De Veiligheidsraad bevestigde haar veroordeling van het viseren van kinderen tijdens een gewapend conflict en de impact van zo'n conflict op kinderen. Alle landen moesten de daders van genocide, misdaden tegen de menselijkheid en oorlogsmisdaden stoppen en bestraffen. Alle partijen in gewapende conflicten werden opgeroepen internationale verdragen als het Kinderrechtenverdrag te respecteren, vluchtelingen, waarvan het merendeel vrouwen en kinderen zijn, te beschermen en hulpverleners toe te laten tot getroffen kinderen. Men was ook bezorgd om het verband tussen illegale grondstoffen- en wapenhandel en conflicten. Internationale organisaties namen nu initiatieven om iets te doen voor kinderen in conflicten. Summary: United Nations Security Council resolution 1314, adopted unanimously on 11 August 2000, after recalling Resolution 1261 (1999) on children and armed conflict and other resolutions including 1265 (1999), 1296 (2000) and 1306 (2000), the Council expressed concern at the impact of conflict upon children and the use of child soldiers, and expressed willingness to consider further measures under the United Nations Charter when dealing with situations of children in armed conflict. Unlike Resolution 1261 on the same topic, Resolution 1314 established more targeted measures to protect children during and after conflict. he Security Council reaffirmed its condemnation of the deliberate targeting of children during armed conflict and the impact of such conflict on children. It was the responsibility of all states to end the impunity of those guilty of genocide, crimes against humanity and war crimes. All parties involved in armed conflict were urged to uphold international law, particularly with regard to the Geneva Conventions and Additional Protocols, United Nations Convention on the Rights of the Child and Optional Protocol. Parties involved in conflict were called upon to provide protection and assistance to refugees and internally displaced persons, particularly women and children, and to facilitate the delivery of humanitarian aid. The Council expressed concern at connections between the illicit trade in natural resources and armed conflict, and illegal arms trafficking and armed conflict; in this regard, it announced its intention to consider further measures. The deliberate targeting of civilians, including children, constituted a violation of international humanitarian and human rights law. The resolution called for provisions to protect children including the disarmament, demobilisation and reintegration of child soldiers and inclusion of child protection advisers in peacekeepingoperations. Special importance was needed towards the vulnerabilites of girls affected by conflict. The Council reiterated its position that children should have access to basic services throughout conflict and post-conflict periods. It also indicated its willingness to consider unintended consequences on children of measures adopted under Article 41 of the United Nations Charter. Kinderen in kwetsbare situaties:Geweld / uitbuiting:Gewapend conflict:KindsoldatenSamenvatting: Resolutie 1379 van de Veiligheidsraad van de Verenigde Naties werd unaniem door de VN-Veiligheidsraad aangenomen op 20 november 2001. De Veiligheidsraad wilde aandacht schenken aan kinderen in gewapende conflicten en aan hen denken als over het mandaat van een vredesoperatie werd beslist. De strijdende partijen zouden desgepast worden opgeroepen maatregelen te nemen om vrouwen, kinderen en andere kwetsbare groepen te beschermen. Het was ook van belang dat hulpverleners ongehinderd toegang hadden tot alle kinderen. Ook de lidstaten, de Secretaris-Generaal, de gespecialiseerde VN-organisaties en internationale organisaties werden gevraagd aandacht te hebben voor getroffen kinderen en hun bescherming. De Secretaris-Generaal werd tenslotte nog gevraagd een lijst van partijen die kindsoldateninzetten op te stellen. Summary: United Nations Security Council resolution 1379, adopted unanimously on 20 November 2001, after recalling resolutions 1261 (1999), 1265(1999), 1296 (2000), 1306 (2000), 1308 (2000), 1314 (2000) and 1325 (2000), the Council considered provisions to protect children during peacekeeping operations and requested the Secretary-General to identify parties to conflict that used or recruited child soldiers. The Council pledged to consider the protection of children in armed conflict when discussing matters with which the Council was seized, and provisions for protecting children when considering the mandates of peacekeeping operations It supported ongoing work by Secretary-General, the Special Representative of the Secretary-General for Children and Armed Conflict, the United Nations Children's Fund, the United Nations High Commissioner for Refugees, the Office of the United Nations High Commissioner for Human Rights and others. The importance of unimpeded access for humanitarian organisations to areas of conflict, particularly for vulnerable groups, was stressed. It would also address the impact of sanctions on children. Furthermore, the Council intended to consider connections between armed conflict and terrorism, the illegal trade in precious minerals, illicit arms trafficking, and other criminal activities.
