Kinderrechten (algemeen):AutonomieSamenvatting: Dit artikel presenteert een discussie over de klinische verwijzing van een pediatrische HIV-patiënt naar buitenbeschermingsdiensten als een poging om haar antiretrovirale medicijnen te laten nemen. Het vertrekt vanuit op het moeilijke geval van Andrea, waargenomen op een kinder-hiv-kliniek. Ik beweer dat kinderbescherming de lijn tussen adolescentie en volwassenheid afdwingt door in te grijpen in het leven van patiënten onder de redenering dat kindpatiënten kwetsbaar zijn en niet in staat zijn om geïnformeerde levenskeuzes te maken. Kinderbescherming is in strijd met het klinisch beleid dat probeert om van patiënten verantwoordelijke volwassenen te maken voordat ze de pedriatische afdeling verlaten door adolescenten richting diensten te vervreemden. Summary: This article presents a discussion about the clinical referral of a paediatric HIV patient to outside child protection services as an attempt to make her adhere to antiretroviral medicine. It draws on the difficult case of Andrea, observed at a paediatric HIV clinic. I argue that child protection enforces the line between adolescence and adulthood by intervening into patient lives under the rationale that child patients are vulnerable and not capable of making informed life choices. Child protection contradicts clinical policies that attempt to make patients responsible adults before leaving the paediatric ward by alienating adolescents towards services. betrokken zijn bij claims omtrent de gezondheid van kinderen die gebaseerd zijn op
concurrerende rechten. De toetsing van de belangen van het kind vormt het Leitmotiv. De ouderlijke verantwoordelijkheden worden als startpunt afgewogen tegen
de belangen van de Staat en het kind die een potentieel tegengewicht vormen. De
bijdrage wil in kaart brengen welke impact kinderen werkelijk hebben op de beslissingen inzake gezondheidszorg die hen betreffen. Kinderen kunnen betrokken zijn
bij het beslissingsproces via hun recht op participatie vervat in artikel 12 IVRK, maar
de impact die hun opvattingen zullen hebben is een kwestie van bekwaamheid. De
rechten van het kind om betrokken te worden bij medische beslissingen moeten
evenwel worden bekeken in het licht van beslissingen van volwassenen. De stem van
het kind zal worden afgewogen tegenover de visie van zijn ouders, de Staat en de
medische beroepsbeoefenaars. De auteur komt tot de conclusie dat, ondanks het
feit dat er globaal meer inspanningen worden geleverd om kinderen te betrekken bij
beslissingen omtrent hun gezondheid, de ouders toch nog de belangrijkste actoren
blijven en de sterkste stem hebben in de finale beslissing. De Staat speelt een ondersteunende rol om ouders toe te laten hun verantwoordelijkheden te nemen – enkel in zeldzame gevallen zal de Staat tussenkomen en ouderlijke beslissingen terzijde
schuiven.Summary: Using a ‘best interest’ test as Leitmotiv, this essay aims to analyse the influence of
the different parties involved in competing rights claims concerning children’s
health. As the starting point of parental responsibility is being balanced against the
potentially countervailing interests of the State and the child, this contribution aims
to assess the impact children actually have in health care decisions that concern
them. While children can be involved in the decision-making through the right to
participation of Article12 CRC, the impact their views will have is an issue of capacity. These rights of the child to be involved in medical decisions are however to be
considered in the light of adult decisions. The child’s voice will be balanced against
the views of the parents, the State and the medical professionals. This essay comes
to the conclusion that while there is an overall increasing effort to involve children
in health care decisions, parents remain the main actors and have the strongest say
in the final outcome. The State plays a supporting role by enabling parents to take
upon their responsibilities – but only in rare cases will the State step in and override

De ziekte van Huntington kan gezien worden als een ziekte van de hele familie. Jongeren die leven in een gezin waarin de ziekte van Huntington voorkomt, beschrijven dit vaak als iets verborgen, isolerend en dat men slechts weinig ondersteuning krijgt van leeftijdsgenoten of andere volwassenen. Er wordt aan hen slechts weinig de vraag gesteld over wat zij weten over de ziekte, welke impact dat heeft op hun leven en gezondheid terwijl men in contact gebracht wordt met lotgenoten in gelijkaardige situaties. Ook voor ouders is het vaak niet gemakkelijk hoe, wat en wanneer men dit precies te vertellen aan de kinderen. Summary: Affecting over 30,000 people, with approximately 200,000 at risk in the United States, Huntington's disease (HD) is often called a disease of the family (Huntington's Disease Society of America, 2015). HD, with its complicated, stigmatizing symptoms (involuntary movement, slurred speech and cognitive impairment), commonly manifests during ones 30′s and 40′s during which children are often present in the home. Living with a parent or family member with HD can be emotionally charged, particularly given the knowledge of the 50% inheritance rate (Forrest Keenan, Miedzybrodzka, Teijingen, McKee, & Simpson, 2007), manifesting concern about whether they will inherit and when they might test for the disease (Driessnack, Williams, Barnette, Sparbel, & Paulsen, 2012).
