In de White Paper van de Britse regering met de naam “Geen excuses meer” (Home Office, 1997), wordt een plan voorgesteld om de cultuur van de jeugdrechtbank te wijzigen. Dit artikel focust op één cruciaal aspect van de hervormingsplannen: de idee dat magistraten contact moeten leggen met jonge delinquenten en hun families. Na een theoretische analyse van de basis van en de verantwoording voor een speciale jeugdrechtbank, stelt het artikel enkele vaststellingen voor inzake verschillen tussen de communicatieculturen van jeugdrechtbanken in Engeland/Wales en Nederland. Het artikel sluit af met het in vraag stellen van de basisveronderstelling van de White paper, namelijk dat fundamentele veranderingen kunnen worden gerealiseerd zonder structurele hervormingen. |

The UK Government’s White Paper ‘No More Excuses’ (Home Office, 1997) set out plans for changing the culture of the Youth Court. This article focuses on one crucial aspect of the reform plans: the idea that magistrates need to engage with young offenders and their families. After a theoretical analysis of the foundation and justification for a special youth court, the article presents some findings concerning differences between the communication cultures of English/Welsh and Dutch Youth Courts. The article concludes by questioning the basic assumption of the White Paper, that fundamental changes could be realised without structural reform. |
