Dit artikel stelt de normatieve universaliteit van kinderrechten in vraag door de ideale definitie van kindertijd na te gaan die impliciet opgenomen is in het VN Verdrag inzake de Rechten van het Kind en andere internationale wettelijke documenten. Er wordt gekeken of deze definitie universele kracht heeft in het licht van verschillende noties van kindertijd die voorkomen over de hele wereld. Het artikel maakt een onderscheid tussen de rechten van kinderen als mensen, en rechten die ze verkrijgen als gevolg van hun leeftijd. Deze laatste rechten worden als problematisch aanzien, en het artikel toont dit aan met voorbeelden die de noties van kindertijd, onderliggend aan het VRK, uitdagen. Het artikel presenteert alternatieven die conflictueus kunnen zijn ten aanzien van aannames die aan de grondslag van het VRK liggen, en dagen de universele natuur van de vastgelegde rechten uit. |

The article questions the normative universality of children's rights by considering the ideal definition of childhood implicit in the UN Convention on the Rights of the Child and other international law documents. It questions whether this definition has any universal purchase in light of different conceptions of childhood held across the world. The article distinguishes between rights that children have as human beings, and rights they are regarded as having by virtue of their age. The latter are regarded as problematic and the article illustrates this with examples that challenge the conception of childhood underlying the CRC. The article presents alternatives that may conflict with the assumptions underlying the CRC, and challenges the universal nature of the rights enshrined. |