All parties to armed conflict were called upon to:
(a) respect international instruments relating to children in armed conflict;
(b) protect and provide assistance to refugees and internally displaced persons;
(c) promote and protect the rights of girls in armed conflict;
(d) abide by commitments made to the Special Representative of the Secretary-General for Children and Armed Conflict;
(e) provide protection for children in peace agreements.
All Member States, the Secretary-General, United Nations bodies and various international organisations were also asked to address the protection of children and child soldiers in areas of armed conflict. De Raad stond achter de oproep van de secretaris-generaal om een tijdperk te beginnen met internationale normen en standaarden voor de bescherming van kinderen in gewapende conflicten. Partijen die kindsoldaten inzetten werden opgeroepen hiermee onmiddellijk te stoppen. De secretaris-generaal had een lijst van dergelijke partijen aan zijn rapport toegevoegd. Bij de lidstaten werd aangedrongen op maatregelen om de illegale handel in lichte wapens aan conflictgebieden aan banden te leggen. Men was ook bezorgd om het seksueel geweld dat vooral tegen meisjes werd gepleegd; ook door hulpverleners en vredeshandhavers. Landen die vredeshandhavers aanleveren werden gevraagd een gedragscode uit te schrijven. Tenslotte werd de secretaris-generaal gevraagd tegen 31 oktober te rapporteren over onder meer:
a. De vooruitgang van de opgelijste partijen in het beëindigen van het gebruik van kindsoldaten,
b. Een beoordeling van de kinderrechtenschendingen in conflictgebieden en de rol van illegale grondstofontginning en wapensmokkel,
c. Voorstellen om beter toe te zien op de naleving van de internationale normen en standaarden voor de bescherming van kinderen in conflicten,
d. Richtlijnen om de specifieke noden van kinderen op te nemen in ontwapenings-, demobilisatie-, rehabilitatie- en herintegratieprogramma's, door bijvoorbeeld kinderbeschermingsadviseurs.Summary: United Nations Security Council resolution 1460, adopted unanimously on 30 January 2003, after recalling resolutions 1261 (1999), 1265(1999), 1296 (2000), 1306 (2000), 1308 (2000), 1314 (2000), 1325 (2000) and 1379 (2001), the Council called for the immediate end to the use ofchild soldiers and endorsed an "era of application" of international norms and standards for the protection of war-affected children. The resolution supported the call of the Secretary-General Kofi Annan for an "era of application" international standards concerning the protection of children in armed conflict. Parties to conflict that were using child soldiers were called upon to end such practices while a dialogue would be established with the parties to develop plans to end their recruitment and use. There was concern at the list of parties violating their international obligations attached in the annex of the Secretary-General's report and further steps would be taken. Member States were called upon to adopt measures through national legislation to control arms trafficking in states that did not respect international law (the Fourth Geneva Convention) relating to the military use of children and protection of civilians during war. The Council was determined to include provisions for the protection of children in the mandates of peacekeeping operations. There was concern at reports of sexual exploitation of women and children, particularly cases involving humanitarian workers and United Nations peacekeepers. The Security Council requested the implementation of counselling and HIV/AIDS testing services for United Nations peacekeepers, police and humanitarian personnel. All concerned parties and other states were called upon to ensure that the rights of children were incorporated into peace and disarmament, demobilisation and reintegration processes, and to abide by commitments made to the Special Representative of the Secretary-General for Children and Armed Conflict, Olara Otunnu. Finally, the Secretary-General was instructed to submit a report by 31 October 2003 on the implementation of the current resolution, including a specific section on the protection of children in all of his future country-specific reports. Het rekruteren van kindsoldaten, het doden en verminken van kinderen, verkrachting en seksueel geweld tegen vooral meisjes, ontvoering en gedwongen verhuizing, kinderen humanitaire hulp ontzeggen, scholen en ziekenhuizen aanvallen en kinderhandel, dwangarbeid en alle vormen van slavernij tegen kinderen werden sterk veroordeeld.
