Mensenrechten:AlgemeenSamenvatting: Het Aziatische Mensenrechten Handvest is onderdeel van de poging om in Azië een populaire mensenrechtencultuur te creëren. In deel 10, erkent het Handvest dat de onderdrukking van kinderen vele vormen aanneemt. Wijdverbreide armoede, gebrek aan toegang tot onderwijs en sociale ontwrichting in landelijke gebieden behoren tot de oorzaken van de trends die de kwetsbaarheid van kinderen vergroten. Reeds lang gevestigde vormen van uitbuiting en misbruik, zoals gedwongen arbeid of het gebruik van kinderen voor bedelen of seksuele bevrediging staan positieve ontwikkeling ook in de weg. Als gevolg van patriarchale geslachtsvoorkeur en genitale verminking van vrouwen, wat op grote schaal toegepast wordt in sommige Aziatische landen, overleven vele meisjes hun eerste levensjaren niet. Lidstaten erkennen dat ze op meerdere vlakken gefaald hebben in de verzorging van kinderen en de voorziening van zelfs de basisbestaansmiddelen zoals onderdak. Daarom zijn alle Aziatische staten opgeroepen het Verdrag inzake de Rechten van het Kind te ratificeren en te implementeren. Summary: The Asian Human Rights Charter is part of the attempt to create in Asia a popular culture on human rights. In Part 10, the Charter recognises that the oppression of children takes many forms. Widespread poverty, lack of access to education and social dislocation in rural areas are among the causes of the trends which increase the vulnerability of children. Long-established forms of exploitation and abuse, such as bonded labour or the use of children for begging or sexual gratification are rampant. Female infanticide due to patriarchal gender preference and female genital mutilation are widely practised in some Asian countries. States acknowledge that they have failed dismally to look after children and provide them with even the bare means of subsistence or shelter. Therefore, all Asian states are called upon to ratify and implement the Convention on the Rights of the Child. Het bevat een analyse op de banden tussen kinderrechten, het welzijn van kinderen en kinderarmoede, de dimensies en de staat van kinderarmoede en de beleidsmogelijkheden om het aan te pakken. Het boek onthult dat een hoge graad van economische groei en de daling van inkomensarmoede niet automatisch vertaald worden in de verbetering van het welzijn van kinderen. Het vestigt ook de aandacht op het feit dat politiek engagement en goed leiderschap de meest kritieke factoren zijn om met succes een beleid en programma’s uit te stippelen om kinderarmoede uit te roeien. Een onderdeel van dit boek is toegewijd aan de impact van de huidige financiële crisis op kinderen in Afrika. Summary: This book is unusual in several respects. It looks at child poverty and policy experience not only in Africa but also in Asia and industrialised and transition economies. It contains a wealth of information and analysis on the linkages between child rights, child wellbeing and child poverty, the dimensions and state of child poverty and the policy options for tackling it. The book reveals that high rates of economic growth and reductions in income poverty do not automatically translate into improvements in the wellbeing of children. It also draws attention to the fact that political commitment and good leadership are the most critical factors in the successful delivery of policies and programmes for eradicating child poverty. A section of the book is devoted to the impact of the current financial and economic crises on children in Africa.

Overeenstemming met internationale verplichtingen onder het VRK legt aanzienlijke vereisten op voor kleine ontwikkelingslanden, zoals deze die men kan vinden in de zuidelijke regio van de Stille Oceaan, waar kinderen één derde uitmaken van de gehele bevolking van vele eilanden. De nadruk wordt gelegd op strafrecht en familierecht. De paper gaat na hoe de lokale rechtbanken omgaan met het Verdrag en de uitdagingen die opkomen in de plurale rechtsystemen die worden gekarakteriseerd door een gebrek aan wettelijke hervormingen en middelen. De huidige ervaringen van de traditionele sociale orde eert kinderen maar aanziet hen niet noodzakelijk als rechthebbenden. Summary: While children are universal, recognising and giving practical effect to their rights is not. Compliance with international obligations under the UNCRC imposes considerable demands on small developing nations, such as those found in the south Pacific region, where children make up over a third of the total population of many island states. Focusing on criminal and family law this paper considers how the local courts are engaging with the Convention and the challenges which arise in plural legal systems characterised by lack of legal reform and lack of resources, in which the contemporary experience of raditional social ordering may value children but not necessarily see them as right holders. Dit gebeurde onder toezicht van Childwatch International, een globaal onderzoeksnetwerk. Het onderzoekt de socio-culturele context van de participatierechten van kinderen in die vijf landen, in verhouding tot de verplichtingen die op deze landen rusten, als verdragspartijen bij het IVRK. Hoewel het juridisch afdwingen van participatie aanzienlijke gevolgen heeft voor de levens van kinderen en relaties tussen volwassenen en kinderen, werd hierover nog niet veel onderzoek verricht, intercultureel in het bijzonder. Summary: This edited book is the result of collaboration between five countries in the Asia Pacific Region. It is auspiced by Childwatch International, a global research network. It explores the socio-cultural context of children's participation in the five countries, in response to the obligations on these countries, as signatories to the UN Convention on the Rights of the Child. While the legal mandating of participation has significant implications for children's lives and adult-child relations, research in this area has been limited, particularly cross culturally.
