrechten en kinderrechten. Daarom is het verband tussen opvoeding en het mensenrechtenproject, met het kinderrechtenproject in het bijzonder, het centrale thema van dit boek. (Ook beschikbaar in het Engels, het Frans en het Spaans) Summary: The adoption and entry into force of the Convention on the Rights of the Child is an important milestone in history. The Convention is the result of many years of arduous effort to improve children’s situation in society. It is also the starting point for developing a new attitude to children. Obviously, making children’s rights a part of positive law is not the end of the matter. There is in fact a clear connection between legal and social norms (i.e. between the law and educational science). Educational science, teaching us how to deal with children, is all about human and children’s rights. Therefore the relationship between education and the human rights project, particularly the children’s rights project, is central to this book. Mensenrechten:VN-MensenrechtenverdragenSamenvatting: Het Verdrag inzake de Rechten van het Kind is het meest comprehensieve instrument rond kinderrechten op internationaal niveau. Vernieuwend is dat het Kinderrechtenverdrag zowel burgerlijke en politieke rechten, als economische, sociale en culturele rechten waarborgt. Door deze verschillende soorten rechten samen te brengen in één instrument, wordt het gelijkwaardige belang en de samenhang van deze rechten benadrukt. Er is wel een differentiatie in de verplichtingen inzake implementatie: ten aanzien van economische, sociale en culturele rechten zijn de staten die partij zijn enkel verplicht die maatregelen te nemen die de hun ter beschikking staande middelen toelaten (art. 4).
Een andere nieuw aspect is de idee van participatie: kinderen hebben, naast titularis te zijn van beschermings- en provisierechten, evenzeer het recht om zelf (actief) bij te dragen aan de vormgeving van hun eigen leefwereld/leefomgeving.
Het Comité voor de Rechten van het Kind heeft vier algemene beginselen uit het verdrag gedistilleerd: het verbod van discriminatie (art. 2), het belang van het kind (art. 3), het recht op leven, overleven en ontwikkeling (art. 6) en het recht van het kind om zijn mening te uiten (art. 12).Summary: The Convention on the Rights of the Child is the most comprehensive instrument on children’s rights on an international level. It is innovative in its approach, incorporating both civil and political rights and economic, social and cultural rights. The combination of these two types of rights into one instrument highlights their indivisibility, interdependence, and the non-hierarchical relationship that exists between them. There is however a difference with regards to the obligations they entail for implementation: with regard to economic, social and cultural rights, State parties need to undertake implementation measures to the maximum extent of their available resources and, where needed, within the framework of international co-operation (Article 4). Another innovative aspect is the idea of participation: next to rights related to protection and the provision of services, children have the right to (actively) participate in shaping their own world and environment.

Onderwijs:AlgemeenSamenvatting: De EU besloot het VN-Verdrag inzake de rechten van personen met een handicap (UNCRPD), die in 2011 in werking trad. Het verdrag is bedoeld om ervoor te zorgen dat alle mensen met een handicap genieten van hun rechten op gelijke basis met anderen, en besteedt bijzondere aandacht aan de rechten van kinderen met een handicap. In dit verband bevat de UNCRPD verplichtingen voor de staatpartijen om alle nodige maatregelen te nemen om het volledige genot te verzekeren van alle mensenrechten en fundamentele vrijheden door kinderen met een handicap op gelijke voet met andere kinderen (art. 7 UNCRPD7), met inbegrip van het recht op onderwijs, op zorg binnen de gemeenschap, op gezondheid en op vrijetijdsbesteding. Artikel 7 is specifiek gewijd aan kinderen met een handicap. Artikel 16 maakt een verwijzing naar de maatregelen die de lidstaten moeten ondernemen voor de bescherming van kinderen met een handicap. Andere artikelen met expliciete betrekking tot kinderen zijn artikel 3, artikel 18, artikel 23, artikel 24 en artikel 30. Summary: The EU concluded the UN Convention on the Rights of Persons with Disabilities (UNCRPD) which entered into force in 2011. The Convention aims to ensure that all people with disabilities enjoy their rights on an equal basis with others and devotes specific attention to the rights of children with disabilities. In this regard, the UNCRPD sets out obligations for state parties to take all necessary measures to ensure the full enjoyment of all human rights and fundamental freedoms by children with disabilities on an equal basis with other children (Art. 7 UNCRPD7), including the right to education, to care within the community, to health and to leisure activities. Article 7 is specifically devoted to children with disabilities. Article 16 makes a reference to the measures that Member States must undertake in order to protect children with disabilities. Other articles referring to children explicitly include Article 3, Article 18, Article 23, Article 24 and Article 30.