Moreover, many children and youth participate, at often-intense levels and complexity, in caregiving for the parent or family member (Kavanaugh, 2014). With inconsistent knowledge of HD and attention paid to HD families by health and social service providers (Helder et al., 2002 ; Lowit and van Tiejlingen, 2005), youth in HD families describe secrecy (Williams et al., 2013), isolation, and little support from peers and other adults (Kavanaugh, Noh, & Studer, 2015). Youth in families with HD are infrequently presented with an opportunity to explore what they know about HD, how it affects them and their well-being, while connecting with “like peers” in similar situations.
In families with illness, youth well-being is often influenced by what they are or are not told about the parent's illness (Muckherjee, Sloper, & Lewin, 2002). While many families struggle with what to tell their children, it is clear children and youth need support in helping them deal with a parental illness (Spath, 2006). Youth in families with HD desire information about the disease process and the possibility they themselves might be at risk – while clearly stating the need to be in supportive environments with other “like youth” where they feel normal and less “othered.” (Kavanaugh et al., 2015). Yet, these youth may be kept in the dark about their risk of inheritance and HD in general, as many parents struggle with how, what, and when to tell them (Forest Keenan, Teijlingen, McKee, & Miedzybrodzka, 2009).

De auteur argumenteert dat de trope van het aids-weeskind een reeks agenda’s dient, waaronder voor academisch onderzoek. In het bijzonder vertegenwoordigen weeskinderen het karakteristieke kinderagens, gevierd in sprookjes en fictie. Tenslotte onderzoekt de auteur hoe dit heeft geleid tot een beleidsreactie - opleidingsbeurzen - die de armoede in de regio niet adequaat aanpakt. Summary: Policy, interventions and research concerning southern African children remain dominated by a focus on AIDS-related orphanhood, although the association between orphanhood and disadvantage is highly questionable. The author argues that the trope of the AIDS orphan serves a range of agendas, including for academic research. In particular, orphans represent the quintessential child-agent, celebrated in fairytales and fiction. Finally, the author examines how this has led to a policy response – education bursaries – that cannot adequately address childhood poverty in the region. Onderwijs:AlgemeenSamenvatting: Door de vooruitgang van medische kennis en de verbeterde therapeutische mogelijkheden groeien kinderen met een chronische aandoening op tot volwassenen die actief wensen te participeren aan het maatschappelijk gebeuren. Kinderen en jongeren met specifieke gezondheidsnoden botsen vaak op barrières die een succesvolle schoolloopbaan hypothekeren. Deze barrières zijn niet alleen toe te schrijven aan de gevolgen van hun aandoening maar evenzeer aan belemmerende factoren die ze ervaren in de onderwijscontext. In dit artikel wordt vooreerst ingegaan op de problematiek van kinderen en jongeren met specifieke gezondheidsbehoeften (prevalentie, gevolgen voor functioneren en ontwikkeling, en modellen om hun functioneren in beeld te brengen) en de onderwijsen opvoedingsbehoeften die hiermee gepaard gaan, om vervolgens de wet- en regelgeving te belichten die hun recht op onderwijs moeten garanderen. In Vlaanderen werd internationale regelgeving vertaald naar het zogenaamde M-Decreet dat meer waarborgen biedt op toegang tot een school naar keuze voor kinderen met specifieke onderwijsbehoeften. Summary: Due to the advancement of medical knowledge and the improved therapeutic possibilities children with a chronic disease grow up into adults who actively want to participate in social life. Children and young people with special health needs are often confronted with barriers that hamper successful schooling. These barriers are not just related to their health condition but also to impeding factors they experience in the educational context. This article firstly discusses the issue of children and young people with special health needs (prevalence, impact on functioning and development, and models to describe their functioning) and the educational needs related to this. Secondly, laws and regulations warranting their right to education are highlighted. In Flanders, international regulation has been translated into the so-called M-decree that provides more guarantees of access to a school of choice for children with special educational needs.
