In deze Algemene Commentaar behandelt het Comité het recht van het kind op bescherming tegen lijfstraffen en andere wrede of vernederende vormen van straf. In het licht van het doel van het Comité om geweld tegen kinderen uit te roeien, onderstreept deze tekst het recht van het kind op respect voor zijn of haar menselijke waardigheid, fysieke integriteit en gelijke bescherming voor de wet. Het Commentaar begint met het schetsen van de achtergrond van het probleem en het definiëren van een aantal termen. Het gaat verder met mensenrechtenstandaarden en lijfstraffen voor kinderen. Daarna behandelt het maatregelen en mechanismen (wettelijk, m.b.t. implementatie, onderwijs, toezicht, etc.) om zulke vormen van straf uit te roeien. Een laatste paragraaf behandelt rapportagecriteria onder het Verdrag. |

In this General Comment, the Committee discusses the right of the child to protection from corporal punishment and other cruel and degrading forms of punishment. In the context of the Committee’s aim to eliminate violence against children, this GC highlights the child’s right to respect for his or her human dignity, physical integrity and equal protection under the law. The GC starts off with sketching the background to this problem and providing a number of definitions. It continues with the human rights standards and corporal punishment of children. Then it addresses measures and mechanisms required to eliminate such forms of punishment (legislative, implementation, education, monitoring etc.). In a final paragraph the GC discusses States’ reporting requirements under the Convention. |
