In deze Algemene Commentaar behandelt het Comité de verplichtingen van lidstaten onder artikel 12 van het Verdrag, met een focus op het recht van het kind om gehoord te worden. Aangezien dit één van de fundamentele pijlers van het Verdrag is, moet dit recht volledig begrepen en in de praktijk toegepast worden. Daarom behandelt deze tekst een aantal basisaspecten van dit recht en legt het een link naar de concrete verplichtingen van de Staat. Het begint met artikel 12 te identificeren als een recht dat zowel voor individuele kinderen als voor groepen kinderen geldt. Dit wordt ondersteund door een wettelijke analyse, een link met andere bepalingen uit het Verdrag, een stuk over implementatie in verschillende omgevingen en situaties, basisvoorwaarden voor implementatie, en een aantal conclusies. |
| Summary: |
In this General Comment, the Committee discusses the obligations of State parties under Article 12 of the Convention, concentrating on the right of the child to be heard. Constituting one of the fundamental values and principles of the CRC, this right requires full understanding and implementation in practice. Therefore, this GC addresses a number of fundamental aspects of this right and relates it to State parties’ concrete obligations. It starts off by identifying Article 12 as a right both of the individual child and of groups of children. This is supported by a legal analysis, a link with other CRC provisions, a section on implementation in different settings and situations, basic requirements for implementation, and a number of conclusions. |
