De Veiligheidsraad veroordeelt opnieuw het viseren van burgers tijdens een gewapend conflict. Ook het merendeel van de vluchtelingen tijdens zo'n conflict waren burgers, en zij hadden, onder het internationaal humanitair recht, recht op bescherming. Het viseren van dergelijke personen geldt als een schending van de mensenrechten. Het is belangrijk dat burgers toegang hebben tot humanitaire hulp. Ook het ontzeggen van die hulp is een schending van het internationaal recht. Het is wel van belang dat humanitaire organisaties dan neutraal blijven in het conflict.
VN-vredesmachten krijgen het nodige mandaat mee om burgers mee te beschermen, alsook ex-strijders en vooral kindsoldaten te ontwapenen. Ook kunnen maatregelen als tijdelijke veiligheidszones of corridors overwogen worden als genocide, mensenrechtenschendingen of oorlogsmisdaden tegen burgers dreigen.
De Veiligheidsraad neemt ook akte van de van krachtwording van het verdrag tegen antipersoonsmijnen uit 1997 en het positieve effect dat dat zal hebben op de veiligheid van burgers. Verder heeft de wijde verspreiding van lichte wapens een bijzonder destabiliserende impact en brengt dit ook de humanitaire hulp in gevaar.Summary: United Nations Security Council resolution 1296 was adopted unanimously on 19 April 2000. After recalling Resolution 1265 (1999), the Council discussed steps to enhance the protection of civilians during armed conflict. The Council strongly condemned deliberate attacks on civilians and emphasised the need to consider ways to best protect civilians. The majority of victims were internally displaced persons and vulnerable groups and therefore were afforded protection under international law. Systematic and widespread violations of international humanitarian and human rights law in situations of armed conflict could constitute a threat to international peace and security. It was important that civilians had access to humanitarian aid, and a denial of assistance constituted a violation of international law. At the same time, it was important that aid agencies remained neutral during conflict. The resolution notes that the Council would include measures for demobilisation, demilitarisation and reintegration of ex-combatants and child soldiers, disposal of weapons and ammunition, and resources for the protection of civilians in immediate danger. Such measures would include security zones or corridors to protect civilians and the facilitation of humanitarian assistance in instances of genocide, crimes against humanityand war crimes. The peacekeeping missions could also include a component for the dissemination of information on international law through mass media. The Security Council also took note of the entry into force of the Ottawa Treaty in 1997 and the positive impact it would have on the safety of citizens. Furthermore, the destabilising effect of small arms was recognised with regard to prolonging conflicts and distribution of humanitarian aid. Finally, the Secretary-General Kofi Annan was asked to continue his work and submit a report by 30 March 2001 on the situation of civilians in armed conflict. De Veiligheidsraad bevestigde haar veroordeling van het viseren van kinderen tijdens een gewapend conflict en de impact van zo'n conflict op kinderen. Alle landen moesten de daders van genocide, misdaden tegen de menselijkheid en oorlogsmisdaden stoppen en bestraffen. Alle partijen in gewapende conflicten werden opgeroepen internationale verdragen als het Kinderrechtenverdrag te respecteren, vluchtelingen, waarvan het merendeel vrouwen en kinderen zijn, te beschermen en hulpverleners toe te laten tot getroffen kinderen. Men was ook bezorgd om het verband tussen illegale grondstoffen- en wapenhandel en conflicten. Internationale organisaties namen nu initiatieven om iets te doen voor kinderen in conflicten. Unlike Resolution 1261 on the same topic, Resolution 1314 established more targeted measures to protect children during and after conflict. he Security Council reaffirmed its condemnation of the deliberate targeting of children during armed conflict and the impact of such conflict on children. It was the responsibility of all states to end the impunity of those guilty of genocide, crimes against humanity and war crimes. All parties involved in armed conflict were urged to uphold international law, particularly with regard to the Geneva Conventions and Additional Protocols, United Nations Convention on the Rights of the Child and Optional Protocol. Parties involved in conflict were called upon to provide protection and assistance to refugees and internally displaced persons, particularly women and children, and to facilitate the delivery of humanitarian aid. The Council expressed concern at connections between the illicit trade in natural resources and armed conflict, and illegal arms trafficking and armed conflict; in this regard, it announced its intention to consider further measures. The deliberate targeting of civilians, including children, constituted a violation of international humanitarian and human rights law. The resolution called for provisions to protect children including the disarmament, demobilisation and reintegration of child soldiers and inclusion of child protection advisers in peacekeepingoperations. Special importance was needed towards the vulnerabilites of girls affected by conflict. The Council reiterated its position that children should have access to basic services throughout conflict and post-conflict periods. It also indicated its willingness to consider unintended consequences on children of measures adopted under Article 41 of the United Nations Charter. Bij de lidstaten werd aangedrongen op een grotere vertegenwoordiging van vrouwen op alle beslissingsniveaus. De secretaris-generaal werd gevraagd meer vrouwen aan te stellen als Speciale Vertegenwoordiger of Gezant en hun rol in vredesoperaties, als bijvoorbeeld militair waarnemer, politie of mensenrechten- en humanitair personeel, te vergroten. Zelf zou de Veiligheidsraad hieraan denken bij vredesoperaties. Bij onderhandelingen en de uitvoering van vredesakkoorden moest worden gedacht aan de speciale noden van vrouwen en meisjes in het conflict, moesten