De Secretaris-Generaal werd gevraagd binnen de 3 maanden een actieplan op te stellen om systematisch en grondig toe te zien en informatie te vergaren over het gebruik van kindsoldaten. De Veiligheidsraad zelf was van plan maatregelen te nemen tegen het verband tussen gewapende conflicten en de illegale ontginnen van grondstoffen, illegale wapenhandel en grensoverschrijdende ontvoeringen en rekrutering.
De Secretaris-Generaal had een lijst opgesteld van partijen in conflicten die nog steeds kindsoldaten inzetten. Zij werden opgeroepen binnen de 3 maanden actieplannen op te stellen om hiermee te stoppen. Tegen partijen die weigerden en ook niet wilden onderhandelen, zouden gerichte maatregelen, zoals wapenembargo's, worden genomen.
Voorts was men bezorgd om de seksuele uitbuiting van vrouwen en meisjes in tijden van humanitaire crisis, onder meer ook door hulpverleners en vredeshandhavers.
De Raad verwelkomde ook initiatieven van internationale organisaties om kinderbeschermingsbeleid en -programma's op te zetten, erop toe te zien, er personeel voor te voorzien tijdens operaties en initiatieven te nemen om voor kinderen schadelijke activiteiten te stoppen.
Tenslotte werd de Secretaris-Generaal gevraagd tegen 31 oktober te rapporteren over de uitvoering van deze resolutie door de vernoemde partijen en de vooruitgang van het actieplan.Summary: The resolution began by condemning the use and recruitment of child soldiers, the killing and maiming of children, rape, sexual violence, abduction, forced displacement, denial of humanitarian access, attacks against schools and hospitals, child trafficking, forced labour and slavery. The Secretary-General Kofi Annan was asked to devise a comprehensive monitoring mechanism within three months on the recruitment and use of child soldiers and abuses committed against children.At the same time, the Council expressed its intention to consider further measures to end the link between the illegal trade of resources, arms trafficking, cross-border abduction, recruitment and armed conflict. All concerned parties were urged to respect international obligations applicable to them.
The Council was concerned at the continued recruitment of child soldiers by certain parties and called upon the parties to have plans ready in three months to end the use and recruitment of child soldiers, requested the Secretary-General to regularly review their compliance and expressed the intention to impose further measures against parties or countries that had not co-operated, such as arms embargoes. Meanwhile, it was decided to keep provisions specifically relating to the protection of children in the mandates of peacekeeping operations, including the deployment of child protection advisers. Such provisions for children would also be included in disarmament, demobilisation and reintegration programmes, and the Council emphasised that education would play an important role in the prevention of the recruitment of children in armed conflict.
Furthermore, the resolution requested the United Nations to implement HIV/AIDS education, testing and counselling services. It welcomed arrangements by regional and subregional organisations such as the European Union and Economic Community of West African States (ECOWAS) for the protection of children, encouraging the mainstreaming of such policies through advocacy, policies and programmes, developing monitoring mechanisms, establishing child protection mechanisms and the inclusion of child protection staff. The Council encouraged the strengthening of regional and local institutions.
