Kinderrechten zijn een belangrijk onderzoeksveld geworden in de voorbije decennia, voornamelijk als gevolg van het aannemen van het VN Verdrag inzake de Rechten van het Kind (VN VRK) in 1989. Vandaag de dag is het bijna ondenkbaar om wetenschappelijk werk over kinderrechten te verrichten zonder het Verdrag op te nemen als de ondersteuning van het debat over kinderrechten. Het doel van dit artikel is om op kritische wijze academisch onderzoek over het VN VRK na te gaan. Door gebruik te maken van een analyse over het discours van de internationale literatuur, maakt het artikel een optekening van het academische discours over kinderrechten. Drie thema’s die het meeste voorkomen in de academische werken over het VN VRK worden geïdentificeerd: (1) autonomie en participatierechten als de nieuwe norm in de gebruiken van kinderrechten en de beleidsvoering; (2) kinderrechten vs. ouderlijke rechten; en (3) de globale kinderrechten industrie. Het feit dat deze drie thema’s het huidige wetenschappelijke werk over het VN VRK onderscheiden is misschien geen toeval, na analyse van de processen van ‘educationalization’ die de kindertijd in de westerse maatschappij heeft gekarakteriseerd sinds de 19e eeuw. Het perspectief van educationalization geeft een moderne onderzoeksagenda weer voor kinderrechten in de komende decennia. |

Children’s rights have become a significant field of study during the past decades, largely due to the adoption of the United Nations Convention on the Rights of the Child (UNCRC) in 1989. Today, scholarly work on children’s rights is almost inconceivable without considering the Convention as the bearer of the children’s rights debate. The goal of this article is to critically explore academic work on the UNCRC. By means of a discourse analysis of international literature, the article maps the academic discourse on children’s rights. Three themes are identified that predominate in the academic work on the UNCRC: (1) autonomy and participation rights as the new norm in children’s rights practice and policy, (2) children’s rights vs parental rights and (3) the global children’s rights industry. That these three themes distinguish contemporary scholarly work on the UNCRC might not be a coincidence, analysed from the process of ‘educationalization’ that has characterized childhood in western societies since the 19th century. The perspective of educationalization presents a contemporary research agenda for children’s rights for the coming decades. |