vredesinitiatieven van lokale vrouwen gesteund worden en de mensenrechten van vrouwen en meisjes gerespecteerd. Partijen in gewapende conflicten werden opgeroepen maatregelen te nemen tegen specifiek geweld als verkrachting en ander seksueel misbruik. Ook moest het civiele karakter van vluchtelingenkampen gerespecteerd worden en gedacht worden aan vrouwen en meisjes tijdens het ontwerp ervan. Ook bij de ontwapening en demobilisatie van strijders moest gedacht worden aan de verschillende noden van vrouwen en mannelijke strijders. Summary: United Nations Security Council resolution 1325, adopted unanimously on 31 October 2000, after recalling resolutions 1261 (1999), 1265(1999), 1296 (2000) and 1314 (2000), the Council called for the adoption of a gender perspective that included the special needs of women and girls during repatriation and resettlement, rehabilitation, reintegration and post-conflict reconstruction. The resolution called upon all countries to allow increased representation for women at all levels. The Secretary-General, Kofi Annan, was requested to increase the participation of women at decision making levels in conflict resolution and peace process; appoint more women as Special Representatives and envoys; and expand their role in peacekeeping operations, particularly among military observers, police, human rights and humanitarian personnel. In this regard the Council expressed its willingness to incorporate a gender perspective into peacekeeping operations. The Security Council called upon all parties involved in negotiating and implementing peace agreements had to take into account the special needs of women and girls in armed conflict, support women's peace initiatives and implement international humanitarian law and human rights law that respects the rights of women and girls. Parties to armed conflict were also urged to take measures to protect women and girls from gender-based violence such as rape and other forms of sexual abuse, and to respect the humanitarian nature of refugee camps and take the needs of women and girls into their design. The resolution emphasised the responsibility of all countries to prosecute those responsible for crimes against them. During the disarmament, demobilisation and reintegration process, the differing needs of female and male ex-combatants had to be taken into account. Finally, the Secretary-General was requested to conduct a study concerning the impact of armed conflict upon women and girls, report its findings and on gender mainstreaming as a whole in United Nations peacekeeping missions. The resolution also calls upon all countries to respect fully international law applicable to the rights and protection of women and girls, in particular the obligation under the Geneva Convention of 1949 and Additional Protocol thereto of 1977, the Refugee convention of 1951 and the Protocol thereto of 1967, the Convention on the Elimination of All Forms of Discrimination Against Women and the Optional Protocol thereto of 1999, the Convention on the Rights of the Child and Optional Protocol on the Involvement of Children in Armed Conflict as well Optional Protocol on the Sale of Children, Child Prostitution and Child Pornography, to bear in mind the provisions of the Rome Statute of the International Criminal Court. Kinderen in kwetsbare situaties:Geweld / uitbuiting:Gewapend conflict:KindsoldatenSamenvatting: Resolutie 1379 van de Veiligheidsraad van de Verenigde Naties werd unaniem door de VN-Veiligheidsraad aangenomen op 20 november 2001. De Veiligheidsraad wilde aandacht schenken aan kinderen in gewapende conflicten en aan hen denken als over het mandaat van een vredesoperatie werd beslist. De strijdende partijen zouden desgepast worden opgeroepen maatregelen te nemen om vrouwen, kinderen en andere kwetsbare groepen te beschermen. Het was ook van belang dat hulpverleners ongehinderd toegang hadden tot alle kinderen. Ook de lidstaten, de Secretaris-Generaal, de gespecialiseerde VN-organisaties en internationale organisaties werden gevraagd aandacht te hebben voor getroffen kinderen en hun bescherming. De Secretaris-Generaal werd tenslotte nog gevraagd een lijst van partijen die kindsoldateninzetten op te stellen. Summary: United Nations Security Council resolution 1379, adopted unanimously on 20 November 2001, after recalling resolutions 1261 (1999), 1265(1999), 1296 (2000), 1306 (2000), 1308 (2000), 1314 (2000) and 1325 (2000), the Council considered provisions to protect children during peacekeeping operations and requested the Secretary-General to identify parties to conflict that used or recruited child soldiers. The Council pledged to consider the protection of children in armed conflict when discussing matters with which the Council was seized, and provisions for protecting children when considering the mandates of peacekeeping operations It supported ongoing work by Secretary-General, the Special Representative of the Secretary-General for Children and Armed Conflict, the United Nations Children's Fund, the United Nations High Commissioner for Refugees, the Office of the United Nations High Commissioner for Human Rights and others. The importance of unimpeded access for humanitarian organisations to areas of conflict, particularly for vulnerable groups, was stressed. It would also address the impact of sanctions on children. Furthermore, the Council intended to consider connections between armed conflict and terrorism, the illegal trade in precious minerals, illicit arms trafficking, and other criminal activities.
All parties to armed conflict were called upon to:
(a) respect international instruments relating to children in armed conflict;
(b) protect and provide assistance to refugees and internally displaced persons;
(c) promote and protect the rights of girls in armed conflict;
(d) abide by commitments made to the Special Representative of the Secretary-General for Children and Armed Conflict;
(e) provide protection for children in peace agreements.
All Member States, the Secretary-General, United Nations bodies and various international organisations were also asked to address the protection of children and child soldiers in areas of armed conflict.
