Als logisch gevolg is de implementatie van meer kinderrechten beter voor kinderen. Maar is dit ook echt het geval? In deze paper wordt er getracht deze vraag op een kritische manier te beantwoorden. Het probleem met deze vraag is echter dat het van meet af aan wordt overschaduwd door een zeer gepolariseerde discussie tussen wat Stammers (2009) aan de ene kant ‘niet-kritische voorstanders’ en aan de andere kant ‘niet-kritische tegenstanders’ noemt. Deze eerste groep heeft een blind geloof in de voor de hand liggende positieve effecten op kinderrechten. De laatste groep ontkent op radicale wijze de waarde die kinderrechten kunnen uitoefenen teneinde meer respect voor kinderen te realiseren. Geen enkele positie is constructief in het versterken van het kader van kinderrechten aangezien ze beiden vertrekken van ‘consensus denken’ over kinderrechten. Wat er ontbreekt in het denken van kinderrechten is ‘kritiek’, het bevragen en analyseren van de assumpties die zijn ingewerkt in de huidige praktijk op het gebied van kinderrechten. In dit artikel worden er argumenten gegeven voor de ontwikkeling van een traditie van ‘kritische voorstanders’ in de kinderrechten als een pleidooi voor een traditie van ‘kritische studies van kinderrechten’. Summary: Practices in the field of children’s rights presuppose an agreement on what children’s rights are. Consequently, the implementation of more children’s rights is logically better for children. But is this really the case? In this paper, we try to answer this question critically. The problem with this question however is that from the outset, it becomes overshadowed by a highly polarised discussion between what Stammers (2009) calls ‘uncritical proponents’ at the one hand and ‘uncritical opponents’ at the other hand. The former have a blind belief in the obvious positive effects of children’s rights. The latter radically deny the value children’s rights can have in the aim to realise a greater respect for children. Neither positions are constitutive in strengthening the framework of children’ rights since they both start from a ‘consensus thinking’ on children’s rights. What current thinking in children’s rights lacks is “critique”, considered as questioning and analyzing assumptions that are embedded in current practices in the field of children’s rights. In this article, we argue for the development of a tradition of “critical proponents” in children’s rights in a plea for a tradition of ‘critical children’s rights studies’. Dit doctoraatsproject beoogt een bijdrage te leveren aan een ‘sociaal werk benadering van kinderrechten’. De discussie over kinderrechten en haar betekenis in relatie tot sociaal werkpraktijken wordt in deze doctoraatsstudie gevat onder de notie ‘kinderrechteneducatie’. De vraag die centraal staat is of en hoe praktijken van kinderrechteneducatie (kunnen) bijdragen tot een besef van menselijke waardigheid en sociale rechtvaardigheid, dan wel dat praktijken van kinderrechteneducatie dit leerproces inperken of belemmeren. Als casus wordt het kinderrechtendebat in Vlaanderen geanalyseerd. Naast een historische analyse, waarbij wordt ingegaan op de betekenis van de kinderrechtenbeweging in Vlaanderen, in het bijzonder in relatie tot de jeugdbescherming, maken twee themagerichte deelstudies onderdeel uit van dit onderzoek: een analyse van de discussie over de kinderbijslag als recht van het kind enerzijds en een analyse van de discussie over het jeugdsanctierecht anderzijds. De studie toont aan dat i) kinderrechteneducatie kinderrechten zowel in continuïteit als discontinuïteit met het pedagogiseringsproces plaatst; ii) Kinderrechteneducatie zowel drager is van aandacht voor kinderen als van selectiviteit ten nadele van maatschappelijk kwetsbare kinderen en iii) kinderrechteneducatie de aandacht vestigt op het debat bescherming vs. participatie, eerder dan op belang van provisierechten. Als conclusie van de studie wordt een pleidooi gehouden om kinderrechteneducatie te beschouwen als een expressie van mensenrechten. Dit behelst onder meer een grotere nadruk op het herverdelingsvraagstuk, het belang van een ‘resourcist-view’ op kinderrechten en de noodzaak van kritische analyse van praktijken van kinderrechteneducatie. Summary: In spite of the attention for children’s rights in policy and practice, there is little interest in scientific research on children’s rights, in particular in the field of social work. This doctoral study aims to contribute to the development of a ‘social work approach of children’s rights’. In this doctoral study, the relevance of children’s rights for social work practices is grasped through the notion of children’s rights education. The main question is whether practices of children’s rights education hinder or rather contribute to learning processes aiming to develop a sense of human dignity and social justice, and how they do so. The research focuses on the children’s rights debate in Flanders. Besides a historical analysis, which examines the significance of the children’s rights movement in Flanders specifically in relation to youth protection, two thematic studies are carried out: an analysis of the discussion of child benefit as a right of the child on the one hand and an analysis of the debate on youth sanction law on the other. The results show that i) practices of children’s rights education put children’s rights in both continuity and discontinuity with the process of educationalisation; ii) practices of children’s rights education are a bearer of attention for children as well as of selectivity for socially vulnerable children and iii) practices of children’s rights education highlight the debate on protection vs. participation, rather than provision rights. Based on these results, an argument is made to regard practices of children’s rights education as an expression of human rights. This includes a greater emphasis on the debate on the redistribution of social goods, the importance of a ‘resourcist-view’ on children’s rights and the need for critical analysis of practices of children’s education. De focus tijdens een verblijf in de gemeenschapsinstelling ligt dan zowel op bescherming van de jongere zelf, als op beveiliging van de maatschappij. Dit is zowel voor de jongeren als voor hun omgeving een zeer ingrijpende maatregel. In deze longitudinale studie gaan we met behulp van zowel kwalitatieve als kwantitatieve methoden na hoe jongeren dit beleven, hoe ze hun kwaliteit van leven ervaren tijdens en na een verblijf in de gemeenschapsinstelling, en wat mogelijke risico- en beschermende factoren zijn ten aanzien van het (opnieuw) plegen van feiten. We vertrekken hierbij vanuit een sterktegerichte visie, gebaseerd op het Good Lives Model for offender rehabilitation (GLM), een theoretisch rehabilitatiekader dat oorspronkelijk ontwikkeld werd voor volwassen delictplegers. Meer bepaald willen we volgende belangrijke hypothese van het GLM onderzoeken bij jongeren in de gemeenschapsinstelling: “een goed leven kan een bufferende rol spelen bij de kans op recidive”, of met andere woorden, een hogere mate van welzijn op verschillende levensgebieden kan leiden tot een lagere mate van betrokkenheid in criminele activiteiten. Verder willen we, vanuit het standpunt van jongeren zelf, te weten komen wat zij als ondersteunend ervaren (hebben) gedurende hun traject. De studie wordt uitgevoerd in gemeenschapsinstelling De Zande, met campussen te Ruiselede, Wingene en Beernem. Summary: Adolescents can be referred to a closed institution for forced care and treatment by the Juvenile Judge in case of an act defined as an offense, or in case of a problematic or alarming living situation. As a consequence, closed institutions focus on both protecting and securing the adolescents and the broader society. This is a very far-reaching measure for both the adolescent and his/her context. In this longitudinal study we investigate, by means of both qualitative and quantitative research methods how adolescents experience this, how they evaluate their Quality of Life during and after stay in the closed institution, and which risk and protective factors regarding reoffending can be distinguished. Based on the Good Lives Model for offender rehabilitation (GLM), we want to study the hypothesis that experiencing a higher Quality of Life may reduce the chances of engagement in criminal activities.
